SINGAPORE - A man who was honoured as best chief financial officer at the Singapore Corporate Awards 2015 was sent to prison for four weeks on Monday (Oct 2) for taking upskirt videos of women.
Chan Chee Kin, 42, was chief financial officer at listed Midas Holdings, the aluminium alloy manufacturer, when he committed four charges of insulting the modesty of women in Orchard Road on June 21, 2016.
He pleaded guilty on Sept 25 this year to two of four charges of using his mobile phone to take upskirt videos of women on June 21, 2016. Two other similar charges were taken into consideration for the purposes of sentencing.
Investigations showed that Chan was at 313@Somerset mall when he saw one of the victims at around 1.25pm that day. He turned on the video recording app on his mobile phone and stood behind the victim on the upriding escalator. He held his phone under the victim's dress and took an upskirt video for 2½ minutes. He did it a total of three times.
At about 2.40pm, he was at Dhoby Ghaut MRT station when he saw another woman. He similarly stood behind her on an upriding escalator and took an upskirt video of her which lasted 52 seconds. He then followed the victim to Cold Storage supermarket at Plaza Singapura and continued filming her multiple times.
He was arrested that day, but the statements of facts did not say how he was identified.
Deputy Public Prosecutor Lee Zu Zhao had sought a jail sentence of at least four weeks on each charge. He told District Judge Adam Nakhoda that Chan demonstrated persistence in following each victim, filming them multiple times.
Chan's lawyer Anand Nalachandran said in mitigation that his client suffered from persistent depressive disorder which had gone undiagnosed for five years.
Chan began treatment soon after his diagnosis after June 2016, said the lawyer, who asked for a community-based sentence for the married father of two.
Community-based sentencing includes a mandatory treatment order or a short detention order which will be wiped out once served, and not deemed a previous conviction.
"With treatment and counselling, our client has no urges to repeat the same offending behaviour," the lawyer said.
But Judge Nakhoda said he did not think either probation or a community-based sentence was appropriate in this case, as the key sentencing principle is general and specific deterrence.
He noted that in both cases, Chan followed the victims to film them. For the second victim, it was more egregious as Chan had taken seven more videos of the victim after the first at the MRT escalator.
A message had to be sent that Chan's actions could not be condoned, the judge added.
Chan could have been jailed for up to one year and/or fined on each charge of insulting modesty.
