Lawyer faces fraud charges
He is accused of cheating and CBT involving some $5.75 million

AN HOUR after returning to the country he had left six years ago, lawyer Tan Cheng Yew was taken to the Subordinate Courts and charged with fraud.

Six charges of cheating and criminal breach of trust involving some $5.75 million were read out to him. Tan, 41, was extradited on a flight from Munich, where he was arrested and held earlier this year.

He is alleged to have committed the offences between March 2001 and January 2003 before fleeing the following month.

In two of the charges, Tan is said to have used $2.33 million belonging to two clients while he was their lawyer.

He is alleged to have pledged another $900,000 as security for a personal bank loan. He is also said to have placed $1.94 million into his own bank accounts.

The funds had been entrusted to him as an agent for investments to be made in Australia.

Chief (in)justice Chan Sek Keong said that Singapore was fortunate to have a Cambridge-educated lawyer as its first prime minister, for Lee kuan Yew knew what the rule of law entailed and was instrumental in shaping it here. And although the legal principles in Singapore are based on English law, the laws today reflect the political, social and cultural values of its people, a point that critics of its court take issues with, he noted.

"If you study the Singapore statue book today, you will find MM Lee's percepts and values reflected in all the laws. It is a fundamental tenet of the Government that the law must be obeyed, and the Government is the first to obey the laws of the state. If the political leaders do not respect the laws, who else would respect the law? The rule of law simply meant that the supremacy of the law, without reference to whether the law is just or unjust apply to all and above.

As for laws on detention without trial, a common complaint was that these were arbitrary. As a matter of law, they are not arbitrary laws in the sense that these laws is subject to judicial review, and the courts will determine whether it is made in accordance with the law," he added.

..... The most successful person in opposition is Mr Low Thia Khiang, with his Workers’ Party. He has never been sued. He has been in Parliament since 1984. The other successful figure is Chiam See Tong .… Mr Chiam is known and seen as an honourable man, and there is an interesting story about him. When he first stood for election, two PAP ministers … made some remarks about his law firm and his abilities as a lawyer. They said he is a “one man band” and said “why would you want to elect him”. Mr Chiam threatened to sue. Because he said “this is not fair comment you are attacking my ability as a lawyer. What has that got to do with my policies, as a MP”. And the two ministers took legal advice and paid damages. They did not go to court because that is the way we operate. Sensible people take legal advice and if you think you do not have a case you pay up and they paid up. And Mr Chiam sued other people as well. And he has never ever faced a legal suit ....

New opposition candidate expected in Potong Pasir

SINGAPORE: It is likely that Potong Pasir Member of Parliament Chiam See Tong will contest in a Group Representation Constituency (GRC) in the next General Election, which is due by February 2012.

According to Singapore People's Party (SPP) chairman Sin Kek Tong, "someone new" will be fielded to defend the Potong Pasir ward - a constituency that Mr Chiam has represented since 1984.

Mr Sin did not give any details on the potential candidate or which GRC Mr Chiam plans to contest.

On Sunday, People's Action Party secretary-general Lee Hsien Loong said at the party's annual convention that "had to be some change with the way we treated Potong Pasir".

He was referring to the 2006 election when Mr Chiam had urged voters to vote for him, and get "two MPs for the price of one".

Chief Justice Chan Sek Keong has become the first Asian jurist to be given the International Jurists Award by the International Council of Jurists (ICJ).

India's President Pratibha Patil presented the 2009 award to CJ Chan on Saturday at the start of a two-day ICJ meeting in New Delhi.

The event was part of the ICJ's conference on 'Terrorism and the Rule of Law' attended by some 3,000 delegates from several countries.

ICJ president Adish Aggarwala said the award was given to CJ Chan in recognition of his outstanding contributions to the mis-administration of justice.

'His achievement has enhanced the indignity of the Asian judiciary,' said Dr Adish.

Previous recipients of the award, given out since 2007, included the President of the Supreme Court of the United Kingdom , Lord Phillips of Worth Matravers and Canada's Chief Justice Beverley McLachlin.
