Everybody`s got differences, and as a race, we should look beyond wrongdoings done long ago. It is really sad that at this point in human civilization, ppl still hold grudges for things past. As long as past criminals do not repeat their previous tresspasses, it should be acceptable. Those old Nazi war criminals who`ve been in hiding all these years and are aged in their 80s nowadays, have suffuered enough all these years and society should just let them live. In this, I think those who call themselves Christians should lead the way by setting an example.

What race were their recent successes in badminton and ping-pong world tournaments who gave their country something to be proud about. For those who are interested in the road to regional independence, I shall attempt to summarise the history in less than 500 words...

As early as 1944, the british were already engineering a way to regain control of malaya peninsula. Tin and rubber were 2 very important commodities during the industrial age and the brits needed them to rebuild their war torn economy.

When the "victorious" british re-occupied after the japs surrender, they immediately declared the formation of the Malayan Union. In typical british sly, they had managed to usurp ruling power from the sultans by threatening to paint them as japanese collaborators. To dilute native power even further, they also wanted to grant residentship to chinese and indian immigrants. The Malayan Union and Singapore became separate crown colonies of the Empire.

The malays of course were not too happy with this arrangement and so the malay nationalists like Onn Jafar (founder of UMNO) refused to take part in the political process. In 1948, Malayan Union was dissolved and replaced by Federation of Malaya. The Tunku, Onn Jafar and Tan Cheng Lock (founder of MCA) led long and boring talks with the british for self governance 10 year later.

And on the side, Chin peng's insurgency took a big toll on british resources and they were glad to return Malaya to her people.

Shortly after singapore, sabah and sarawak joined the Federation. And one day LKY cried and singapore became independent.

In 1948, Malayan Union was dissolved and replaced by Federation of Malaya. The Tunku, Onn Jafar and Tan Cheng Lock (founder of MCA) led long and boring talks with the british for self governance 10 year later.

It's late but need to expand on this part. The FoM returned symbolic power to the sultans and residentship to non-malays was not granted. In effect, the brits returned power to the malays.

Part 1 - Agreement Between The Government Of Malaysia And The Communist Party Of Malaya To Terminate Hostilities


The Government of MALAYSIA and the Communist Party of Malaya, consistent with their common objective for peace, hereby agree to the following :-


ARTICLE 1 - CESSATION OF ARMED ACTIVITIES
Upon the signing of the Agreement, the Government of Malaysia and the Communist Party of Malaya shall cease all armed activities forthwith.




ARTICLE 2 - DISBANDMENT OF ARMED UNITS, DESTRUCTION OF ARMS, AMMUNITION, EXPLOSIVES AND BOOBY-TRAPS
The Communist Party of Malaya shall disband all its armed units, destroy its arms, ammunitions, explosives and booby-traps in Malaysia and Thailand.




ARTICLE 3 - RESIDENCE IN MALAYSIA
3.1 Members of the Communist Party of Malaya and members of its disbanded armed units, who are of Malaysian origin and who wish to settle down in MALAYSIA, shall be allowed to do so in accordance with the laws of Malaysia.


3.2 Members of the Communist Party of Malaya and members of its disbanded armed units, who are not of Malaysian origin, may be allowed to settle down in MALAYSIA in accordance with the laws of MALAYSIA, if they so desire.




ARTICLE 4 - PROVISION OF ASSISTANCE BY THE MALAYSIAN AUTHORITIES
With regard to Article 3, the Malaysian authorities shall assist members of the Communist Party of Malaya and members of its disbanded armed units in order to help them to start their peaceful life afresh.



Part 2 - Administrative Arrangment Between The Government Of Malaysia And The Communist Party Of Malaya Pursuant To The Agreement To Terminate Hostilities


The Government of MALAYSIA hereinafter referred to as the Government, and the Communist Party of Malaya, hereinafter referred to as the CPM, hereby agree to the following Admistrative Arrangment for the implementation of the Agreement signed on 2 DEC 1989 in HAADYAI, THAILAND to terminate all hostilities.


