引發港府提出修訂《逃犯條例》、轟動港台兩地的港男涉於台灣殺害女友案，涉案港男陳同佳昨在高院被裁定四項洗黑錢罪罪成，法官押後至四月廿九日判刑。庭上宣讀的控方案情首次披露陳向警方承認的殺人情節，陳被捕後於警誡下承認案發前已知女友懷孕，並與她到台灣旅行期間二人爭執，女友告之胎兒非他經手，且讓他看到女友與他人性交的片段。陳指當時感憤怒，把女友頭撼向牆壁，並用雙手從後箍住其頸致死，糾纏歷時十分鐘。陳稱在棄屍後拿了女友的銀行卡提取款項並回港，且以女友的款項「找卡數」。


被告陳同佳，現年二十歲，在港被控四項洗黑錢及三項盜竊的交替控罪，他早前已於裁判法院承認四項洗黑錢罪，昨在高院法官彭寶琴席前確認其認罪並被裁定罪成。控罪指，被告於去年二月十七日至三月十三日，四度干犯洗黑錢罪行，處理原屬於其女友潘曉穎（當時二十歲）的財物，即提款卡、一部數碼相機、一部手機、新台幣二萬元（約港幣五千四百多元）及一萬九千二百多港元。


承認四項洗黑錢罪 涉款逾二萬元


身形較早前略胖的被告，昨在犯人檻內一直表現平靜。辯方只稱希望法官考慮被告並無案底，自去年三月已一直被還押，且早已表明認罪，便沒作其他求情。根據香港法例，洗黑錢最高可被判監十四年。


案情指被告與潘在二○一七年七月一同做兼職時認識，兩人一個月後拍拖。潘在同年十二月初證實懷孕，被告同月亦知悉此事，兩人計劃於去年二月到台灣旅行，由被告付錢訂機票酒店。去年二月八日上午，潘離家出發，她只向家人表示和朋友去台灣，會在同月十七日返港。其母在三月五日報警表示女兒失蹤，她其後在家找到潘的入台證副本，上面印有潘在台北下榻之酒店名字。被告則在二月十七日晚上回港。


案情續指，去年三月十三日，被告在警誡下承認殺潘，之後將屍體埋於台北一處草地。被告其後再與警方多次錄口供，他承認與潘抵台後，先去台南和台中遊玩，至二月十三日去台北，住在大同區南京西路一酒店。十六日晚上，他在某夜市買了一個行李篋，回酒店後，他和潘就執行李問題爭執，但爭執後兩人又性交。


捉死者頭撼牆 雙手箍頸致其斃命


被告續稱，十七日凌晨他與潘再起爭執，潘指她的胎兒其實是她前男友經手，被告更稱看到潘與一名不知名男子性交的影片，他在激動之下捉住潘的頭撼向牆壁，並用雙手從後箍住其頸，與她在地上糾纏約十分鐘至她死亡。他把潘放入行李篋並把她的個人物品放入四個膠袋內。


約上午七時，被告先在酒店附近幾個垃圾收集站棄置潘的私人物品，然後帶着藏屍行李篋乘捷運到竹圍站下車找地方棄屍。找了兩小時後，他把屍體棄置在一個公園裏的灌木叢中。被告稱，潘生前告訴過他其銀行卡密碼，他在殺人後拿了潘的銀行卡提取了二萬元新台幣，之後他帶着潘的銀行卡、數碼相機、手機和該些新台幣回港，一直放置在啟晴邨寓所，直至被警察找回。被告亦於二月十九至廿一日，三度用潘的提款卡提款，共提取了一萬九千二百元，部分用作找卡數。

The case of the Hong Kong government proposed to amend the "Fugitive Offenders Ordinance" and sensation in Hong Kong and Taiwan to kill a girlfriend in Taiwan. The defendant, Chen Tongjia, aged 20, was charged with four charges of money laundering and three thefts in Hong Kong. He had previously admitted four money laundering offences in the Magistracy. He confirmed it before the High Court Judge Peng Baoqin. Plead guilty and convicted of crime. The charge alleges that the defendant committed four acts of money laundering from February 17 to March 13, last year, dealing with the property originally belonging to his girlfriend Pan Xiaoying (then 20 years old), namely a cash card and a digital camera. A mobile phone, NT$20,000 (approximately HK$5,400) and HK$19,200.

