I just heard on CNA that Najib has undertaken to abolish the ISA. Not too long ago, one of our PMs said that we would keep the ISA only as long as Malaysia has the ISA. Are the PAPzis going to keep their word on this?

Cun Bo?? They won't do it lah..Both Mudland and Sinkieland need this law to keep the peasants in order..In fact the Malaysia MHA Minister just say it's here to stay and they may tweak the system..:D

Not celebrate yet. Najib is under great pressure to restore the UMNO-BM majority balance snd this could be a trick to get that to take place.

Until we see the Malaysian Federal parliment pass this as law, The talk abt abolishing ISA is just an election tactic, which the act itself may never take place if BN restore their 2/3 majority.

Abolishment Of ISA Should Make People More Responsible In Ensuring Peace And Order

KUALA LUMPUR, Sept 15 (Bernama) -- The government's decision to abolish the Internal Security Act (ISA) as announced by Prime Minister Datuk Seri Najib Tun Razak today should make people be more responsible in ensuring peace and order in the country.

Universiti Utara Malaysia's Political and International Studies lecturer Md Shukri Shuib said the decision showed Najib's confidence in the Malaysian society's role including that of the legislative members of the opposition in the overall transformation process.

"With the abolishment of the ISA, indirectly, the executive branch (of the government) has given part of its power on the question of security to the judiciary and legislative, including the people.

"And those in the legal sector, including members of the Bar Council, should be more disciplined and also neutral. There should no more vacillating and hiding behind political activities.

"The opposition too should give their commitment to the transformation process," he said when contacted by Bernama.

Md Shukri said abolishing the ISA should also not pave the way for certain quarters to carry out subversive activities, but to see this decision as a right step to strengthen the country's functional and inclusive democratic system.

Najib in his Malaysia Day 2011 special address, announced that the ISA would be abolished and two new laws introduced to ensure continued peace, order, prosperity and harmony in the country.

In his address, Najib also announced the abolishment of the Banishment Act 1959, and comprehensive review of the Restricted Residence Act 1933, Publications and Printing Presses Act 1984 and Section 27 of the Police Act.

Md Shukri said there should not be polemic following this, with certain quarters claiming that the measures taken by the government were politically motivated.

He hoped the opposition would offer constructive alternatives in the formulation of new, comprehensive security laws, instead of playing up political sentiments.

Makkal Sakhti Malaysia president Datuk R.S. Thanenthiran said Najib's latest decision proved that he was keeping his promise made when he became prime minister -- to be a 'people's prime minister'.

Describing the decision as bold and daring, Thanenthiran said the decision to revoke the ISA had been awaited by the people.

"This is a major and awesome transformation for the good of the people, and the people should congratulate the prime minister for his courage and openness.

"I believe the decision was made after careful study by all concerned parties. The time is right for transformation in this era of modernisation. This outdated Act (ISA) should be abolished," he said.

Thanenthiran said the decision would not only improve Barisan Nasional's image, but also Malaysia's as there were still developed countries practising the ISA.

National Press Club president Mokhtar Hussain welcomed the government's decision to review the Publications and Printing Presses Act, hoping this would bring positive changes.

"Any positive changes to the Act will give more space to the press in Malaysia to play a more constructive role without any fear.

"It will also lift the standard of journalism in the country and enhance the integrity of the press in playing its role in a democratic society," he said.

SINGAPORE - Three men were detained under the Internal Security Act between January and July this year for their involvement in terrorism-related activities, said the Ministry of Home Affairs (MHA) yesterday.

They are Jumari Kamdi and Samad Subari - who are members of the Jemaah Islamiyah (JI) terrorist group - and Abdul Majid Kunji Mohammad, a member of the Moro Islamic Liberation Front (MILF).

Yesterday's press statement from the MHA came a day after the 10th anniversary of the Sept 11 attacks, and as Singapore's leaders reiterated the importance of vigilance in tackling the terror threat.

The three detained men are Singaporeans.

Jumari, who was detained in January, was a member of a JI network in "a neighbouring country where he had relocated to in the 1980s", the MHA said.

He had undergone para-military training organised by the JI, including the handling of weapons and firearms. Jumari was apprehended in November last year and was deported to Singapore.

Samad, another JI member, was one of the pioneer members of the Singapore JI network, the MHA said. He had undergone terrorist training with Al Qaeda in Afghanistan in 2001 and fled to Indonesia following the crackdown on the JI network.

He remained in hiding until his arrest by the Indonesian police in Sumatra in June 2009 and was jailed for immigration offences. Upon the completion of his prison sentence in June this year, Samad was deported to Singapore.

The MHA said Abdul Majid, who had been residing in Malaysia since the mid-1990s, was a member of the MILF since 1998.

He had "undergone para-military training in weapons-handling and the making of improvised explosive devices" at the MILF's Camp Abu Bakar in Mindanao, Philippines.

