Immediately following the completion of a divorce case that ended her marriage, a Roman Catholic woman tried to sue her lawyers for not warning her that a divorce would do precisely what it did: end her marriage.
Apparently, the termination of her marriage was an outcome Jane Mulcahy wished to avoid.
Although British courts rejected the lawsuit, the British woman went on to file an appeal against the dismissal.
As Lord Justice Briggs read during the appeal last month, Mulcahy believed that her lawyers “had failed to give her the advice which was requisite in view of her firmly held belief in the sanctity of marriage.”
Mulcahy argued that her lawyers should have suggested judicial separation, a course of action that is one step below a divorce. She tried suing the lawyers on accounts of professional negligence.
Ultimately, Mulcahy’s appeal was dismissed.
