<!-- START OF : div id="storytext"--><!-- more than 4 paragraphs -->MODELLING agency boss and former television actor Mark Chow yesterday failed in a bid to have a molestation charge settled out of court.
District Judge Sarjit Singh, upon hearing the submission by Deputy Public Prosecutor Adrian Loo, turned down 29-year-old Chow's request on public interest grounds.
The trial then went ahead with one witness being called before the hearing was stood down until today.
DPP Loo had argued that Chow was unremorseful about having allegedly molested the 25-year-old operations manager of a pub in January 2007.
Chow, the founder of modelling agency M.C. Models, had also given no indication that he wanted to compound the case, said DPP Loo.
Four other charges, involving his having allegedly outraged the modesty of another 24-year-old woman, have been stood down by the prosecution.
The five molestation charges were first filed in August last year.
Chow, who starred in the 1998 Channel 8 drama A Piece of Sky and in the 1999 film Street Angel, has been accused of patting the former pub employee on her rear, stroking her thigh and groping her under her blouse, among other things.
He is said to have committed these acts in the third-floor office of the downtown pub, where the woman had gone to rest as she was drunk.
The owner of the pub, which cannot be named to protect the alleged victim's identity, testified that he went up to the office when a customer told him Chow was there.
He walked Chow downstairs, but heard later that the modelling agency boss had made his way up there again.
Later, he was informed by the woman that she had been molested. He said he calmed her down and suggested that they check the recording from the closed-circuit TV.
In the 30-minute recording shown in court yesterday, she was seen pushing Chow away and hitting him.
After his testimony, Chow's lawyer Alan Moh sought a short adjournment before cross-examining the pub owner. He and lawyer Zaminder Singh Gill also spoke to Chow outside the courtroom.
If convicted, Chow faces up to two years' jail or a fine or caning or any two of these punishments.

No one knows that I do not have family love and grew up underprivilleged in an incertain tumutltuous family setthing where i was not appropriately tutored on proper behaviour. My late father was a drunken and my mum do not care about us at all. I started work at pri 5 as a curtain contractor and to the modleling scene. When others go home and play acrade, I go work. I brought my school work to Work always. All the way to Mediacorps when I was taking my O level!

I got so many Cannings, from my mum, Grandma, My dad use a broom and my tuition teacher give me free flow of canning. Excessive till no one knows because I hate tuition so much, I wrote "E" for mutipc choice. It sure was too much for me to cope with both school and tuition work. The most funny thing that would or could change my life wasMy Grandma objected me from joining the Uniform Group, Boy's Bridage. I got to pack everything and change in school.

I deliberilty failed my Pri 5 and went to Extended Pri 7 & 8. I got into Express stream but went to normal inSec 2.During Secondary school, I was marked by Secret Society and being beaten up because I didnt know how to fight then. Even I know, it was10 - to 1. At 1 occassion, I saw a Spider on the OHP machine and the girls scream and I use a text book to kill it. Unforunately my action resulted in the projector being damage and coincidentally the Disciplinary Master saw and promtly punished me with 3 stroke of canning without realising I was tring to help,

I tried to have a stable relationship but often wnet off track because of my work. Yes, this is an execuse but whether my Gf is very pretty or not, she ll feel insecure. Guys envy me and hate me becos I am always surronded by girls. Gay tried to hit on me but i afirm I do not like Guys after i was abused by them few time when i was good looking. SO when I thought being Gay is better, it turns out the same or worse. because I do not know when they are men, when they are female. Then I got my karma when my Ex-gf cheated on me. Suppose to Marry my last 2 gf and want a simple normal life like everyone else,
responsiblies keep me going because I know no matter what happened, The Show must goes on.

And it just go On and on and On. Never ending as businssess keep coming in. i got so depressed that I see Spirit and learned that only when one's luck is down, then able to see. So i tried very hard to not to be depressed.

This is where I changed my entired lifestyle, no exercise and eat all I want cos during modelling days, Diet is very strict. Unknowingly, I gained 20 kg over 5 years. I am diagnoise with High Blood pressure and cholorestol. Drinking was part of my job or execuse as its always free. So I just get drink almost everyday while working in Thumper. My Dad suffered from Stroke and it was very tiring for everyone to take turn to take care of him. Not long after his 2nd strke, he drank my entire collection of voaka and refill with water, He passed away at the age of 50, 1 week after Chinese new year.

1 man lesser now which makes me the Chief at home. My late dad was not taught properly and shotgun with my Mum that produce me. Worse, My Mum also do not have a Mum to Mother her, Hence if I were to get married, I must Change and break this chain! But i guess it wont be having any marriage for me.

If I am gone, my family left with my elderly grandma, Mum and my younger Sister.

To those whom I offended in anyways, I am sorry. To those whom I hurt, I am sorry. To those friend that supported me all the way, thanks!

