Chinese man accused of creating fake U.S. Army unit

(Reuters) - A Chinese man was arrested for creating a fake U.S. Army unit and convincing immigrants that joining the squad was a path to citizenship, authorities said.

Yupeng Deng, 51, allegedly gave his recruits military uniforms, had them parade in a Los Angeles suburb and took them to the decommissioned USS Midway aircraft carrier, which is a museum in San Diego.

Deng charged more than 100 fellow Chinese nationals a fee of between $300 and $450 to join the fake Army unit, according to the Los Angeles District Attorney's Office.

He called his bogus squad the U.S. Army/Military Special Forces Reserve unit, or MSFR for short, and he gave himself the lofty title of supreme commander, prosecutors said.

Aside from telling recruits that belonging to the unit was a path to U.S. citizenship, Deng also urged them to pay him cash for higher military rank, according to prosecutors.

He also allegedly provided them with fake documents and phony military identification cards.

Deng, a resident of the Los Angeles suburb of El Monte, was arrested on Tuesday by sheriff's deputies.

He was charged with theft by false pretenses, manufacturing deceptive government documents and counterfeit of an official government seal.

Deng faces up to eight years in prison if convicted. He is scheduled to be arraigned on Wednesday, and is being held on $500,000 bail.

Jane Robison, a spokeswoman for the District Attorney's Office, declined to comment on how Deng was caught.

"All the details and evidence will come out in a preliminary hearing," she said.

The voters who elected the new Congress expect it to cast off unconstitutional and discredited policies such as Keynesian big-spending and judicial grabbing of legislative prerogatives. We also hope Congress will shake itself loose from the dishonest, anti-American trade policies of other countries, especially Communist China.

Although China is called a major trading partner, it treats U.S. companies like suckers, cheating them coming and going. China even intimidates U.S. businessmen so they don’t dare to criticize China’s unfair trade tactics.

Take, for example, the attitude of CEO Jeffrey R. Immelt of General Electric, the company now laying off hundreds of U.S. workers and giving those jobs making light bulbs to Chinese workers. He won’t comment about the current U.S. case in the World Trade Organization accusing China of giving illegal subsidies to Chinese wind turbine makers.

A few years ago, G.E. caved into the Chinese government’s demand that G.E. build a large wind turbine factory in China. Since G.E. owns a crucial patent for wind turbines, this demand was based on the Chinese anti-free trade policy called indigenous innovation (which China expert James McGregor calls “a blueprint for technology theft on a scale the world has never seen before”).

China then developed its own wind turbine manufacturers, and is now directing purchasers to buy from those Chinese firms instead of from G.E. That’s the reality in what free traders naively believe is the world’s fast-growing market for U.S. goods.

When asked about China’s cheating of G.E. on wind turbines, Immelt responded by saying that G.E. will fine-tune its competitive tactics to adapt to Beijing policy. The New York Times quoted a California lawyer specializing in Asia deals, Judy Lam, as explaining that his reaction translates as, “I understand my place” and big American corporations are “willing to suck it up—that will win them points.”

Although the Obama Administration filed a wind-turbine complaint with the World Trade Organization, no U.S. company joined to defend itself. WTO disputes take up to three years to come to a decision, which usually turns out to be against U.S. interests.

The United Steelworkers Union has dared to complain about China’s cheating practices on alternative energy products such as wind turbines, solar panels and batteries, filing a 5,800-page petition under section 301 of the Trade Act of 1974. Google said it might shut down its China-based internet search engine if Chinese censorship continues.

The Chinese government passes short laws on complex industrial and financial subjects while leaving unlimited discretion to bureaucratic regulators (like the Obama Administration). In authentic socialist practice, the regulators can use their discretion to advantage their friends and punish their enemies.

China has a long record of disciplining companies that fail to conform to Chinese regulatory demands. Chinese regulations presume to dictate ordinary managerial decisions of non-Chinese companies such as what equipment may be bought and from whom.

