The mother from the Tamil family at the centre of an immigration row has spoken of her family's ordeal at a Christmas Island facility, as hundreds of people rallied around the country to urge the Government to let them stay in Australia.

Priya said she, her husband and their two daughters had been holding out hope of a return to their Central Queensland home of Biloela since a last-minute court injunction stopped their deportation on Thursday night.

But she said her daughters were crying "all the time" and had not been eating properly since they were move from the Melbourne immigration centre.

Priya and Nadesalingam, also known as Nades, came to Australia separately by boat in 2012 and 2013 and their daughters Kopika, 4, and Tharunicaa, 2, were born in Australia.

The Department of Home Affairs said the family had been comprehensively assessed a number of times and had consistently been found not to be genuine refugees.

Following the injunction, the Federal Court ruled on Friday that Tharunicaa should not be deported from Australia until 4:00pm Wednesday.

The family was moved from Darwin to a Christmas Island detention centre in the early hours of Saturday morning, lawyers said.

In the small town of Biloela, more than 50 people gathered to tell the Government they want the Tamil family back with them.

A moment of silence was observed for the family and tears were shed as demonstrators sung songs.

Family friend Vashini Jayakumar said the ordeal had "terrified" Priya as a mother.

"They just feel terrible. I don't know how to express that. It's just a very hard time for them," she said.

Priya said she sustained injuries during Thursday night's deportation that were being treated on Christmas Island but were "very painful".

Advocates for the family said the mother had a blood pressure condition and had not received medication to treat it.

The Department of Home Affairs did not comment on the condition of the family or confirm their location, saying it would be inappropriate as the matter is before the courts.

"Unlawful non-citizens are only removed if the Department is satisfied they do not engage Australia's non-refoulement obligations and that removal would not breach Australia's international obligation," a spokesman said.

Supporters push for ministerial intervention
Lawyers will fight the deportation in the courts, but a campaign to keep the family in Australia has urged Immigration Minister Peter Dutton to intervene in the case.

Former deputy prime minister and Nationals leader Barnaby Joyce joined the chorus of voices asking for the family to stay on Saturday.

He told Nine newspapers "I think we should be listening" to the people of Biloela, who want the family to stay.

But he said he was "certainly not here to tell the Minister how to do his job".

Opposition Leader Anthony Albanese, who usually has a bipartisan approach to border protection, said he had raised the issue with the Prime Minister and suggested Immigration Minister Peter Dutton needed to intervene in the case.

"The fact that the family were moved from Darwin to Christmas Island to get them out of public view is, I think, just quite extraordinary," he said.

"What was the cost of that move for the Australian taxpayer?"

Greens Leader Richard Di Natale said the treatment of the family was "senseless cruelty".

"It is barbaric, it is cruel and it needs to end," he said.

Mr Dutton said on Friday the family had been found "all the way to the High Court" not to be owed protection.

A Sri Lankan couple and their Australian-born daughters, who were spared deportation by a last-minute injunction, are due to have their case heard in Melbourne Federal Circuit Court this morning.
Friends and support groups say Priya and Nadesalingam, also known as Nades, fled Sri Lanka during the civil war because of persecution of the Tamil people.
However, the Department of Home Affairs said the family had been comprehensively assessed a number of times and had consistently been found not to be genuine refugees.
Christopher Tran, a lawyer for the Government, told the court last week the family's application to be recognised as genuine refugees was "manifestly hopeless".
Who is the Tamil family?

Last-minute injunctions have stalled the deportation of a Tamil family who have spent years fighting to stay in Australia. Here's what we know about the case.
Simon Jeans, an immigration lawyer who worked with the past 10 immigration ministers, has been following the case. He said several errors were made in the family's bid to stay in Australia.
"Observing this case over the past 18 months has been like watching a train wreck in slow motion," Mr Jeans said.
He said the family have not been truthful in visa applications and said evidence suggested they came to Australia in 2012 and 2013 by boat as economic refugees.
The family have been fighting their case on the grounds they face persecution in Sri Lanka due to links to the militant Tamil Tigers (LTTE).
According to documents from June 2018, Nades claimed he was forced to join the LTTE in 2001 and was harassed by the Sri Lankan military.
However, he frequently travelled between Sri Lanka, Kuwait and Qatar between 2004 and 2010 for work, during the civil war that ended in 2009.