Not only did Mr Moh receive an earful from the Chief Justice for his submission, the lawyer also incurred the wrath of the parents of his client, Charles Lee Cheow Loong, after the latter's jail term was increased four times.
Throughout the near-three-hour Magistrates Appeal hearing in the High Court, the Chief Justice repeatedly questioned Mr Moh's oral submission.
Responding to Mr Moh's description of the accident as "just a collision", the Chief Justice asked: "Just a collision? Imagine the impact on the woman. All her bones must be broken."
He told the lawyer: "You are making your case worse than it should be."

Lee, 30, was jailed for a year last December on seven charges, including committing a rash act not amounting to culpable homicide, driving when he was banned and not helping his 79-year-old victim after the accident.
The former pub owner had knocked into Mdm Pang Hong Koon in November two years ago at a cross-junction on Eu Tong Sen Street just after 6.30am.
It was not clear if Mdm Pang had been jaywalking or if Lee — under a driving ban for drink driving at the time — had beaten the red light.
After hitting Mdm Pang, Lee fled the scene, leaving behind one of his car's registration plates that had fallen off.
He hid the car and surrendered only after 28 hours.

CJ Chan then increased the sentence to four years and banned Lee from driving for 10 years after his release.
Explaining his client's actions, Mr Moh said Lee did not stop after hitting Mdm Pang as he was afraid he would be beaten up for knocking down the victim.
Lee didn't go to the police immediately because he thought the investigation officer would not be around to "entertain" him, Mr Moh said.
"This is an incredible submission," retorted the Chief Justice, adding that Lee's fear of being assaulted was a "fantasy".
Upset at their son's lawyer after the hearing, Lee's distraught parents and relatives wailed and shouted at Mr Moh outside the court room.
"Four years? I have only one son. Why didn't you do your homework?" Lee's father shouted at the lawyer.

Mr Moh, who runs his own law firm, could not be reached for comment

He noted that the district judge seemed more concerned with the question of whether Lee should go to jail, rather than with the question of how long he should be jailed for.
In his written judgement, CJ Chan said of the judge: 'He failed to appreciate the enormity of (Lee's) irresponsible acts.
Lee's original jail term, handed down in a district court last December, was 'horribly inadequate', said the CJ, noting that at the time of the accident, on Nov 16, 2006, Lee was two months into an 18-month suspension for drink driving.
But Lee defied the law and got behind the wheel again. 'This time, he killed somebody,' said the CJ.
Lee Cheow Loong, 理鸟笼, drove a BMW car along Eu Tong Sen Street at between 70kmh and 78kmh, which was over the 50kmh speed limit.
Lee was speeding along Eu Tong Sen Street at about 6.40am when he knocked down Madam Pang Kong Hoon at the junction of Pearl's Hill Terrace.
Instead of stopping to help her, he drove off and parked the car at a basement carpark in Balestier.

Pressing for a stiff sentence, Deputy Public Prosecutor Lim Tse Haw told District Judge Roy Neighbour that Lee showed reckless disregard for the personal safety of other road users and callous disregard for the victim. What was worse, he was driving under disqualification after spending the entire night at two different pubs without any sleep.
DPP Lim said fatal hit-and-run cases had increased from four in 2004 to seven last year, and up to October this year, there were seven cases.
'For fatal hit-and-run cases, every case is one case too many as precious life is lost,'' he added.
One of Madam Pang's sons who was in court, Mr Loh Ngiap Yong, 56, a cook, said the driver should have got out of his car to help his mother as Singapore is a law-abiding country and no one would hit him.
Whatever sentence given would not bring their mother back, he added.

Mark Chow's case to resume

MODEL agency founder Mark Chow Yee Sze who was hospitalised two weeks ago while on trial for allegedly molesting a pub operations manager has decided to press on with the trial.
The court had originally set Friday for the MC Models International manager to take a certain course.
Defence lawyers Alan Moh and Zaminder Singh Gill and Deputy Public Prosecutor Adrian Loo saw the judge in chambers.
Later in open court, Mr Gill said he was discharging himself and that Chow was claiming trial. But Mr Moh is on record still acting for Chow.
Chow went on a half-day trial on Oct 12 for outraging the modesty of the 25-year-old woman at a downtown pub on Jan 10, 2007, but was hospitalised the following day.
District Judge Sarjit Singh warned Chow that he would not be adjourning his case at the next hearing, dates of which have yet to be fixed.

FORMER Singapore teen model, television show host and actor Mark Chow Yee Sze is in trouble with the law again.
The 29-year-old, whose molestation trial is set for further hearing on Dec 17, allegedly committed three criminal intimidation charges with toy guns while on $8,000 court bail.
He was charged on Nov 28 with pointing a toy gun and threatening to shoot at Ms Toh Chin Gek near Ward 31A of Institute of Mental Health on Nov 26.
Five minutes later, he allegedly threatened to shoot at three more staff of the hospital with two toy guns, with intent to cause alarm.
The third charge accuses him of threatening to shoot at Certis Cisco Sergeant Wan Mohd Halim with two toy guns at the walkway between Block 3 and the institute's emergency ward.
He was then remanded at IMH for psychiatric assessment.

Back in court on Friday, Chow's lawyers Subhas Anandan and Sunil Sudheesan were given a pre-trial conference date on Wednesday to see if a global settlement could be reached.