China has a Communist government, so the Communist Party is in the driver’s seat. China can violate with impunity all international law and trade agreements, slap taxes and regulations on U.S. plants in China, compel U.S. corporations to give their trade secrets and manufacturing know-how to Chinese competitors, and force Americans to keep silent about the unfairness of it all.

G.E.‘s Immelt was gung-ho for trade with China in 2002. He then told G.E. managers: “I talk China, China, China, China, China. You need to be there. I am a nut on China.” But G.E. got only half the China market that Immelt was counting on.

In 2010, after G.E. had handed over technology in everything from rail locomotives to antipollution equipment in order to gain access to the Chinese market, Immelt was singing a different tune: “I really worry about China. I am not sure that in the end they want any of us to win, or any of us to be successful.”

After major U.S. corporations, including our biggest technology companies, gave away their most valuable industrial secrets, they are asking themselves, Was it all worthwhile?

Some people foolishly call our relationship with China “free trade.” But there is nothing free or fair about it; it is trade war between an aggressively protectionist Communist government and a U.S. that is shackled by foolish and out-of-date illusions about free trade.

A suspicious microprocessor was the first sign something fraudulent was afoot.

AN APPLE MacBook Air notebook computer, offered on eBay by a seller in Perth for just $599 - $500 less than the list price - was the bargain of the year, thought Tony Thomas, Melbourne journalist and Mac enthusiast, as he hit the ''buy now'' button.

The computer, shown on the eBay site to have an illuminated Apple logo on its lid and Apple's MacBook Air livery on its packaging, was, in fact, a fake. It ran not Apple's Mac OS X operating system but Microsoft's Windows.

''I was in Perth on my way home from Africa when I saw the MacBook Air on eBay,'' Thomas says. ''I snapped it up straight away, sure I had a wonderful bargain. I even emailed the seller, identified as Jake Gill at 'oz-sh0p' in the Perth suburb of Balga, suggesting I cab out to his place with the cash so I could take the machine home next day. He replied that it wasn't convenient and insisted I pay through PayPal.

''I should have smelled a rat. But I was cackling with glee about my bargain and posted a note on iMUG [the Melbourne Macintosh User Group's online forum], skiting about my luck.'' Members of iMUG, intrigued by the price, queried the ''MacBook's'' specifications. Told the microprocessor was a 1.67GHz Intel Atom, a chip that is not compatible with Mac OS X, they agreed: ''It's a knock-off.''

Thomas consulted the experts at Beyond the Box, an Apple reseller in Moonee Ponds, near his home, who confirmed Atom processors had never been used in MacBook Airs. ''By then the truth was clear,'' Thomas says. ''I had bought a fake.'' The computer arrived by courier a few days later, packed in a cardboard box printed with a facsimile of Apple's MacBook Air labelling. A Customs declaration on the outer brown paper wrapping was in Chinese but in English described the contents as a ''G-book'' and ''a gift.'' It had been sent not from Perth but from China.

The machine has a plastic case (genuine MacBook Airs are aluminium) and the Apple logo is a cut-out. Other features, such as USB ports and the PC-style power adapter, are poorly done. The handbook is in Chinese and there is no Mac system disc, just a CD labelled ''driver''. Thomas contacted eBay's disputes department, which checked with Apple that the machine was a fake and immediately wiped ''Jake Gill's'' oz-sh0p entry. PayPal, owned by eBay, refunded the money.

''I emailed Jake Gill offering to return it if he sent me his mailing address,'' Thomas says. ''I have heard nothing. This also showed me the value of membership in a computer club such as iMUG, where so much expert support is always available.'' Many attempts to sell counterfeit goods on eBay are thwarted before they are listed, eBay Australia-New Zealand spokeswoman Jenny Thomas says.

More than 10,000 companies seeking to protect their brands and customers have joined eBay's global Verified Rights Owner program, through which they advise the online market of infringements of their brand. Counterfeit electronics and other luxury goods have long been a plague on the internet. The makers of these operate brazenly, despite assurances from China that pirates will be punished.