As a result, the Immigration Assessment Authority (IAA) did not accept he had links to the LTTE and would not be "of concern to the Sri Lankan authorities."
"Anyone who was associated with the LTTE or was suspected of being with the LTTE, would not have been coming and going into Sri Lanka," Mr Jeans said.
"They would have been picked up by security forces."
Mr Jeans said boat arrivals tended to exaggerate their stories so they could get permanent residence.

Professor of International Politics with Deakin University, Damien Kingsbury, said it was not unheard of for Sri Lankans to travel to the Middle East for work during the civil war.
Although the conflict has ended, Professor Kingsbury said the political situation was still dangerous for some minorities and people with links to the Tamil Tigers. He said people still "disappear" and were tortured.
"The environment is changing and it's never been particularly favourable to Tamils but it looks like it's changing back to a more draconian environment," Professor Kingsbury said.
He said because the family left the country by boat, they will automatically be taken into custody when they land in Sri Lanka.
"[Nades has] automatically committed an offence in the eyes of the Sri Lankan government," he said.
In a Courier Mail article published last night, Peter Dutton outlined his argument as to why the family should be returned to Sri Lanka.
"They have explained their circumstance to every decision maker and judge and every one of them has rejected their claim for protection. That is that they are not refugees," he wrote.
He said the Government has brought in refugees who in many cases faced imminent death of persecution, adding "their cases are much more compelling than those who are not refugees but simply want a stronger financial future for their families."
Activism more harmful than helpful, lawyer says

Over the past week, the Australian Government has come under fire after dramatic images of the family being taken to Christmas Island were broadcast across screens in Australia.
One video shows the children, Kopika and Tharunicaa, screaming out for their mother as she is dragged away by Border Force personnel.
Yesterday, rallies were held in capital cities across the country in protest of the family's treatment.
Despite the distressing nature of the images, Mr Jeans said excessive media coverage and activism was harming the family's case by forcing the Immigration Minister, David Coleman, into a corner.
"If the Minister grants a visa to the family it just encourages more people to make media campaigns and it might be unfair for other people who may not be able to make as much noise in the community," Mr Jeans said.
"This is the most significant mistake and this is not a mistake of the family."

Sarah Dale, the Centre Director at the Refugee Advice and Casework Service, said media campaigns could have some success in lobbying ministers and cited the removal of children from Nauru as a success.
The Home Affairs Minister Peter Dutton has repeatedly attacked pro-refugees activists and has even suggested some were coaching asylum seekers to self-harm.
Mr Jeans said it's unlikely the Immigration Minister will intervene.
"The family have some merit to remain under the Minister's guidelines but I'm not hopeful that a positive outcome can be put in place at very short notice," he said.

"I understand the compassion shown by many, but we have to look at this case on its merit," Mr Dutton told Channel Nine.

"There's no indication at all that's been given to this family, including before they had children, that they would ever settle in this country.​
"Over a period of time, both Minister Coleman and myself have looked at this case, and it's completely without merit in terms of their claim to be refugees."

Prime Minister Scott Morrison categorically ruled out any use of ministerial discretion in the case, and argued the family could apply to return to Australia as migrants after they returned to Sri Lanka.

"They didn't come to the country in the appropriate way, they have not been found to have an asylum claim," he said.

"And to have changed our policy on this, or to exercise intervention powers on this, would be to send exactly the wrong message to those who are looking to sell tickets to vulnerable people looking to get on boats."

