前特首曾蔭權在任時無申報接受深圳東海花園豪宅裝修,去年被高院裁定一項「公職人員行為失當」罪成,被判監20個月,他現獲准保釋等候將於今年4月進行的上訴聆訊。另一方面,他另一項被控的「行政長官接受利益」罪,該罪的審訊雖已暫告一段落,但律政司指曾蔭權違諾無配合調查,令廉政公署要花時間和資源進行調查,故此要求法庭下令他就該罪的檢控,支付控方訟費。法官今(6日)裁決指,接納律政司的申請,下令曾蔭權支付訟費,估計約500萬港元。

Former Hong Kong leader Donald Tsang Yam-kuen was ordered to pay HK$4.6 million (US$590,000) on Tuesday after a judge ruled he should foot the bill for what it cost the city to prosecute and jail him last year.

Tsang, who served as chief executive from 2005 to 2012, was sentenced in February last year to 20 months in prison after he was found guilty of one count of misconduct in public office.

He faced a second trial in November after jurors in the February trial failed to return a verdict on a separate bribery charge. His retrial ended in a hung jury as well.

Although prosecutors decided not to press for a third trial, they asked the court to make the 73-year-old pay for a third of the legal costs, accusing Tsang of being uncooperative during their investigation.

“I am of the view that there are special circumstances in this case that warrant the imposition of the cost order against the defendant,” Mr Justice Andrew Chan Hing-wai wrote in his judgment.

According to a figure released by the Department of Justice, the prosecution cost HK$13.7 million.

The city's former chief executive Donald Tsang Yam-kuen has been ordered by the High Court today to pay a third of the prosecution's court costs, or about HK$5 million, arising from his misconduct trial in February last year.

In November 2017, the bribery charge against Tsang was shelved after a majority verdict could not be reached by an eight-member jury but the prosecution demanded court costs because of what it said was Tsang's uncooperative manner during Independent Commission Against Corruption's investigation.

Tsang was convicted in February 2017 of misconduct for failing to disclose conflicts of interest in renting a luxury penthouse in Shenzhen from Wave Media shareholder Bill Wong Cho-bau and receiving HK$350,000 free renovation from him as the Executive Council was considering the broadcaster's license application. The former Hong Kong leader was sentenced to 20 months of imprisonment but is out on bail. An appeal is due to be heard in April.

Tsang led Hong Kong for seven years from 2005 and is the city's highest-ranking official to face a graft trial.

IF PAP lose power,PAP ministers would be charged for corruption for overpaying themselves.

First, that won't happen. PAP has a huge margin for electoral victory each time. Next, the SAF and Home Team stand ready to defend Singapore from both external and internal threats in the event of a freak election result.

Only if this case was heard when he's still in power, it would have been classified as a gift and he'll be acquitted.
