SINGAPORE: Surgeon Dr Susan Lim wanted the Ministry of Foreign Affairs (MFA) to intervene and stop the Singapore Medical Council (SMC) from investigating an accusation of over-charging against her, in the High Court hearing Monday.

The Council's lawyer described her move as a "pressure tactic".

Dr Lim, who was not in Court Monday, is fighting a move by the Council to appoint a second disciplinary committee to investigate an accusation by the Health Ministry that she had overcharged her patient, a member of the Brunei royal family.

In her letter to Foreign Affairs Minister George Yeo, Dr Lim had said she would need to disclose details of the royal family of Brunei which could impact the relationship between the two countries.
MFA however rejected Dr Lim's request and said the Ministry does not intervene in legal proceedings.

Court documents from the Council also revealed that Dr Lim had alleged a personal or professional conflict of interest against Chairman of the second disciplinary committee.

Senior Counsel Lee Eng Beng, who is representing Dr Lim in the last day of the hearing, argued that Dr Lim had not marked up the bills.
The judge will deliver his verdict on a later date.

Court of Appeal reserves judgement on Dr Susan Lim case

SINGAPORE: The Court of Appeal on Thursday reserved judgement on prominent surgeon Dr Susan Lim's attempt to overturn a High Court decision against her for overcharging her patient, a member of the Brunei royal family.

Dr Lim was appealing against the decision to allow the Singapore Medical Council (SMC) to convene a second disciplinary committee to hear her case.

A hearing before the SMC's disciplinary committee halted abruptly without a decision in July last year following accusations by Dr Lim's lawyers that the panel had prejudged the case.

Dr Lim has been embroiled in the high-profile case over her S$12 million bill for treating a cancer patient - the sister of the Brunei queen - over seven months in 2007.

Dr Lim, who's represented by Senior Counsel Lee Eng Beng from Rajah and Tann, told the court that the SMC has failed in its statutory obligation to provide a disciplinary process that is fair.

Mr Lee argued that the decision made by the Council to reconvene the disciplinary committee was not valid.

His argument was based on two emails, dated September 3 and 13 last year, sent to members of the Council by its secretariat.

The emails informed members about the Council's decision to appoint a second disciplinary committee and that if no responses were received from any member, the decision would be deemed to be unanimous.

Mr Lee claimed that the emails also do not contain sufficient information and do not advise the members of what had happened and what considerations they need to bear in mind before they could make a proper decision.

He also showed an affidavit filed by a member of the SMC, Dr Wilmot Rasanayagan, who said that he rejected the appointment of the second disciplinary committee.

The court has ordered that the SMC provides affidavits from members who received the emails to ascertain that they read and understood the decision by the Council.

The SMC represented by Mr Alvin Yeo from Wong Partnership has asked the court to dismiss the appeal.

Mr Yeo said that the charges against Dr Lim be allowed to be fully investigated in a formal inquiry by the second disciplinary committee.

Dr. Susan Lim is a specialist in liver transplant and stem cell research. The Bruneian patient was being treated for cancer? Isn't this outsider her field? Shouldn't she have transferred or referred the patient to someone who knows cancer rather than seeing $$$ to be made? What was her motive in pursuing this patient?
 
Problem here is that patient doctor relationship is not same as customer relationship. Patient has cancer - death sentence hanging over head, pain, disfigurement, all sorts of fears, worries, shame etc. Now the question is to what extent this relationship has been unethically taken advantaged of. While being very sick, in fear of death, who's judgement is very good? If such a patient demands the heavens and can pay for it, does it mean the doctor gives everything she wants? If royal wants to put a swimming pool in his jumbo jet that's his business... But somebody sick with cancer fearing for her life but wants the extreme may not be the same situation.

Seems she did liver transplant quite many years ago when in public sector. Dabbled in stem cell research but that doesn't seem to be going anywhere fast. She's a breast cancer surgeon so that was well within her field.

There're expert knowledge guidelines as to what treatments are recommended for what stage of disease that docs/ specialists should know. Even for most exceptional cases, what's done (or not done) needs to be justified based on shared knowledge in the specialised field. There're many many breast cancer experts all over the world treating celebrities. Case before medical council would be extremely simple if she could just get couple of them to go through all the steps she did for this patient, say they were all professionally justified, that the costs were reasonable. Open and shut case that obviously isn't here.
