SINGAPORE has no qualms about taking a tough line on serious crimes and imposing the mandatory death penalty because it believes this stand has saved thousands of lives, Law Minister K. Shanmugam said yesterday. The penalty applies to crimes such as murder, kidnapping and drug trafficking, and Mr Shanmugam believes it has had a deterrent effect and sent a clear signal to drug barons on Singapore's position. He acknowledged it was easy for death penalty opponents to focus on the plight of the individual who faced being hanged.

But the consequences of getting rid of the death penalty had to be considered: 'You save one life here, but 10 other lives will be gone. What would your choice be if you were to make that choice?' Mr Shanmugam, who is also Second Home Affairs Minister, was responding to Joo Chiat resident Jack Lin, 26, at a dialogue that capped his visit to the ward. Mr Lin had asked whether the case of Yong Vui Kong, whose lawyers argued against the mandatory death sentence, would affect the future of such a punishment.

this drama was sadly again being highlighted by SDP which exploited this and trying to again score unwarranted political points.

maybe it's harsh to pass the death penalty. then what about a life sentence? life sentence if i do not get it wrong is for duration of imprisonment up to 25 yrs. after that, the convicted people would go free.

sgp gov boasts about giving convicts a "2nd chance". so what is a 2nd chance? how do they categorise who deserve that precious "2nd chance"?

Illicit gay activities:

Penal Code Section 377A states, “Any male person who, in public or private, commits, or abets the commission of, or procures or attempts to procure the commission by any male person of, any act of gross indecency with another male person, shall be punished with imprisonment for a term which may extend to 2 years.”

Cheating:

Voluntarily causing hurt – A person causes hurt when he or she causes bodily pain, disease or infirmity to any person. Whoever does any act with the intention of causing hurt to any person, or with the knowledge that he is likely to cause hurt to any person, and does cause hurt to any person, voluntarily causes hurt. The penalty for voluntarily causing hurt is imprisonment of up to one year, or a fine of up to S$1,000, or both.

Theft of Temple Funds:

Theft is committed when a person, intending to take dishonestly any movable property out of the possession of any person without that person’s consent, moves that property in order to effect the taking. The penalty for theft is imprisonment of up to three years, or a fine, or both. It is more common, however, for offenders to be charged with committing theft in a building, tent or vessel, which is used as a human dwelling, or for the custody of property. The penalty for this more serious offense is imprisonment of up to seven years, and also a fine.

Judgement on Yong Vui Kong’s appeal this Friday

The Court of Appeal will be delivering its judgement this Friday, 14 May, on Yong Vui Kong’s appeal. The hearing will take place at 11am.

It has been two months since Yong made his appeal on 15 March. He is appealing against the death sentence which was imposed on him in 2007 when he was caught with 47g of diamorphine. He was found guilty of drug trafficking and was given the mandatory death penalty.

Originally scheduled to hang on 4 December last year, his lawyer, Mr Madasamy Ravi, persuaded the court that Yong had not had his appeal heard, as was his right under the Constitution. The court agreed and granted Yong a hearing on 15 March. In that hearing, Mr Madasamy argued that the mandatory death penalty was unconstitutional, citing many judicial decisions in other jurisdictions all over the world.

On Sunday, 9 May, Law Minister K Shanmugam defended the Singapore government’s position on the issue. According to the Straits Times, the minister “believes this stand has saved thousands of lives… The penalty applies to a crimes [sic] such as murder, kidnapping and drug trafficking, and Mr Shanmugam believes it has had a deterrent effect, and sent a clear signal to drug barons on Singapore’s position.”

why was a mandatory death sentence legislated for hardcore drug traffickers? the disastrous and harmful effect to many are horendous should drugs be smuggled into our country.

even with such harsh law, people are still tempted to take the chance. they rate the monetary reward higher than the possible risk of losing their life in the gallow.

it's a gamble drug trafficker take. for yong, he lost. the wager is his life.:(
