An illegal immigrant convicted of killing a young California couple in a horrific, drunken car crash could be back on the streets this summer after serving a mere fraction of his sentence, leaving the victims’ kin livid.

“It’s disgusting,” Anatoly Varfolomeev, the father of 19-year-old Anya Varfolomeev, who was burned alive with her boyfriend Nicholay Osokin inside their car in the fatal November 2021 wreck in Orange County, told Fox News.

“You have two young, unbelievable future, productive American citizens killed for nothing and that illegal immigrant who already has been deported twice is going to be released again?” the furious father told the outlet. “For what? If even he is deported, he will come back.”

Now, he is eligible to be released in just three months.

With that date fast approaching, Bilal Essayli, the US attorney for the Central District of California, said Wednesday that he would step in to try to keep the convicted migrant locked up for years.

“My office has filed a felony immigration charge against this defendant,” Essayli posted on X. “He faces up to 20 years in federal prison if convicted for 8 USC 1326,” the federal statute charging deported illegal migrants who reenter the US.

Ortega-Anguiano has been in trouble for years.

In 2022, he was convicted of two counts of gross vehicular manslaughter while intoxicated and sentenced to 10 years in prison – with a pending US Immigration and Customs Enforcement detainer hanging over his head.

California corrections records show that he is being held at the California Medical Facility in Vacaville but is eligible for parole in July, meaning he will have served only about a third of his sentence.

Ortega-Anguiano was deported from the US in 2016, but crossed back into the country illegally in February 2018 near Otay Mesa, California, by presenting phony documents – but was booted again four months later, an ICE spokesperson said.

He crossed the border again at some point – and was behind the wheel of the speeding car when he killed Varvolomeev and Osokin.

Illegal immigrant deported 4 times accused of deadly DUI crash


Fox News' Alicia Acuna reports the latest on the case.

An illegal immigrant in Colorado who has been deported multiple times and is now facing charges after allegedly killing a mother and her son in a car crash that police say involved alcohol has had his bond set at $250,000 cash only.

Jose Guadalupe Menjivar-Alas appeared in court virtually from the Broomfield County Jail on Thursday as a judge, in setting the amount, cited community safety concerns and doubts about his ability to appear for future court dates.

"Just even the possibility that Mr. Menijvar would be deported if he posts bond is very concerning," the judge said at one point during the hearing.

Menjivar-Alas has been convicted of DWI multiple times prior to his arrest last month.

The Broomfield Police Department detained the 37-year-old on December 15 in connection with a fatal crash three days beforehand on Main Street and Miramonte Boulevard.

Menjivar-Alas was driving a Toyota Tundra that crashed into a Mazda CX-5 driven by 47-year-old Melissa Powell. Powell’s 16-year-old son, Riordan, was also in the Mazda, and they were both killed in the crash.

An investigation into the crash led detectives to believe that alcohol and speed contributed to the crash.

Menjivar-Alas was transported to a local hospital after the crash, and once released, he was booked into the Broomfield County Jail and charged with DUI, vehicular homicide from reckless driving and vehicular homicide caused by DUI and was designated a habitual traffic offender.

U.S. Immigrations and Customs Enforcement (ICE) told Fox News Digital Menjivar-Alas, a citizen of El Salvador, has been deported from the U.S. four times.

"ICE records show that the subject has been previously removed and has no regard for immigration law," an ICE spokesman said.

Menjivar-Alas was first convicted of DWI on August 4, 2007, and received subsequent convictions for the same offense on December 7, 2016, and May 7, 2019. He was also convicted of driving with alcohol on September 16, 2007.

An immigration judge issued Menjivar-Alas’ first order of removal on April 14, 2009.

He was then removed from the U.S. in June 2009, June 2013, November 2014 and January 2015.

Despite being deported, Menjivar-Alas continued to make his way back into the country.

Two young college students were killed by a drunk undocumented migrant who drove into them then fled the scene, police say.

Ohio University junior Katie Braham, 20, and her friend Chloe Polzin, 21, died after the Honda Civic they were traveling in was struck behind by another vehicle at full force from behind in Urbana, Illinois.

Police say 29-year-old Julio Cucul Bol, from Guatemala, had consumed alcohol before the crash and fled the scene on foot after fatally striking Braham and Polzin on January 19.

Three other women survived the crash.

