I write to you to seek more information on the above controversy surrounding the sale of the Town Councils Management Software (TCMS) to the PAP-owned $2 company, Action Information Management Pte Ltd. (AIM) As a resident in a GRC managed by a PAP town council, I am bewildered by the above transaction, because the money was used to develop TCMS and thereafter TCMS was sold to AIM. This could affect the residents future, as shown in my 9 questions below. As you are all my duly-elected GRC representatives, and members of CCK town council, you have a duty to account to me on how the money has been spent or how the residents will be affected in future.
My questions are set out below:-
1. How much did all the town councils pay to National Computer Systems to develop TCMS originally, and how much was CCK town council's share ? Since Aljunied Town Council was unceremoniously axed by AIM, how much was Aljunied TC's share in TCMS, and how much did they get from the sale to AIM?
2. Why did the town councils, together with CCK town council, decide to sell TCMS to a third-party in the first place? Did the town councils discuss this decision to sell the TCMS? Please provide to me a copy of the minutes of the town council meeting (or at least, a copy of the portion of the minutes dealing with this) where this decision was made.
3. Who were the other 4 companies, other than AIM, who obtained the tender documents?
4. (a) What due diligence did the town councils, together with CCK town council do on AIM, before awarding the contract to AIM? The tender advertisement notice states, inter alia, on "Eligibility and Financial Grade", that it requires "Experienced and reputable Company with relevant track record." Please provide details of the experience and reputation of AIM and its relevant track record. This question is of vital importance, as public funds are involved.
4 (b) The tender advertisement notice also states, inter alia, that “The Town Councils reserve their rights not to accept the lowestor any tender without assigning any reason thereof". Since the town councils, are the sellers and NOTthe buyers of TCMS, surely the word 'lowest'is a grave error of unimaginable proportions. The correct word should be 'highest', shouldn't it? Here's food for thought for all TC's, but especially for my own CCK town council.
5. What protections are there in the contract with AIM, to ensure that it could properly deliver on its contractual obligations? For instance, was a performance bond or bankers’ guarantee required from this PAP $2 company?
6. Was the fact that AIM is a PAP-owned company disclosed to all town councils? If so, how did the town councils, together with CCK town council, address the conflict of interest, when AIM submitted the only bid for this tender?
7. Was National Computer Systems, who originally developed the TCMS, asked to participate, or was at least, informed of the tender? If not, why not?
8. Did all the town councils, together with CCK town council, know that AIM would engage NCS as a sub-contractor? If so, why did all the town councils, together with CCK town council, not decide to cut out the middleman (i.e. AIM) and simply renew its contract with NCS? That would be logical, wouldn't it ? At any rate, I repeat, what is the main reason for wanting to sell TCMS in the first place?
9. Were all the town councils, together with CCK town council aware that there is a guillotine clause in AIM's contract with TCs, for the termination of contract, due to "a material change in the composition of TCs" as it happened to Aljunied TC? What if more TCs were to fall to the opposition?
As the above are questions of enormous public interest, I should be grateful if you could answer all the 9 questions, point by point, as soon as possible - and not leave any question in limbo.
