The Justice Department and FBI have formally acknowledged that nearly every examiner in an elite FBI forensic unit gave flawed testimony in almost all trials in which they offered evidence against criminal defendants over more than a two-decade period before 2000.

Of 28 examiners with the FBI Laboratory’s microscopic hair comparison unit, 26 overstated forensic matches in ways that favored prosecutors in more than 95 percent of the 268 trials reviewed so far, according to the National Association of Criminal Defense Lawyers (NACDL) and the Innocence Project, which are assisting the government with the country’s largest post-conviction review of questioned forensic evidence.

The cases include those of 32 defendants sentenced to death. Of those, 14 have been executed or died in prison, the groups said under an agreement with the government to release results after the review of the first 200 convictions.

The FBI errors alone do not mean there was not other evidence of a convict’s guilt. Defendants and federal and state prosecutors in 46 states and the District are being notified to determine whether there are grounds for appeals. Four defendants were previously exonerated.

The admissions mark a watershed in one of the country’s largest forensic scandals, highlighting the failure of the nation’s courts for decades to keep bogus scientific information from juries, legal analysts said. The question now, they said, is how state authorities and the courts will respond to findings that confirm long-suspected problems with subjective, pattern-based forensic techniques — like hair and bite-mark comparisons — that have contributed to wrongful convictions in more than one-quarter of 329 DNA-exoneration cases since 1989.

  美国媒体18日报道,美国司法部和联邦调查局(FBI)承认,在2000年以前的20多年里,FBI法医物证鉴定部门的绝大多数工作人员在多起涉及毛发比对鉴定的案件中给出了有瑕疵、不利于被告的证词。换句话说,这些不可靠的证据或许已致全美数以百计的人蒙冤入狱,难证清白。

  【工作有缺陷】

  《华盛顿邮报》报道,美国全国刑事辩护律师协会和法律援助机构“无辜项目”自2012年起对1972年至1999年间毛发物证鉴定存疑的2500起案件展开审查。截至3月初,342起案件的判决结果已经完审,包括268起FBI法医物证鉴定人员给出对被告不利的毛发比对结果的案件。

  审查人员发现,FBI物证鉴定实验室毛发比对部门共有28名工作人员。在这268起涉及谋杀、强奸和其他暴力犯罪的案件中,26名鉴定人员就254起案件夸大了毛发比对结果从而使其有利于检方,比例高达95%。这些案件中,32名被告被处以极刑,其中14人被执行死刑或在狱中身亡。

  按审查人员的说法,所谓“夸大”是指FBI物证鉴定人员以不完整或有误导的数据作为理论依据,进而给出犯罪现场遗留的毛发与被告相匹配的证词。

  《华盛顿邮报》说,虽然除FBI物证鉴定结果之外还有其他证据可以证明被告有罪,但从2000年之后修订的物鉴标准来看,鉴定人员在那一时期工作上的缺陷很有可能导致冤案发生。

  更可怕的是,这批FBI物证鉴定人员还参与培训了500至1000名州和地方一级的物证鉴定人员,指导他们以同样的工作方式为法庭提供证词。

  【追索有难度】

  全国刑事辩护律师协会和“无辜项目”的这一发现引发美国司法界一片哗然。一些人将批评矛头直指FBI,称后者“30年来运用微观毛发分析来为被告定罪的做法是一场彻头彻尾的灾难”。

  “这些发现令人不寒而栗……是对我们刑事司法体系的拷问,”检察官出身的联邦参议员理查德·布卢门撒尔说,“那些原本清白无辜的人可能已经含冤入狱甚至被执行死刑,忠实践行法律的检察官也被捏造、虚假的证据蒙蔽了双眼。”

  针对可能出现的冤假错案,美国司法部和FBI在一份声明中说,他们“会努力确保将FBI物证鉴定人员过去的疏失告知那些受影响的被告,保证正义在每一起案件中得到伸张。今后,司法部和FBI将致力于确保毛发分析的准确性,执行好物证鉴定科学的所有规程。”

  不过,弗吉尼亚大学法律教授布兰登·加勒特认为,鉴于美国刑事司法体系中的种种法律规定,被定罪的罪犯想要挑战多年前的证据并非易事。

  “处理我们刑事司法体系中系统性差错的工具并不存在,”加勒特说,FBI需要为自身的工作疏失承担责任,“但问题是,或许没有几个法官、检察官或辩护律师有能力或有意愿做点什么。”(闫洁)