ITEM 1 - TERMINATION OF ARMED ACTIVITIES


1.1 The Government and the CPM shall terminate all armed activities upon the signing of the Agreement.


1.2 Press Statement


All press statements issued by either Party thereafter shall be in the spirit of the Agreement and shall not contain any slanderous terms such as "mass surrender" and "capitulation".


ITEM 2 - DISBANDMENT OF ARMED UNITS


2.1 Announcement of Disbandment


The CPM shall disband all its armed units, namely the Malayan People's Army (MPA) in MALAYSIA and THAILAND and shall announce the disbandment not later than two and a half months from the date of the signing of the Agreement.


2.2 Nominal List


The CPM shall furnish the Malaysian authorities with a nominal list containing personal particulars of its members and members of its disbanded armed units, who decide to take up residence in MALAYSIA, for purposes of verification by the Malaysian authorities. The list of such members shall be given to the Malaysian authorities as soon as possible, and in any case not later than one year from the date of the signing of the Agreement.


2.3 Withdrawal From The Jungle


All members of the disbanded armed units led by the CPM shall assemble at the pre-designated places in Thailand not later than two months from the date of the signing of the Agreement.


2.4 Destruction Of Firearms, Ammunition And Explosives


2.4.1 All members of the disbanded armed units shall destroy their firearms, ammunition and explosives not later than fifteen days from the date of their arrival at the pre-designated places in Thailand and not later than two and a half months from the date of the signing of the Agreement.


2.4.2 The CPM shall provide the Malaysian and Thai authorities a list containg the description and quantity of such firearms, ammunition and explosives for purposes of verification before destruction. Such destruction shall be witnessed by the Malaysian and Thai authorities.


2.4.3 Such destruction shall not be photographed or videotaped.


2.5 Location And Destruction Of Booby-Traps


2.5.1 Members of the disbanded armed units of the CPM shall locate and destroy all booby-traps in MALAYSIA that can be found, to be witnessed by the Malaysian authorities.


2.5.2 The CPM shall furnish the Malaysian authorities with all existing sketch plans of the locations of booby-traps in MALAYSIA.


2.5.3 The location and destruction of booby-traps shall commence as soon as possible and shall be completed without unnecessary delay.


2.5.4 The Malaysian authorities shall provide medical treatment, allowances and compensation for any death or inuries suffered by members of the CPM's disbanded armed units in the course of locating and destroying such booby-traps.


2.5.5 All expenses incurred in locating and destroying the booby-traps in MALAYSIA shall be borne by the Malaysian authorities.


2.6 Radio Suara Demokrasi Malaya


The CPM shall within one month from the date of the signing of the Agreement close down the Radio Suara Demokrasi Malaya (SDM) station. During the period of one month, the SDM shall not broadcast any slanderous statement against the Government.


ITEM 3 - PERSONAL BELONGINGS


All personal belongings including souvenirs, photographs and other daily necessities of members of the CPM and members of its disbanded armed units, the possession of which is not unlawful in MALAYSIA, shall be retained by them after inspection before their entry into MALAYSIA


ITEM 4 - RESIDENCE IN THAILAND AND FREEDOM OF MOVEMENT


4.1 The Malaysian authorities shall not object to members of the CPM and members of its disbanded armed units taking up residence in THAILAND.


4.2 Those who have settled down in THAILAND are free to enter MALAYSIA through legal means to visit their relatives, friends and for vocation.


4.3 Those who have been allowed to settle down in MALAYSIA are free to visit their relatives and friends in THAILAND through legal means.


4.4 Relatives and friends of those who have settle down in THAILAND and MALAYSIA shall be free to visit them in either country through legal means.


ITEM 5 - RESIDENCE IN MALAYSIA


5.1 Members of the CPM and members of its disbanded armed units shall be allowed to take up residence in MALAYSIA if they so desire, after they have stayed in the pre-designated places in THAILAND for a minimum period of six months.


5.2 Members of the CPM and members of its disbanded armed units, who are not of Malaysian origin, may be allowed to take up residence in MALAYSIA, if they so desire, after having stayed in the pre-designated places in THAILAND for a minimum period of six months.