"Over the years, he aided the group in procuring funds and weapon components," the MHA said. Abdul Majid was arrested in Malaysia in May, this year and was subsequently deported to Singapore.

In its press statement, the MHA also said Mohamed Khalim Jaffar, a member of the Singapore JI, was released earlier this month on a Suspension Direction. Khalim was detained under the ISA in January 2002.

A Suspension Direction is made by the MHA to suspend the operation of an existing Order of Detention, subject to the execution of a bond and to conditions as the minister sees it.

The conditions may include restrictions in respect of a person's residence, employment, movements and activities.

A ministry spokesperson said there are 17 people on Orders of Detention, one on Suspension Direction and 49 on Restriction Orders currently.

Under a Restriction Order, a person must abide by certain conditions and restrictions after release, or risk being re-detained.

纳吉也宣布检讨警察法令第27条文,以符合联邦宪法第10条文所赋予集会的自由,但强调政府仍坚决反对街头 示威。

他表示,政府了解到大马已改变,也了解人民期待这个国家更开放,重视人民的概念和想法,让世界民主标准,即 民有、民治和民享的理念起步。

他表示,紧急状态是历史的产物,因此人民是时候向前迈进,迎向新希望,而不再受制于极端历史的 束缚。

因此纳吉宣布,国阵政府将向国会提案,以废止仅存的3项紧急状态。

我国独立至今,一共颁布4次紧急状态,包括在1964年9月3日全国颁布的紧急状态、1969年5月15日 全国颁布的紧急状态、1969年9月14日在砂拉越颁布的紧急状态,以及 1977年11月8日在吉兰丹州颁布的紧急状态。

根据联邦宪法第150条款第3项,国家元首赋权解除已颁布的紧急状态,或在下议院及上议院通过后自动解除。 除了1964年颁布的紧急状态已解除,其他已颁布的紧急状态至今仍有效。

法庭定夺延长扣留

此外,政府将废除内安法令,并另外制定两项新法令来对付颠覆、恐怖主义,以及破坏公共秩序与安全的有预谋犯 罪。

纳吉表示,这些新法令将大幅缩短警方扣留的期限,并比现在的期限更短。

除了对付恐怖主义法令的权力仍操控在部长的手上,但延长扣留的权力将从行政权转移到司法机构,所以接下来的 扣留都需要获得庭令。

纳吉表示,他遵从当初在2009年4月3日接任首相时的承诺,以检讨1960年内安法令。

“就此,我在这个历史性的夜晚,欣然宣布1960年内安法令将直接废除。”

纳吉承诺,今后不会再有人因为政治信仰的不同,而被扣留。

纳吉也宣布废止1959年驱逐法令,并答应全面检讨其他数项法令,以满足现代的需求,包括1933年限制居 留法令和1967年警察法令第27条款(有关集会自由部分)。

纳吉保证,政府不会犹豫修改或废除任何不再重要的法令。

改革政策挽回声望

媒体早前引述消息,纳吉今晚将宣布三项“小开放”政策,包括修改内安法令及放宽集会和媒体自由,试图在举行 全国大选之前挽回劣势。

早前公布的民调显示,纳吉的民望因净选盟大集会而在上个月跌破60%,跌到两年来的低点。

独立民调中心在国庆日前夕发布的民调显示,由于政府不当处理净选盟事件和生活成本高涨等原因,令首相纳吉的 民望在8月下挫至59%。这比5月民调的65%成绩,下挫了6%。

KUALA LUMPUR - Malaysia will repeal a controversial 51-year-old law allowing detention without trial and ease other legislation blamed for curbing civil liberties, Prime Minister Najib Razak said Thursday.

Bowing to a key opposition demand as speculation over snap polls mounts, Najib said the abolition of the tough Internal Security Act (ISA) and other changes were aimed at finding a balance between security and democratic rights.

"I am happy to announce on this historic night that the ISA will be completely repealed," Najib said in a nationally televised speech.

"The changes are aimed at having a modern, mature and functioning democracy which will continue to preserve public order, ensure greater civil liberty and maintain racial harmony."

Najib took office in 2009 promising changes to ISA. But Thursday's announcement came as a surprise as government officials had recently indicated the act was only set for a comprehensive revision.

Najib added that two new laws would be drafted to ensure multi-racial, Muslim-majority Malaysia can "deal with subversive elements, terrorists and criminal acts".

He said any new legislation would ensure detentions can only be carried out by court order and that future periods of detention without trial would be shorter than in the past.

However, he said actions against suspected terrorists would still come under the powers of the home minister.

The ISA allows an individual to be held virtually indefinitely for acts considered a threat to national security or to prevent such acts.

Thousands of people have been detained under the ISA over the past five decades, typically those suspected of Islamic militancy and government critics.

