KUALA LUMPUR: A labourer was sentenced to 15 years’ jail and seven strokes of the rotan by the Sessions Court for raping his 12-year-old daughter. The man was charged with raping her at 9am on Dec 11 in his house in Kepong.
Judge Emelia Kaswati Mohamad Khalid scolded the 37-year-old man for failing in his duty as protector to his child.
“Even cats and chickens get angry when their young are threatened. You were entrusted by God to protect your children and yet you do this. Even animals know how to care for their young,” she added.
The man initially disagreed with the charge, and argued that it was his wife who filed the complaint and not the victim. But this was brushed aside by the judge.
“What matters is whether you did or did not rape your own child,” she said.
The man later pleaded guilty after the charge was read out to him.
The man, who was unrepresented, pleaded for leniency, saying he was the sole breadwinner and had to support his wife and four children, aged between seven and 12. DPP Malini Anne Jerry asked the court to impose a deterrent sentence, saying that the case should be a lesson to the father and the public.
“The trauma inflicted on the child will also affect her mother and siblings. “Also, what would happen to his three daughters if he was given a light punishment?” she added.
The judge also approved the prosecution’s request for the man to undergo police supervision for three years after he had completed his sentence.
15 years is too light as he will be out at 52 years of age. Still capable of harming young children. This animal should be castrated.