For example, in Kunming, in China's Yunnan province, a business owner has mimicked the Apple Store concept with its own retail presence. Most items on sale appear to be genuine. However, a US visitor to the store, who blogs as Birdabroad, said some employees genuinely thought they were working for Apple.

BEIJING, July 28 (Xinhua) -- An official with China's State Administration of Industry and Commerce (SAIC) said Thursday that the agency had started an investigation into three reportedly fake Apple Stores.

Ning Wanglu, head of the SAIC's anti-monopoly and anti-unfair competition bureau, said the administration has ordered the local industrial and commercial regulator in the southwestern Yunnan Province to investigate and verify the case after it was informed that there were three Apple Stores in Kunming, capital city of Yunnan.

Two of the three stores claimed they were Apple's authorized outlets, while the other admitted it was not, according to Ning, speaking to reporters during a press conference.

The Yunnan provincial administration of industry and commerce was conducting a further investigation into the claims and would submit the final findings to the SAIC, said Ning without giving a timetable.

Apple has four authorized outlets in the Chinese mainland, two in Beijing and two in Shanghai, according to the official website of the company.

China piracy sweep nets fake Tibetan books, porn films

(Reuters) - China's latest crackdown on intellectual property piracy has netted more than 20,000 fake Tibetan-language text books, 90,000 copies of a well-known Chinese film as well as porn films, state media said on Friday.

The United States and other Western countries have repeatedly complained that China has not kept promises to stamp out intellectual property theft.

Countless pledges from Beijing to get tough have also failed to stamp out the problem, and pirated goods are commonly found in shops and on the streets of the Chinese capital.

In the latest effort to convince a skeptical world its efforts are paying off, the official Xinhua news agency said Chinese courts had given sentences of up to six years in jail to 18 people for pirating the text books and films.

"In one case, Zhang Xinfeng was found to sell more than 30,000 copies of textbooks, including more than 20,000 Tibetan books, to 25 schools in 19 Tibetan cities and counties between September 2009 to September 2010," the report said.

Zhang got five years in jail and a 100,000 yuan ($15,521) fine, Xinhua said. Two other people were also given jail time for producing 90,000 copies of the 2010 Chinese film, "Let the Bullets Fly," by award-winning director Jiang Wen, as well as "porn discs," it added without elaborating.

Xinhua said the sentences were "the latest move to show the country's determination to combat piracy." U.S. Department of Commerce General Counsel Cameron Kerry, in Beijing this week on a visit focused on anti-corruption and commercial rule of law issues, said piracy remained an area of concern.

Washington would "like to see continuing improvement in the area of intellectual property enforcement," he told reporters. Software companies who have done business in China for years "haven't yet seen an uptick in software sales," even though China has touted that all central government agencies are using legally purchased software as of May, Kerry added.

"The recent special campaign was effective at raising awareness, but these efforts need to continue," he said. "They need to deepen the audits of Chinese government agencies and state-owned enterprises."

Chinese piracy and counterfeiting of U.S. software and a wide range of other intellectual property cost American businesses alone an estimated $48 billion and 2.1 million jobs in 2009, the U.S. International Trade Commission said in May.

China's history with food safety is a rocky one, but even in the annals of robbery and abuse, this will go down in infamy.
Various reports in Singapore media have said that Chinese companies are mass producing fake rice made, in part, out of plastic, according to one online publication Very Vietnam.
The "rice" is made by mixing potatoes, sweet potatoes and plastic. The potatoes are first formed into the shape of rice grains. Industrial synthetic resins are then added to the mix. The rice reportedly stays hard even after being cooked.
The Korean-language Weekly Hong Kong reported that the fake rice is being sold in the Chinese town of Taiyuan, in Shaanxi province.
"A Chinese Restaurant Association official said that eating three bowls of this fake rice would be like eating one plastic bag. Due to the seriousness of the matter, he added that there would be an investigation of factories alleged to be producing the rice," Very Vietnam noted.
Unfortunately, it's not the first time fake rice has been sold in China, according to China's Global Times.
