雄檢再確認 陳致中用妻子手機召妓

陳致中召妓疑雲，繼高雄地方法院法官認定屬實後，高雄地檢署十八日又根據首度曝光的「人文首璽」停車場陳致中取車畫面，以及警方提供路口監視器拍下「妮可」坐上陳致中休旅車畫面等新證據，再度認定陳致中有召妓；檢方還指出，陳致中是使用妻子黃睿靚的手機，搭配O953門號與應召站聯繫。

面對先前法界及陳致中委任律師質疑沒有查到應召站、無法證明有召妓的說法，檢方也根據警方監視器影帶中拍到接送應召女轎車E4-XX26的車號，傳訊了當天在場的林姓馬伕，他坦承接送「妮可」上了召妓男的2096-ZC休旅車，也成為全案的關鍵證人。

面對雄檢再舉出「召妓是事實」證據，陳致中強調，全部是推論證據，他質疑檢方在選前敏感時刻公布這些證據，案件也沒有急迫性，很明顯就是政治打壓。陳致中晚上仍參加造勢晚會，但黃睿靚並未現身。

陳致中之前受訪指立委邱毅說他召妓是「 人說 話」、「瘋人講的話根本不可信」，邱毅因而告陳致中誹謗，要求檢方介入調查，高雄地檢署昨天偵結，認為純屬個人主觀意見發表，未涉誹謗罪，對陳致中不起訴。

但有意思的是，偵辦的主任檢察官呂幸玲，在長達廿七頁的不起訴書中，對於誹謗罪的論述只有寥寥六頁，反而以長達十四頁來為陳致中究竟有無召妓「釋疑」。

檢方強調，本案由週刊報導引起，要判斷執是執非，就必須先釐清週刊報導是否屬實，因此，昨天特別公布陳致中住家「人文首璽」畫面，證實從七月二日深夜到隔天凌晨，陳致中有到停車場開車進出。

檢方並查出，陳致中家人持有人文首璽大樓的四張磁卡，其中只有陳致中的磁卡從晚上十一點十四分，刷卡搭乘電梯到停車場，隔天凌晨零點四十九分又從停車場刷卡進入大樓搭乘電梯上樓；綜合上述證據，檢方認為並非如陳先前所說「七月二日晚間九時返家後即未外出。」

檢方又調閱召妓男與應召站約定地點的警方路口監視器，證實「妮可」確有其人，也確實上了陳的休旅車，情況與週刊報導相符。

陳致中先前曾說當天車子是由友人林偉斌借用，但林在出庭時僅坦承有借車，但忘了是那一天？又說壓力很大，無法回答台北金融圈友人是誰？借車之說檢方並不採信。

檢方調查過程中，又意外發現，召妓男使用「○九五三」門號原本是搭配用陳致中的手機，卻從今年三月廿五日到七月廿日，改為搭配黃睿靚的手機使用，而這支門號大多使用在接受色情簡訊或與應召站業者聯繫。

檢方根據兩處監視器畫面、通聯分析、手機使用、人文首璽刷卡記錄等諸多證據，均證明陳致中說謊，認定「其所為依一般正常智識之人的認知，即係『召妓』之舉。」

照片戳破謊言　地檢：陳致中是召妓男

邱毅告陳致中的刑事案件，高雄地檢署今天簽結，卻罕見的對媒體公佈陳致中在7月2日、7月3日這兩天進出人文首璽停車場的監視器照片，照片中清晰可見陳致中在7月2日晚間11點04分，到停車場取車，1個多小時後，這台銀色凌志休旅車又出現在車道上，等於是直接戳破陳致中當初說，7月2日晚上工作完就搭乘計程車回家的說法。

從檢方公佈的照片可以明顯看到，陳致中穿著T恤、牛仔褲，走進人文首璽的停車場，準備搭上他的銀色凌志休旅車，時間是7月2日深夜11 點04分，另外2張照片，一張是轎車離開人文首璽，另一張則是車子回到人文首璽的車道上，時間則是7月3日凌晨0點49分，檢方認定，這些照片就足以戳破陳致中7月2日回家後就沒外出的謊言。陳致中司機（7月22日）：「載致中到明誠路快接近12點了。」

高地檢襄閱主任檢察官王俊力：「顯示說陳致中在7月2日的晚上，他有外出的情形。」

第一張照片也清楚拍到，深夜11點多，陳致中確實是自己凌志轎車出去。陳致中（7月21日）：「銀色代步休旅車借給朋友，林姓朋友在使用。」

王俊力：「他們的供述跟證詞並不可採，所以也不足以認定，有第三人來借用這部車子。」

檢方說，他們交叉比對陳致中、黃睿靚及召妓男的手機門號及序號，都有重疊的地方，認定召妓男就是陳致中。

王俊力：「黃睿靚曾經使用過其中一支序號手機，因此我們認為說陳致中先生，跟這位召妓的男士，應是同一人。」

檢方說，是因為承辦邱毅告陳致中毀謗官司，有必要查清楚陳致中到底有沒有召妓，才會進行調查。只是陳致中告壹週刊的民事官司，2天前才被駁回，法官還一度被批撈過界，檢方卻選在偵查終結時，違反慣例，主動公佈這些證據，時機敏感，引人質疑。

