Court bans sale of Word; Microsoft has fix ready

SEATTLE – A federal appeals court ordered Microsoft Corp. to stop selling its Word program in January and pay a Canadian software company $290 million for violating a patent, upholding the judgment of a lower court.

But people looking to buy Word or Microsoft's Office package in the U.S. won't have to go without the software. Microsoft said Tuesday it expects that new versions of the product, with the computer code in question removed, will be ready for sale when the injunction begins on Jan. 11.

Toronto-based i4i Inc. sued Microsoft in 2007, saying it owned the technology behind a tool in the popular word processing program. The technology in question gives Word users an improved way to edit XML, or code that tells the program how to interpret and display a document's contents.

A Texas jury found that Microsoft Word willfully infringed on the patent. Microsoft appealed that decision, but the U.S. Court of Appeals for the Federal Circuit on Tuesday upheld the lower court's damage award and the injunction against future sales of infringing copies of Word.

Michel Vulpe, founder and co-inventor of i4i, said in a statement that the company is pleased with the decision, calling it "an important step in protecting the property rights of small inventors."

Microsoft said it has been preparing for such a judgment since August. Copies of Word and Office sold before Jan. 11 aren't affected by the court's decision. And Microsoft said it has "put the wheels in motion to remove this little-used feature" from versions of Word 2007 and Office 2007 that would be sold after that date.

"Beta" or test versions of Word 2010 and Office 2010, expected to be finalized next year, do not contain the offending code, the software maker said.

Redmond, Wash.-based Microsoft said it may appeal further, asking for either a rehearing in front of the appeals court's full panel of judges or in front of the U.S. Supreme Court.

For the benefit of those who do not know.. MINDEF was due to upgrade their Win95/98 desktop and Microsoft Singapore wanted to charge them ~300 million dollars (I can only remember that it is roughly the cost of x2 defence technology buildings)... MINDEF was held hostage, decided to upgrade only key applications while leaving the mass desktop in military bases with outdated software; and embark on opensource (totally opposite of iDiotA's SOP)...

How wonderful is sinkie government agencies... a bunch of incompetence fools.

The good news is none of the government agencies are dumb enough to move to Apple yet. When they do, not only will they be held ransom on the Software side of things, Apple will have a huge say on the Hardware too
 
Have you tried google office yet? Translate most Word/ppt/excel/pdf quite well.
There is also Apple works and OpenOffice.org. There are "alternative" out there its if you are willing to switch to them that is the question. Don't forget, you can also go old school and use LaTeX. ;)

Microsoft has been ordered to stop selling certain versions of its Word programme after a US court ruled it had infringed a patent held by a Canadian software company.

The information technology major was ordered to pay $290m (£180m) in damages to Toronto-based i4i Inc and told it will not be able to sell any more copies of Word 2007 unless alterations are made to the programme over the next three weeks.

The US Court of Appeals for the Federal Circuit upheld an earlier jury verdict and lower court ruling in the patent case filed nearly three years ago. The case was brought over Microsoft's use of XML, or extensible markup language, in the 2007 versions of its word processor.








Microsoft said the injunction only referred to US sales of versions of Microsoft Word 2007 and Microsoft Office 2007 and said it had already "put the wheels in motion to remove this little-used feature from these products". It added that it was now "considering legal options".

Michel Vulpe, founder of i4i, said: "This ruling is clear and convincing evidence that our case was just and right..

"We are vindicated and we're appreciative but we're not surprised because we believed from the outset that we had a great case and that the trial judge made the right decision."

What if you send a simple form (just tables and no code) with tables designed in word. Will the format stay? What about excel spreadsheet?

Stop pretending you know something, you dumb fuck! Microsoft is not even compatible between versions, let alone other applications.. And have not even considered those with embedded codes

The way to go is to force people all to install Open Office by emailing Open Office format files to people in business / work with you. Once they installed you STOP using MS formats. e.g. no more .doc .ppt .xls all become .odt .ods etc. Strictly refuse to accept MS file formats.
