“I would rather go to jail than break my promise about being together forever,” says offender.
TAIPEI, Taiwan - The Taipei Shilin District Court Monday found a 36-year-old teacher who was sexually involved with a 14-year-old student guilty of "offenses against sexual autonomy," sentencing her to eight months in prison. "I would rather go to jail than break my promise about being together forever," said Liu Hsiao-min, the offender and former Taipei City Jing Xing Elementary School teacher, in court to the judge.
Liu, an unmarried elementary school English teacher, is guilty for the eight counts of intercourse she had with a 14-year-old eighth grade male student from a different school. The illegal acts took place in the span of two months, from February to April.
According to court documents, the two met through their mutual love of badminton in January. They started meeting up for games at the gyms of their respective schools and slowly fell in love.
The unlikely couple started "officially" dating by the end of the month, calling each other "boyfriend" and "girlfriend." Over winter break, the teenager invited Liu to his Taipei City, Wenshan District home after a game of badminton and asked to have sex with her. Liu allegedly could not resist her boyfriend's request; hence on February 8 around 2pm, the couple consummated their relationship for the first time.
In court, Liu would insist that she did not initiate the physical relationship, although she did admit to seven other instances of consensual sex, some of which occurred at her Shichi City home.
By April, the teenager's mother had noticed that her son was behaving strangely, with phone bill fees through the roof. When she found pictures of him posing intimately with a mature-looking lady, the mother extracted everything from her son, including the fact that he and Liu had had sex eight times.
The mother called abuse hotlines and filed a report at the Women's and Children's Protection Division of the Taipei City Police Department. Police found Liu at her home and confiscated over 30 photos of the couple together. Liu admitted to sleeping with the adolescent and that she knew he was only 14 years old.
In court, the teacher reportedly claimed that she could not live without her young lover and refused to be the one to break things off. Her remarks greatly agitation the boy's parents, who attended court proceedings on his behalf.
Although Liu was clearly having sex with a minor, the collegial panel took into consideration the fact that the sex was consensual and therefore, not rape. It was also the first offense with which Liu had ever been charged, hence the judge found her guilty of "offenses against sexual autonomy" and sentenced her to eight months in prison.
The judge stated that this was a fair ruling that will be permanently impact Liu's record. Jing Xing Elementary School had dismissed Liu from her position as a teacher back in July. Both Liu and the Shilin District Court may file appeals, if they so wish.