'They were at a stoplight and there was someone who was driving drunk who hit them from behind at full force. And following the accident, he fled on foot," said Katie's father Joe Abraham told Fox 32.

Cucul Bol was arrested on a bus in Texas as he headed towards the US-Mexico border just days after the crash, US Marshals said.

Braham's parents say they are speaking out because they believe the US needs to better monitor who enters the country.

President Donald Trump has begun raids to round up criminal migrants in the US illegally so they can be deported.

'I don't want to get too political because that's not going to bring Katie back, but certainly, I would like to see more vetting,' her father Joe said.

Polzin was a student at the University of St. Andrews in Scotland, where she was playing water polo.

She and Braham became best friends in high school.

They were using a break from college to visit friends at the University of Illinois at Urbana-Champaign.

Over the weekend President Trump issued new orders as part of his plan to ramp up massive deportations of illegal migrants - a daily quota of arrests for border officials.

In a Saturday phone call with U.S. Immigration and Customs Enforcement officials, Trump staff said the president was unhappy with the number of arrests so far.

He wants it ramped up from a few hundred a day to 1,200 to 1,500 per day, the Washington Post reported.

ICE officials were told that each field office should make 75 arrests per day and managers would be held accountable when that number isn't reached.

The news of the quota requirement has sparked criticism from those concerned officials will partake in more indiscriminate arrests, or face charges of civil rights violations as they try to meet their numbers.

This devastating incident, reportedly caused by an illegal immigrant driver under the influence, has sparked a wave of grief and anger.

Jackie Cruz Acencio, the grieving mother of 8-year-old Arya Cruz Acencio, is speaking out against the circumstances that led to this tragic event. She expressed her anguish, stating that the driver responsible should never have been in the country, as her family faces the aftermath of this preventable catastrophe.

“I have deep compassion for those seeking a better life,” Jackie shared in an exclusive interview with Fox News’ Matt Finn. “However, I have no sympathy for the driver who hit my family. I’m filled with anger because he shouldn’t have been here in the first place.”

The accident claimed the life of young Arya and left her father, Oscar Cruz Acencio, severely injured. As he clings to life, having already lost a leg, the family’s future hangs in the balance.
The accused driver, Bryan Josue Alva-Rodriguez, a 25-year-old citizen of Guatemala, has been arraigned while recovering from injuries in the hospital. He faces serious charges including murder, vehicular manslaughter, and driving under the influence.

The San Diego office of U.S. Immigration and Customs Enforcement (ICE) commented on the incident, emphasizing the preventable nature of the tragedy. “An innocent life has been lost in a tragedy that could have been prevented,” they stated on social media platform X.

Alva-Rodriguez illegally entered the United States on Feb. 8, 2018, and was arrested by U.S. Border Patrol agents in Calexico, Calif. He was issued a notice to appear before an immigration judge and released, ICE said.

While in immigration proceedings, he was charged with two DUIs on Sept. 6, 2020, and April 7, 2021, according to the agency. On March 16, 2023, an immigration judge ordered him deported. However, Alva-Rodriguez failed to leave the U.S. as ordered, authorities said.

The Cruz Acencio family was on their way home from a Thanksgiving visit when the suspect, who was allegedly intoxicated, allegedly hit their vehicle. The suspect allegedly crossed a double yellow line and crashed into the family’s car head-on.

“We didn’t deserve it, and nobody does,” Jackie told Finn.

Her husband, Oscar, is still recovering not only from the leg amputation, but also a traumatic brain injury that he suffered during the crash. He is being treated at a Navy hospital in San Diego.

Jackie recalled that she saw her daughter wasn’t breathing when the crash happened, describing that it looked like the little girl was sleeping.

“At that moment, I wasn’t thinking like, ‘oh, she’s dead.’ I just kind of didn’t think about it,” she said. Reality hit Jackie when she was told that her daughter did not survive the crash. She said that she is sad and angry and is still processing the loss.

The tragic accident comes amid a nationwide debate about the issuing of commercial drivers licenses (CDLs) to illegal immigrant truckers.

The Department of Transportation has clashed with California Gov. Gavin Newsom in recent months, claiming that the state illegally issued non-domiciled CDLs. The department claimed that several migrants held CDLs that expired after the end of their work permits. California has until Jan. 5 to revoke illegally issued licenses.

More than 150 mourners gathered Saturday to remember a New Jersey mother and her 11-year-old daughter who were killed in a head-on crash with an allegedly drunk, illegal immigrant driver, the New York Post reported.