The defendant, who was slightly fatter in the early days, had been calm in the prisoners yesterday. The defense only said that the judge would like the defendant to consider that the defendant has no criminal case. Since he has been remanded in March last year and has already indicated that he has pleaded guilty, he has not made any other pleadings. Under the laws of Hong Kong, money laundering can be sentenced to a maximum of 14 years.


The case indicated that the defendant and Pan had been in a part-time job together in July 2017. The two men were dragged one month later. The case continued. On March 13 last year, the defendant admitted to killing Pan under vigilance, and then buried the body in a grassland in Taipei. The defendant then repeatedly recorded a statement with the police. He admitted that he would go to Tainan and Taichung after going to Pan, and went to Taipei on February 13 to live in Nanjing West Road, Datong District. On the evening of the 16th, he bought a baggage bag at a night market. After returning to the hotel, he and Pan executed a dispute over Li, but after the dispute, they had sexual intercourse.

The defendant continued that he had a dispute with Pan Zaiqi in the early morning of the 17th. Pan said that her fetus was actually handled by her ex-boyfriend. At about 7 am, the defendant first disposed Pan's personal belongings at several garbage collection points near the hotel, then took the Tibetan corps and took the MRT to Zhuwei Station to get off the bus and find a place to abandon the body. After looking for two hours, he dumped the body in a bush in a park. The defendant claimed that Pan Sheng had told him his bank card password. After he killed the man, he took Pan’s bank card and extracted NT$20,000. After that, he took Pan’s bank card, digital camera, mobile phone and the new Taiwan dollars back. The port has been placed in the Kai Ching Estate apartment until it is retrieved by the police. The defendant also withdrew the money from Pan's ATM card from February 19 to 21, and collected a total of 19,200 yuan, which was used to find the number of cards.

【星島日報報道】（星島日報報道）港男遊台期間殺害女友案，自去年三月首次提堂後多次押後。案件昨首次在高等法院提訊，律政司代表律師一度申請就案情撮要的受爭議內容展開五日「紐頓聆訊」，並指被告殺害女友後才盜竊女友財物，是法官判刑的重要考慮因素，故應先展開聆訊再聽取答辯。法官強調被告被控洗黑錢而非謀殺，若法庭以謀殺或誤殺罪名為前提判刑，或予人嚴重不公之感，最終拒絕控方申請並即日聽取被告答辯。
控方認為，相關受爭議段落交代了被告與女友的對話，這些對話記錄可反映被告偕女友離港前的意識狀態，對法官判刑有顯著影響。控方不爭議被告因盜竊罪獲得洗黑錢控罪中所指的「犯罪得益」，但他是先殺害女友才盜竊對方財物的，此點或是加刑因素，法官應以宏觀角度審視整案。
法官彭寶琴反駁，衍生本案「犯罪得益」的是盜竊罪而非謀殺或誤殺罪，即使被告只盜竊女友錢財而無殺害對方，控方仍有充足證據指控他洗黑錢。相反，若被告只謀殺女友而無盜竊女友錢財，控方便毫無指控他洗黑錢的基礎。被告是否在赴台前已有謀殺意圖，並非考慮被告洗黑錢刑期的因素，更遑論加刑。
彭官續指，洗黑錢控罪的入罪條件，是證明被告明知或有合理理由相信其處理的財產，屬可公訴罪行的得益。被告早已承認知悉其處理的是從女友偷過來的財產，控方案情亦從無提及被告為盜竊而殺人，故觸發被告洗黑錢的是其盜竊罪行。
控方其後提出押後案件以索取律政司指示，辯方批評控方貪求第二次機會，強調本案延訟多時，不應再拖延下去。彭官最終決定不展開「紐頓聆訊」，被告可即場答辯。