高雄市議員候選人陳致中和妻子黃睿靚昨天舉行記者會，兩人都不能接受檢方指「陳致中與召妓男應係同一人」的說法，要求檢方拿出陳和「妮可」在一起的照片，才能證明陳確有召妓。

陳致中神色自若表示，「檢方公布的證據，不能證明什麼事，完全是檢方的明示、暗示或影射的推論」。拿不出他與「妮可」在一起的照片，反刻意在選前公布所謂「證據」，「都只是為影響選情」。

黃睿靚還是聲明「相信致中沒有召妓」，強調「沒有人比我更了解致中的行蹤與個性」；黃睿靚並以近似向檢方「嗆聲」的語調說，「照片拿出來啊！此風不可長」。

對召妓男曾用自己手機門號，黃睿靚說：「沒想到此事會演變到這麼奇怪的地步，變得好像我在陳致中召妓案中也插一腳」。

檢方公布陳致中七月二日深夜到三日凌晨開車進出「人文首璽」地下停車場監視畫面，陳表示，檢方說他「在那個時段」有開車，「也許那時我是到車上拿東西」，且那時段車子借給友人使用，當然要開回來，「有出有進是很正常的」。

對於檢方指出，經過比對召妓男曾使用黃睿靚的手機，後打電話召妓，陳致中說，「我家手機好幾支，每支都有四、五張SIM卡，我記不得那麼多！」

黃睿靚面對媒體詢問，先再三確認「檢方有這樣指控嗎？」接著說，「這件召妓案變得太誇張了。」她強調手機偶爾會借陳致中使用，但沒辦法記得何時何日借陳致中。

承辦主任檢察官呂幸玲早在不起訴書中，針對陳致中言論加以批駁，指他為選舉造勢，博取選民同情，說政治介入司法，十分不可取。

Chen Chih-chung, the son of jailed ex-Taiwan president Chen Shui-bian, was reported to have solicited the services of a prostitute while campaigning for a city council seat. In the latest edition of the Next Magazine photographs of a hooker alighting from Chen's car in Kaohsiung were published. The magazine carried out a probe following tip-offs that the 31-year-old Chen frequently sought the services of prostitutes.

It also said it received four segments of phone recordings alleged to be of him talking with a pimp. In the early hours of July 3, its reporter spotted Chen's car – a silver Lexus SUV – in front of a bank. A tall and long-haired woman alighted from the front passenger seat and the driver, said to be Chen, drove off.

The magazine reported that the woman and Chen later met up again and had sex in a motel near his home. The woman was later identified as Nicole, a 23-year-old who works with a direct sales company and moonlights as a prostitute at night. She was reported to have a sexy figure and stands 165cm tall and weighs less than 50kg.

Nicole had apparently confirmed to the magazine that she had sex with Chen and was paid NT$5,000 for 40 minutes of 'work'. "I received a call soon after midnight and went to the meeting place to wait for my customer to pick me up. "I recognised the person as I got into the car but I dared not ask anything," she said.

Chen, however, denied the report, saying that he had lent the car to a friend since last month.His wife Huang Jui-ching also said Chen was at home at the reported time of the alleged incident.At a press conference on Thursday, Chen announced that he was going to sue the magazine and Nicole.

Chen, who is running for the Kaohsiung City Council seat, said he has no energy to visit a prostitute as the campaigning had worn him out and he had always finished work near midnight.He also asked why the magazine did not capture his photo if he was indeed driving it."I know the media are watching me at this period of time, and I would be crazy to do such a thing," he said.He also challenged the magazine to bring out more evidence.​

The son of Taiwan's jailed president Chen Shui-bian has lost a lawsuit against a magazine over his prostitutes soliciting report. In July, the Next magazine published an article of Chen Chih-chung, 31, alleging that he frequently sought the services of prostitutes. Chen filed a lawsuit against the magazine and demanded NT$2mil in damages and a public apologyt.

On Wednesday, the Kaohsiung court threw out Chen's case, as the magazine managed to provide proof - four phone recordings - to its report. A judge found that the telephone records of Chen, which included information of where the calls were made, matched the location where he met a prostitute, named Nicole, as claimed by the magazine.

Cross-referencing both Chen and the Nicole's cellphone records, the pair were in the same location when they spoke on the phone and received text messages. Chen, who is running for the Greater Kaohsiung city council seat, was ordered to pay the weekly legal costs. Court official Lin Shu-hui said Chen had placed four calls using his number to Nicole's cellphone.

After the ruling, Chen claimed it was the latest in a long line of attacks against the former first family. "I trust Chih-chung that he did not solicit any prostitutes and that it was impossible for him to engage in any behaviour like that," said his wife Huang Jui-ching.

The ruling comes five days after the Supreme Court sentenced both his parents, Chen Shui-bian and wife Wu Shu-jen , to at least 11 years in prison for accepting hundreds of millions of Taiwan dollars in bribes. The two are still awaiting appeals on three other cases for an additional bribery charge, money laundering and embezzling secret diplomatic funds.