Loved ones of Maria Pleitez, 42, and Dayanara Cortes filled the Lakewood Funeral Home in Howell, where a somber wake was held, the New York Post reported. Many wore custom shirts bearing the pair’s smiling faces.

According to the Post, one inconsolable mourner leaned over Pleitez’s open casket, crying out “¿Por qué?” — “Why?” — as sobs echoed through the chapel.


Pleitez had been driving her daughter and a friend to get milkshakes just after 11 p.m. on July 26 when 43-year-old Raul Luna-Perez allegedly slammed into her Nissan Sentra. Luna-Perez, a Mexican national reportedly in the U.S. illegally, has been charged with two counts of vehicular homicide and assault by auto. Additional charges are pending toxicology results. He had previously been arrested twice this spring for DUI in Red Bank, N.J.


“It hurts so much because this man should not have been on the road,” said Maria del Carmen Pleitez, the victim’s niece, the New York Post reported. “She was the head of our family — strong, kind, hardworking.”


Pleitez immigrated from El Salvador 24 years ago and worked in a local promotional goods warehouse, according to the New York Post. Her 16-year-old daughter, who stayed home the night of the crash, is devastated.


“We wake up thinking it’s not real,” her niece said. “It still doesn’t feel real.”

Unrelated? These murderous scumbags are the very people that ICE is hunting down. Will a few "innocent" people be caught up in ICE operations? Of course they will but it would help if they kept well away while ICE is doing their job.

I sincerely hope ICE shoots more of these scumbags but best to aim at their kneecaps so they don't earn the title of "martyr".

'My own government attempted to execute me,' Chicago woman shot by Border Patrol testifies​

CHICAGO (WLS) -- Marimar Martinez detailed her encounter with Border Patrol agents on Capitol Hill on Tuesday, saying her living testimony is evidence of a pattern of lies told by the federal government.

"Evidence from these operations, including statements made under oath, reveals a pattern of misleading the public," Martinez said.

Martinez said she believes that she survived her encounter with Border Patrol agents so she could share her story.

"I struggle with the memories of the day, the initial swerving into me by Agent Exum, the shots ringing out and the burning sensation as the bullets ripped through my skin and body," Martinez said.

CBP agents shot the Chicago woman and U.S. citizen five times last October after her vehicle was involved in a collision with an SUV with Supervisory Border Patrol Agent Charles Exum.

The federal government charged Marimar with ramming border patrol agents.

Those charges were later dropped. Marimar was one of many, calling the administration's narratives into question on Tuesday.

"I know that being a survivor, it's my duty to be here today to let you elected officials know what is happening on the streets of our country because silence is no longer an option," Martinez said.

Martinez is asking a federal judge to allow the release of evidence in her case in light of the federal government continuing to label her as a "domestic terrorist."

"As a 30-year-old USA citizen with no criminal history, I believed that I had nothing to worry about, but I was concerned for my friends and neighbors," Martinez testified, recalling the Saturday that she saw CBP agents in downtown Chicago. "For the next 15 to 20 minutes, I followed these Border Patrol agents through my neighborhood, honking my horn, shouting out, 'La Migra,'" which in Spanish means immigration officers.

Martinez followed the agents for several blocks before the vehicles collided, resulting in minor dents and scrapes on both vehicles.

According to testimony and documents from Martinez's now-dropped assault case, she stopped her vehicle directly after the collision and the agents' SUV came to a halt just ahead of Martinez. She then accelerated away, testifying in court that she swerved left to avoid hitting the agents, who were exiting their vehicle.

That's when the agents opened fire, ultimately striking Martinez five times in the arm, chest and both legs. Only one of the three agents had a body camera activated at the time.

While the body camera footage hasn't been released publicly, lawyers for Martinez have said in court that it shows an officer shouting "do something b--."

The agent who shot her allegedly said in a group text to friends: "I fired 5 rounds and she had 7 holes. Put that in your book, boys."

"The physical scars will always be there in the mornings and evenings, when I get dressed and I stare at my body, now permanently disfigured by the five lead bullets," Martinez said. "They will be there this summer when I head to the beach with my dogs and family. They will be there when I get down on the floor with my students."

She continued, "Perhaps even worse, the mental scars will always be there as a reminder of the time my own government attempted to execute me, and when they failed, they chose to vilify me."

