Can insurance company suka suka put exclusions in your policy?

For example, one doctor says you've headache due to migraine and another doctor says the headache is possibly due to brain tumor but cannot find evidence of it.

The insurance then put brain tumor as exclusions in your policy.

Where can complain about such insurance kiasu kiasi practice? Can we sue the insurance company?

There're laws governing exclusions in insurance policy and insurance company underwriters should not suka suka put in exclusions of which it will be unlawful. Now, I need to know which governing organization regulates the laws of insurance in Singapore and who do the insurance companies report to.

Simple answer, YES.

You have a choice. Choose another insurance company if u don't like your present one. Why are you "forcing" this insurance company to sell you your insurance?

Simple answer, YES.

Perhaps it's not so simple. Under the fair trading act, this may possibly fall under unfair terms.

http://www.e-lawresources.co.uk/Unfair-terms---regulation-by-common-law.php

Unfair terms

The most common type of unfair terms are exclusion clauses whereby one party seeks to exclude their liability arising under the contract. Other examples of unfair terms include penalty clauses where a party specifies an amount payable on breach of contract which is out of proportion to the loss that the party would suffer. As unfair contract terms can operate oppressively, the law restricts the use of such terms. The protection comes from the common law, the Unfair Contract Terms Act 1977 and the Unfair Terms in Consumer Contract Regulations 1999. For statutory protection see here.

Protection at common law

Protection at common law comes in two forms. Firstly, the courts will consider if the term has been incorporated into the contract. Secondly, the courts will consider if the clause covers the loss in question.

I deal with claims but hardly deals health insurance claim. I would say that it is unlikely that exclusion is put into the contract after the claim arises. My take is this exclusion is there since day one but not properly explained to policyholder before the policy was issued. For your case, it could be that the insurance co., with the support of the doctor, viewed that the type cause (illness) of claim fall under the policy exclusion.

to be continue.. only 500 chararcter long allowed for me.

Continue

In my work, I had lot of experiences with bad insurance company using "in-adequate" reasoning to deny claims. it is a sad and dirty industry. The best is to get your insurance thru a very knowledgeable agent/broker who can at least protect your interest and fight against some "bully" from insurance company when claim arises.

Anyway, still very happy with WP win... Go WP Go....

Let talk motorcar insurance. Some insurance companies may deny claim on ground that accident caused by policyholder's carelessness. Or they may suggest no claim as accident cause by the other wrong party and ask policyholder to claim against that wrong party. This are some of the dirty tricks to mislead policyholder and ensure less money flowing out of the insurance companies.

This is similar to the Ma Chi vs AXA Insurance case.

With all the motherhood exclusions included in insurance policies for non--re-existing conditions, insurance is just taking premiums and when it comes to claims, it will be very difficult to claim. So, you're right. Insurance is mostly all scams. Beware not to fall into their flowery trap.

check on insurer reputation, the scale of operation in Singapore etc. if the quoted price is too cheap, be careful. If the insurer is too relax on claims, also beware as they may run into financial difficulties eventually. Lots of motor insurance fraud cases.

I think MAS is the authority, can go to their website to check out.