He denied suggestions that the news of a suspected Sri Lankan asylum seeker boat being intercepted in August, splashed across newspapers on Monday, was timed by the Government to coincide with the debate.

Mr Joyce, now a backbench Nationals MP, said the family was valued by the community in the regional Queensland town of Biloela.

He argued Mr Coleman had discretion to overturn the deportation, and said it would not set a precedent.

"It makes for a very dangerous situation for the Border Force officials who are put in a difficult position, because again these advocates lie about the way in which this family's been treated.

"[Claims] that they've been forced and that they've been pulled by the Border Force officials — it's a complete nonsense."

He argued moving the family to Christmas Island made sense considering the disruption being caused by protesters picketing airports and other facilities.

He said because the family left the country by boat, they will be taken into custody when they land in Sri Lanka.

"[Nades has] automatically committed an offence in the eyes of the Sri Lankan government," he said.

In a Courier-Mail article published on Saturday night, Peter Dutton outlined his argument as to why the family should be returned to Sri Lanka.

"They have explained their circumstance to every decision maker and judge and every one of them has rejected their claim for protection. That is that they are not refugees," he wrote.

He said the Government has brought in refugees who in many cases faced imminent death of persecution, adding "their cases are much more compelling than those who are not refugees but simply want a stronger financial future for their families."

Mr Dutton's views are at odds with former deputy prime minister Barnaby Joyce, who has argued Immigration Minister David Coleman has the discretion to overturn the deportation and it would not set a precedent.

Over the past week, the Australian Government has come under fire after dramatic images of the family being taken to Christmas Island were broadcast across screens in Australia.

One video shows the children, Kopika and Tharunicaa, screaming out for their mother as she is dragged away by Border Force personnel.

Yesterday, rallies were held in capital cities across the country in protest against the family's treatment.

Despite the distressing nature of the images, Mr Jeans said excessive media coverage and activism was harming the family's case by forcing the Immigration Minister, David Coleman, into a corner.

"If the Minister grants a visa to the family it just encourages more people to make media campaigns and it might be unfair for other people who may not be able to make as much noise in the community," Mr Jeans said.

"This is the most significant mistake and this is not a mistake of the family."

Sarah Dale, the Centre Director at the Refugee Advice and Casework Service, said media campaigns can sometimes sway ministers and cited the removal of children from Nauru as a success.

Mr Dutton has repeatedly attacked pro-refugee activists and has even suggested some were coaching asylum seekers to self-harm.

Mr Jeans said it's unlikely the Immigration Minister will intervene.

"The family have some merit to remain under the Minister's guidelines but I'm not hopeful that a positive outcome can be put in place at very short notice," he said.

The joke is that to come to Australia via boat, you would depart from Indonesia. Which means you means make your way from Sri Lanka, Iran, Afghan or wherever to Jakarta.

'Very real threat': Peter Dutton's warning after revealing asylum seeker boat arrival

Home Affairs Minister Peter Dutton has warned of the "real" threat of asylum seeker boats from Sri Lanka as it emerged a vessel was stopped by the Australian Border Force last month.

The boat from Sri Lanka was intercepted west of Christmas Island on August 7, with 13 suspected asylum seekers flown back to the south Asian country on August 18, The Courier-Mail reports.

Four asylum seeker boats carrying more than 90 people have now been intercepted off Australia since the May 18 federal election.

Home Affairs Minister Peter Dutton said the threat out of Sri Lanka was concerning.

"It is the reason Sri Lanka was the first country I visited after the election, to make sure we can keep these boats stopped. This threat is very real," he told the newspaper.

"Labor wants people to believe that the threat of new boat arrivals is not real. It is. We are dealing with it every day."

News of last month's asylum seeker boat comes as a Tamil family being held on Christmas Island are waiting to find out if a court will allow them to stay in Australia.

An interim injunction blocking the deportation of Priya, her husband Nadesalingam and their Australian-born children Kopika, 4, and Tharunicaa, 2, has been extended until Wednesday.