Marimar was joined by other survivors and Renee Good's family in condemning the fed's use of force by the Department of Homeland Security on Tuesday.

Illinois Democratic leaders were present, calling for sweeping reforms and accountability.

"That's why we made it clear that this negotiation to change the standards for ICE is critical for us to continue this agency," said Sen. Dick Durbin.

Tuesday's testimony comes after ABC News learned at least eight more federal prosecutors resigned in Minnesota after the deadly shootings of Good and Alex Pretti by federal immigration agents.

Disabled, autistic woman details alleged abuse by ICE, centers Black communities historically abused by police​

Aliya Rahman says DHS officers violently arrested her and ignored her pleas for medical attention despite repeatedly saying she was disabled.

A disabled, autistic woman, whose ICE arrest in Minneapolis was caught on camera, testified before Congress, detailing the harrowing abuse and trauma she said she endured while in federal custody.

On Tuesday, Democrats in both the U.S. House of Representatives and Senate held a joint forum receiving testimony on the “violent tactics and disproportionate use of force” by agents of the Department of Homeland Security (DHS).

Aliya Rahman, who is a U.S. citizen and Bangladeshi-American, shared her story. On Jan. 13, Rahman was driving to an appointment at a medical clinic to treat her traumatic brain injury. However, she encountered a traffic jam due to ICE vehicles blocking the road. When she rolled down her window, an agent yelled at her, “I will break your effing window.”

“Agents on all sides of my vehicle yelled conflicting threats and instructions that I could not process while watching for pedestrians. Then the glass of the passenger side window flew across my face. I yelled, ‘I’m disabled’ at the hands grabbing at me, and an agent said, ‘Too late,'” recalled Rahman, a software engineering manager.

She told Democrats at the Tuesday congressional hearing that after ICE agents cut her out of her seatbelt with a “large combat knife” that she thought would be used on her, she felt a “shooting pain” in her head, neck, and wrists before hitting the ground face-first with officers leaning on her back.

“I thought of Mr. George Floyd, who was killed four blocks away,” said Rahman. “I was carried face down through the street by my cuffed arms and legs while yelling that I had a brain injury and was disabled. I now cannot lift my arms normally.”

As she was taken into custody, Rahman said she was never asked for her ID, was never told she was under arrest, was never read her rights, and was never charged with a crime. She was taken to the Whipple Federal Building, a temporary detention center, where she recalled witnessing “Black and brown bodies shackled together.”

Rahman said she received no medical screening and was denied a phone call or access to an attorney. She also claimed she was denied a communication navigator when her speech began to slur, and said federal agents laughed at her when she tried to regain mobility and asked for her cane. After an hour of pleading for medical attention, Rahman said she blacked out.

Despite what she endured, Rahman said, “I do not deserve more humane treatment than anyone else, U.S. citizen or not.” She instead centered those who weren’t able to tell their stories of abuse.

“I am here today with a strong spirit and a duty to the many people who haven’t had the privilege to tell their stories or see their loved ones come home. I am extremely distressed by the pattern that violence from law enforcement has been happening to Black and indigenous communities for centuries and to DHS survivors for over 20 years,” said Rahman.

“We call ourselves a civilized nation, but we lack rules and accountability around what a person claiming to be law enforcement is permitted to do to another human being.”

She added, “I am not afraid, and I’m not afraid to keep working on this problem even after ICE is gone.”

The national outrage over the Trump administration’s immigration enforcement in Minneapolis and across the country has reached a breaking point following cascading events, including the fatal ICE shootings of Renee Good and Alex Pretti, both U.S. citizens, and the detainment of children, most notably 5-year-old Liam Ramos in Minneapolis.

Others who testified before Congressional Democrats included Marimar Martinez, a U.S. citizen and first-generation Mexican-American, who was shot five times by ICE in Chicago on Oct. 4, 2025, and Luke and Brent Ganger, the brothers of Renee Good.

On Wednesday, President Trump’s border czar, Tom Homan, announced that 700 federal officers would be pulled out of Minnesota and that the federal government was coordinating with state and local officials to eventually end its large-scale ICE operations in the Twin Cities. However, advocates say simply pulling out leaves little accountability. Meanwhile, Democrats in Congress are demanding a range of reforms for ICE and DHS officers. Some are even calling for DHS Secretary Kristi Noem to be impeached or fired for her role in leading the agency.