Najib, who had been expected to make some sort of bold move with elections due by 2013 and his public support sagging amid a resurgence by the political opposition, said he also would also review other laws "that are no longer relevant".

This will include repealing the Publications and Printing Presses Act and replacing it with new legislation.

The current act leaves the press vulnerable to licence revocation, and has resulted in a print and broadcast media landscape lacking real opposition voices, although several plucky online news portals have stepped into the void.

The government will also review an act which requires police permission to stage public gatherings, which has been blamed for stifling freedom of assembly.

Najib's government was widely criticised for forcefully quashing a July rally by the opposition and civil society groups for electoral reform.

The ruling coalition now headed by Najib has governed Malaysia since its 1957 independence from Britain.

Brigadier-General (Res) Lee made this response to seven Malaysian journalist s in his office recently when asked why the ISA was still needed in Singapore even though the Communist Party of Malaya no longer posed a threat.

He said that if Malaysia did not abolish the same Act, which provides for indefinite detention without trial, it must have its reasons.

In the interview published in the Nanyang Siang Pau, a Malaysian daily and Lianhe Zaobao yesterday, BG Lee said: "Communism may be dead, but it is not the only threat. We must still deal with other groups, like religious extremists - members of a Malay group were arrested under the Act for making preparations to commemorate the May 13th incident."

The May 13 riots in Malaysia in 1969 started soon after Alliance won a narrow victory in the general elections. A series of bloody clashes broke out between the Chinese and Malay communities, leading to a state of emergency.

He added: "There were also the dissidents and church members involved in a conspiracy to subvert Singapore's political and social order three years ago; another incident involved Francis Seow being exploited by the US. Had there been no ISA, these cases could never have been exposed. So, it is still better for us to retain the Act."

In an earlier meeting with the journalists, Law and Home Affairs Minister S. Jayakumar stressed the need to deal with racial and religious extremism, even though there was no threat from communism.

On the detention order on former Barisan Socialis MP Chia Thye Poh, he said that although Mr Chia is restricted to Sentosa, he is allowed to visit mainland Singapore during the day, but must return to the island in the evening.

Asked by Nanyang Siang Pau about the possibility of a complete withdrawal of the detention order, Prof Jayakumar said he did not rule this out. But, he said, even though Mr Chia has been conducting himself well on the island, he is still not willing to disavow communism.

Malaysia has abused the ISA for the last twenty years. Using it to blatantly suppress political democratic opposition. I believe these abuses have led to it's abolishment. The GOV has not done the same since spectrum and as a tool I would still recommend and support the ISA .

06:44 PM Sep 16, 2011The Government notes the announcement by Malaysia that it will be replacing its Internal Security Act (ISA) with new legislation aimed at preventing "subversive action, organised violence and criminal acts".

The ISA in Singapore and Malaysia may have the same roots from the time when both were British colonies, but the two countries and their respective societies have evolved differently over time. Accordingly, the ISA in Singapore has evolved and is now different from that in Malaysia. A person arrested under the ISA in Singapore may be held in custody for up to 30 days after which an Order of Detention or Restriction Order must be issued or else the person must be released unconditionally. In Malaysia, the period of custody is up to 60 days. Also, under the Singapore ISA, since 1991, the President has the power to veto the Government's decision to detain a detainee if the ISA Advisory Board, which is chaired by a Supreme Court Judge, has recommended the release of the detainee. This was an additional safeguard enacted by the Singapore Government to prevent misuse of the Act.

The Singapore Government has used the ISA sparingly. The ISA has only been used against individuals who have acted in a manner prejudicial to the security of Singapore or to the maintenance of public order or essential services therein. No person has ever been detained only for their political beliefs.

The ISA in Singapore has only been used to deal with threats of subversion, racial and religious extremism (such as inciting racial or religious hatred, strife and violence), espionage and terrorism. These threats continue to be salient today, especially in the last ten years against the threat of terrorism, where the Government's priority is to act swiftly to prevent an attack from taking place. The arrests made under the ISA in Dec 2001 thwarted the imminent suicide bombings against establishments in Singapore that were planned by Al-Qaeda operatives assisted by several of the arrested Jemaah Islamiyah members, preventing the loss of innocent lives. The ISA continues to be relevant and crucial as a measure of last resort for the preservation of our national security.

I agree that ISA hasn't been abused in the GCT and LHL eras like in the LKY era. Nevertheless, I think that updating is required. The fear factor is in the catch-all net factor. It should be updated or replaced by proper anti-terrorist laws. There's already a Religious Harmony Act to deal with religious inciters.

Little Emperor Jr has confirmed that he is nothing but a dishonest liar.

The good thing to come out of this is that Singaporeans now know what Little Emperor Jr means when he uses the term "seriously consider".

It means "seriously consider" can be completed in less than 24 hours without the need for Parliament being convened or without Parliament or his Cabinet debating the issue.