【星島日報報道】香港青年陳同佳遊台期間涉嫌謀殺懷孕女友，棄置藏屍行李後返港被捕。還柙逾1年的陳同佳今午在高等法院承認4項洗黑錢罪，還柙候判。控方案情透露，被告從台灣返港前夜，聽見女友稱懷有前男友的骨肉，又看了一段女友與另一不知名男子性交的影片，一怒之下將女友「撼頭埋牆」，從後以雙手勒斃她再棄屍車站。受害少女遇害前1小時透過短訊告知母親將於當日晚上返港，豈料成為她的遺言。
控方案情指，現年20歲的被告陳同佳前年7月結識受害少女潘曉穎，2人1個月後成為情侶。前年12月初，潘表示自己已懷有5星期身孕。約於同一時間，2人計劃於去年2月一同遊台，被告負責訂購機票和酒店住宿。
前年2月8日早上，潘告知母親將會與「朋友」赴台，但未有指明朋友是誰，便在當日早上與被告離港前往台北。同月17日凌晨1時許，潘發訊母親指將於當日晚上回港，但此後與外界失聯。另一方面，被告於當晚11時許獨自從台北乘飛機返港。
同年3月5日，潘的母親向將軍澳警署報稱女兒失蹤，其後在寓所發現被告的「入台證」副本，又從中得悉被告入住台北紫園旅店。被告於同月13日被香港警方問話，他在會面中承認殺死潘，隨即被警方以謀殺罪名拘捕。他在警誡下承認殺人，將潘的遺體藏於台北某處的草地。
警方隨後2日為被告錄取口供。被告指自己與女友遊覽台南和台中，並於2月13日入住上述紫園旅店。直至同月16日，2人逛夜市後購買一個粉紅色行李箱，並於翌日凌晨時分返回酒店。2人因行李收拾問題爭執後性交。
同日凌晨約2時，2人再次起爭執，期間潘聲稱腹中胎兒是前男友的孩子，又向被告展示一段她與另一名男子性交的片段，不料觸發被告殺機。被告擊打潘的頭部至牆上，隨即以雙手從後箍頸，2人在地上糾纏約10分鐘，直至潘氣絕身亡。被告犯案後將潘的遺體藏於上述行李箱內，並把潘的個人物品分裝進4個膠袋內。
被告睡至同日早上7時後，首先在酒店附近不同垃圾收集站，棄置潘的個人物品。其後他將藏有潘遺體的行李箱，棄置於台北竹圍捷運站附近一個公園的草叢內。
被告現承認返港後處理潘的銀行卡、相機、手機和現金等財物。

On the morning of February 8 of the previous year, Pan told her mother that she would go to Taiwan with a "friend", but did not specify who her friend was. She left the port with the defendant to Taipei on the morning of the same day. At 1 am on the 17th of the same month, Pan’s mother said that she would return to Hong Kong on the evening of the same day, but she lost contact with the outside world. On March 5 of the same year, Pan's mother reported to the Tseung Kwan O Police Station that her daughter was missing. She later found a copy of the defendant's "entry permit" at the apartment and learned that the defendant was staying at the Taipei Ziyuan Hotel. The defendant was questioned by the Hong Kong police on the 13th of the same month. He admitted to killing Pan at the meeting and was arrested by the police on murder. He pleaded murder under vigilance and hid Pan's body in the grass somewhere in Taipei.

The police then accepted the confession for the defendant on the 2nd. The defendant said that he and his girlfriend visited Tainan and Taichung and stayed at the above-mentioned Purple Garden Hotel on February 13. Until the 16th of the same month, two people bought a pink suitcase after visiting the night market and returned to the hotel in the early hours of the next day. The defendant now acknowledges that Pan’s bank card, camera, mobile phone and cash are processed after returning to Hong Kong.
