SINGAPORE: The Singapore Democratic Party (SDP) on Wednesday (Sep 13) said it has filed a lawsuit in the High Court challenging the Government’s decision not to hold a by-election in Marsiling-Yew Tee Group Representation Constituency (GRC).

It argued that it is "incumbent upon the Government" to call for a by-election, after a seat in the four-member GRC fell vacant last month when Mdm Halimah Yacob resigned as its Member of Parliament to run for President. As the only candidate to qualify for the election, she was declared President-elect on Wednesday after her nomination papers were found to be in order.

The three remaining MPs of Marsiling-Yew Tee GRC - Minister for National Development Lawrence Wong as well as Mr Ong Teng Koon and Mr Alex Yam – have said they will take turns to cover Mdm Halimah’s meet-the-people sessions in the Marsiling ward.

Mr Zaqy Mohamad, an MP from Chua Chu Kang GRC, has also been appointed as adviser to grassroots organisations in Marsiling-Yew Tee GRC.

In a statement, the SDP cited an article in the Constitution which states that whenever the seat of an MP becomes vacant for any reason other than a dissolution of Parliament, “the vacancy shall be filled by election in the manner provided by or under any law relating to Parliamentary elections for the time being in force.”

The SDP added: “It was the PAP that mandated that each GRC include at least one candidate from a predetermined minority race. But the same party is also the one who has arbitrarily decided that if that minority member resigns, there is no need to replace him or her in a by-election.”


In February, Minister in the Prime Minister’s Office Chan Chun Sing had said in Parliament that a by-election will not be called, should a minority MP leave his or her GRC.

Responding to a question by Workers’ Party MP Pritam Singh, Mr Chan said this is because it would not affect the key goals of having a GRC system, which include ensuring that there are enough minority members in the House.

Mr Chan also noted that one fewer minority MP would still mean 27 per cent of Parliament is made up of minority MPs, which is “more than what you’d expect proportionately from adding up the percentage of Malays, Indians and other minorities”.

The SDP said it has engaged lawyers from Peter Low & Choo LLC as counsel and that a pre-trial conference has been set for Oct 9.

“Even though it (PAP) won the last elections and forms the Government, it cannot and must not be allowed to do as it pleases without any check from the opposition,” said the SDP.

If the Court declares that a BE is necessary as a result of SDP commencing legal proceedings, then SDP will have effectively "choped" the seats for the BE.

If if the court agrees to a BE, SDP will lose by a landslide. Nobody in their right minds will vote for oppies. They are just too unreliable.

It does not matter if got BE or not as the Pappies will win... however bcos Pappie will win..it should be magnanimous in having the BE...as a propaganda weapon against the oppo...
 
Stop your kvetching, kunt. Confidence in the current leadership is at an all time high….no harm in being magnanimous and letting people blow off some steam
by voting...once the whities win by 80% the bad vibes going around will be assuaged.

SDP's efforts and funds will not be wasted.

Any verdict from the High Courts will work for them.

If yes, then we will see a very interesting B-E to their advantage.

If no, then the public will see the true colour of the judiciary system in Singapore.
 
There's already a precedent in the Court of Appeal ruling for the Hougang BE 2013: that the PM must call for an election to fill a vacated parliamentary seat within a reasonable time. It doesn't matter whether it's an SMC or a GRC.

The ruling clarifies Article 49 of the Constitution and limits the discretionary powers of the PM in deciding whether to call for an election.

SDP indeed has a strong case. The imperative to institutionalize minority representation via the GRC concept strengthens their case, notwithstanding Kee Chiu's specious argument.

If BE really occurred, the residents have to waste time their time to vote again? The residents have to be busy just to fulfill the power struggle of political parties.

I believe at best PAP can only argue for a BE to be held for that particular seat, and not the entire GRC.

Singapore will have to thank a cleaner and a mad lawyer if we get a BE @ Marsiling.
 
Despite the judgment, the PAP and the Government has no shame. I think the SDP realised that the Govt for the sake of salvaging Halimah took a position to focus on the EP but will hold a BE eventually. A legal prod will hasten that decision.

His leap of logic still astounds me.

It is true....we can boycott the BE & they can still win... an Indian can be Malay, anything can be anything...if the deaf, the blind, the mute, will still elect the same...day after day...

We should take things one at a time. The most important thing is not to lose faith. Even Sun Yat Sen needed 10 attempts to succeed.

PAP will truly win if the remaining 30% are broken.
 
We have an excellent track record with BE with one minor blip. That is why the PAP avoid BE like the plague. If a little girl can take down a surgeon, it tells you people will try and find an opportunity to put the dagger in.

PAP strategy has been to avoid reaching the tipping point. Make house, job, nearby hawker centres and freedom to go anyway for holidays and people will tolerate.

I believe at best PAP can only argue for a BE to be held for that particular seat, and not the entire GRC.