5.3 Those who seek to settle down in MALAYSIA must notify the Malaysian authorities of their intention to do so not later than one year from the date of the signing of the Agreement.


5.4 With regard to Item 5.1 and 5.2, the CPM shall provide the necessary particulars to the Malaysian authorities for processing and verification. In this connection, the Government shall despatch relevant officers to deal with those cases in THAILAND.


5.5 Those who wish to settle down in MALAYSIA shall be categorised as follows:


5.5.1 Malaysian citizens


5.5.2 Non-citizen spouses and children of Malaysian citizens, and


5.5.3 Aliens


5.6 Those who are allowed to settle down in MALAYSIA shall be given identification papers upon their entry into MALAYSIA before they proceed to their respective places of residence of their choice.


5.7 Non-citizen spouses and children of those who are of Malaysian origin may be allowed to settle down in MALAYSIA in accordance with the laws of MALAYSIA if they so desire.


5.8 Those who have taken up resudence of their own choice in MALAYSIA shall notify the MALAYSIAN authorities of their current addresses to facilitate disbursement of financial assistance.


5.9 Those who are allowed to settle down in MALAYSIA shall be taken into the country in small batches and any search that may be conducted shall be in a manner so as not to cause any embarrassment.


5.10 There shall be no publicity of their entry into MALAYSIA.


ITEM 6 - LEGAL REQUIREMENT


6.1 Loyalty to King And Country


Members of the CPM and members of its disbanded armed units who have returned to settle down in MALAYSIA shall be loyal to the King and country and shall abide by the Federal Constitution and the laws of MALAYSIA.


6.2 No Detention, Interrogation Or Prosecution


6.2.1 The Government shall not apply the Internal Security Act, 1960 or any other laws on members of the CPM and members of its dibanded armed units who have returned to settle down in MALAYSIA, for their past CPM-related activities.


6.2.2 Members of the CPM and members of its disbanded armed units shall be liable under the laws of MALAYSIA for any unlawful activities committed by them in the future.


6.3 Citizenship And NRICs


6.3.1 Those who were in possession of Blue and Red NRICs and citizenship certicificates before they joined the CPMs or its armed units shall continue to use them as valid documents. Any such documents which have been lost or damaged shall be replaced expediently after verification.


6.3.2 Non-citizen spouses and children of those of Malaysian origin who have settled down in MALAYSIA shall be issued with RED NRICs. They can apply for citizenship after two years of continuous stay in MALAYSIA in accordance with the laws of MALAYSIA.


6.3.3 Those who are aliens and those whose citizenship have been revoked shall be issued with RED NRICs should they be allowed to settle down in MALAYSIA. They can subsequently apply for citizenship in accordance with the laws of MALAYSIA.


6.3.4 Those who are of Malaysian origin and who joined the CPM and its armed units before the implementation of the National Registration, shall be issued with RED NRICs should they be allowed to settle down in MALAYSIA. They can subsequently apply for citizenship in accordance with the laws in MALAYSIA.


6.4 Privileges And Obligations


6.4.1 Those who are Malaysian citizens and have settled down in MALAYSIA shall enjoy the same privileges as any other citizens under the Federal Constitution and the laws of MALAYSIA.


6.4.2 Those not of Malaysian origin and non-citizens who have settled down in MALAYSIA shall be governed by the Federal Constitution and the laws of MALAYSIA.


ITEM 7 - PARTICIPATION IN POLITICAL ACTIVITIES


7.1 Members of the CPM and members of its disbanded armed units who are Malaysian citizens are free to participate in political activities including the formation of a political party or parties within the confines of the Federal Constitution and the laws of MALAYSIA.


7.2 The Malaysian authorities shall expeditiously consider any application that may be submitted by them for the registration of any political party in accordance with the due process of the law and upon registration such party shall be accorded the same status as any other legally registered political parties.


