DPP lawmaker vows to appeal verdict

TAIPEI (Taiwan News) – Former President Ma Ying-jeou (馬英九) was found not guilty of pressuring the then-prosecutor general to leak confidential information about the investigation into alleged influence peddling by then-Legislative Speaker Wang Jin-pyng (王金平) and of defamation.

Appeals against the Taipei District Court verdict are still possible.

Based on transcripts of a wiretapped conversation supplied by the prosecutor general, Ma accused Wang in 2013 of having tried to influence a prosecutors’ decision not to file an appeal against a not-guilty verdict for top opposition lawmaker Ker Chien-ming (柯建銘) in a breach-of-trust case.

It was the senior Democratic Progressive Party legislator who brought the case against Ma leading to Tuesday’s verdict. Ker said he would appeal against the ruling.

He accused the former president of forcing the prosecutor general to reveal confidential information and of having defamed him by making the allegations public at a news conference.

Ker also accused the ex-president of interfering into a private investigation, while Ma defended himself, saying he was considering the administrative implications of the allegations.

The former president, who has been embroiled in several legal cases since leaving office last May, pleaded innocent and accused Ker of having filed the suit to draw attention away from his own alleged involvement in influence peddling.

Ma was not in court Tuesday to attend the judge issuing a verdict.

The court said that there was no evidence to suggest that in his 88-second phone call to the prosecutor general, Ma told him to bring or make public confidential information. As to the alleged defamation of Ker, the district court said that Ma had only commented on information available in a news release from prosecutors.

The case became public in September 2013 and started a long power struggle between Ma and Wang, with the former trying to expel the latter from the Kuomintang, which would have automatically resulted in the end of Wang’s legislative career. The speaker won every step of his court battle to remain in the KMT, with the ruling party later deciding to drop the case.

On March 14, Ma was indicted for having leaked the confidential information from the prosecutor general to his premier, Jiang Yi-huah (江宜樺), and to a key aide, Lo Chih-chiang (羅智強). The court still has to start treating that particular case, and no dates have so far been set for hearings or for a verdict.