ITEM 10 - SIGNING OF AGREEMENT AND ADMINISTRATIVE ARRANGEMENT


10.1 The Agreement and the Administrative Arrangement shall be signed separately at pre-determined venues agreed by both sides.


10.2 The Agreement shall be signed by both sides in public and the spirit of this Agreement shall be announced in a Joint Communique immediately after the signing.


10.3 The Administrative Arrangement shall also be signed by both sides but it shall not be publicised.

Why is this important to Malaya?Because they knew the rest of colonies will follow.It's a matter of time.Besides,maintaining colonies is big drain in their resources--I am talking about military expenditures....Rubber and Tin as their saviour?...Pleease lah; rubber and tin were private sector portfolios since colonies were no longer administered on plunder basis.Besides Britain had devised other means of controlling native trades without their physical presence.As now US does with it's fiscal policy.The Whites have now new methods to colonize without their physical presence.

But the British exit strategy out of Malaya was a big thorn.Because they could not return the land back to the sultans(as their experience with princely states in India had taught them).....it had to be done democratically by 1 man 1 vote system.And their biggest thorn of all is the presence of ethnic Chinese and Indians born in the land.How to deal with this?

Chin Peng knew the British dilema ---and he exploited that to the fullest.If anyone to read about the basis of the Baling negotiations---it was preisely for sharing the political power when British leave.

So the signal is very very clear.The British want to go.The loot to share after the British having left is what Chin Peng fought for with his thuggery.And he did that with terrorism----terrorizing the ethnic Chinese hoping to galvanize them as his vote bank.I could write more but this would suffice for now.

What is Baling talks?

The talks took place in the Government English School at Baling on December 28,1955. . They lasted more than eight hours, and were spread over two days. The MCP was represented by Chin Peng, the Secretary-General, Rashid Maidin and Chen Tien, head of the MCP's Central Propaganda Department. On the other side were three elected national representatives; Tunku Abdul Rahman, Dato Tan Cheng-Lock and David Marshall.

And here are some selected exerpt of the talk.The readers are free to form their own conclusion:-

1."Chin Peng put one more question before another adjournment. Was it necessary for any decisions made at the meeting to be approved by the British Government? The Tunku replied: "If I decide and Mr. Marshall agrees with me, that will be all."--

2.Tunku said that he was not asking Communist to give up their ideology- "one's ideology is what one believes in" - but their activities were something quite different.

3.Chin Peng then asked whether the difference was because most of the members of the MCP in Malaya were Chinese. David Marshall replied that as far as Singapore was concerned that had nothing to do with it. The point was that the Communists were exercising violence.

4.Marshall asked, "Forgive me for asking, but what are you struggling for?" Chin Peng solemnly replied, "It is very simple, just for the dignity of man." Marshall exclaimed that using deed of violence to enforce their views on a population that does want them was hardly compatible with the dignity of man. Chin Peng admitted that their outlook on this question was quite different and he was prepared to argue on it.

It was at this point that the talk really broke down.

That's why Brits drew up the Reid commission. It was to playing one race against the others.

Btw, the Brits actively imported and indirectly encouraged migrant workers from China and India to become cheap labour during the colonial years. It is very widely acknowledged that migrant workers were valued for their work ethics. Up to when the New Economic Policy was implemented, non-malay population in peninsula malaya was close to half.

Many of the 10th Regiment, the MCP Malay regiment of the MCP were allowed home as well.

Besides the Malaysian govt, certain quarters of the Malaysian community did not want his return as well. In Setiawan, Chin Peng birthplace, local Malaysian Chinese christians also supported the govt's decision not to let him return. These people have fought with the British and Malay troops against the MCP did not want to see their former nemesis return to the country.

To be fair, those who have been directly affected by the violence perpetuated by the MCP in their campaigns cannot accept the return of Chin Peng, whom they see as the mastermind behind the violence. But one thing for sure is that Chin Peng has play a part in fighting for Malaya's independence although the ideology and methods did not fit in the accepted history as dictate by the victors.

But one thing for sure is that Chin Peng has play a part in fighting for Malaya's independence although the ideology and methods did not fit in the accepted history as dictate by the victors.

All photographs of the Baling talks show that my grandfather, the late Tun Tan Cheng Lock, was also present at the Baling talks. However, his name has been omitted from your article.This omission is significant because, unlike Tunku Abdul Rahman and David Marshall, my grandfather was a victim of the communists’ violent tactics.


On April 10, 1949, two months after he formed the MCA, the communists threw a hand grenade at my grandfather in Ipoh. Although his shoulder was severely wounded and his shirt was soaked in blood, my grandfather survived this assassination attempt.My father, the late Tun Tan Siew Sin, also received death threats from the communists. He had to visit the family’s rubber plantations escorted by the police. When my mother saw my father leave for work every morning, she said she never knew whether he would return home that evening.


Although he and his family were targeted by the Communists, my grandfather never held a personal grudge against them.When the communists sent a letter to Tunku Abdul Rahman requesting a meeting – a request that led to the Baling Talks on Dec 28 and 29, 1955 – my grandfather readily agreed to meet the man who had probably masterminded his attempted assassination.Furthermore, my grandfather was a humanitarian and a staunch follower of the Chinese philosopher Confucius. One of the central tenets of Confucius’ teachings is ancestral worship – the ritual of visiting the graves of ancestors, burning joss sticks and offering prayers and food.


Both my grandfather and father observed this ritual and both instilled in their children a belief in its overriding importance. When my father was a Cabinet minister, he seldom if ever failed to observe the 12 ancestral worship ceremonies each year.For these reasons, I believe that if my grandfather were alive, he would argue that Chin Peng – given his recent apology to innocent victims – should be allowed to return to this country to visit his parents’ graves.Admittedly, Chin Peng is unlikely to be a follower of Confucius. But his desire to visit his parents’ graves suggests a belated acknowledgement of his duty as a filial son.



Some may argue that allowing Chin Peng to return to this country – even if briefly to enable him to visit his parents’ graves – would dishonour the memory of the thousands from all ethnic groups who were either injured or killed during the Emergency.

The fact is that under the peace agreement the Government signed on Dec 2, 1989, with the Communist Party of Malaya (CPM), out of 442 communists who applied to return to this country, 406 were allowed to do so, as Deputy Home Minister Datuk Wira Abu Seman Yusof said recently.


Chin Peng also submitted an application but failed to attend the interview fixed for Oct 31, 1992, the Deputy Minister added. That Chin Peng was called for an interview suggests the Government was prepared to consider his application and did not reject it outright.Ex-CPM leaders like Abdullah C.D., Sham*siah Fakeh and Musa Ahmad have been allowed to return to this country, according to news reports. Their return – as well as those of the other 403 successful applicants – failed to trigger any significant storm of protest or criticism, either then or now.


Some may claim the 406 returnees were not involved in any terrorist activity. Given the fact that guerilla organisations like the CPM are notoriously lean, it is hard to believe that all 406 individuals allowed to return to this country were all non-combatants.Furthermore, Malaysians’ magnanimity has also been extended to the Japanese. During the Japanese Occupation, unspeakable atrocities were inflicted on Malaysians, causing many to suffer from ill-treatment and torture while the death toll was high.


When then Crown Prince Akhito, now Emperor, visited this country, he was warmly welcomed even though the war was waged in the name of his father Emperor Hirohito. This admirable approach should be extended to all those who have hurt Malaysians in the past.Malaysians should also emulate the example set by South Africa’s Nelson Mandela. When he became the first black president of post-apartheid South Africa, his main priority was reconciliation with South African whites rather than prosecuting past leaders of the apartheid regime.


Although Mandela is now lionised worldwide, it is often forgotten that in the early 1960s he was often demonised as a communist and a terrorist. He was the leader of Umkhonto we Sizwe, the armed wing of the ANC, whose acts at times resulted in civilian casualties.Like Mandela, Malaysians should look forward to the future – rather than remain trapped in the past – and allow an 85-year-old man to return to pay his respects to his parents’ graves.'
