Magazine wins copyright case

THE publisher of a well-known horse-racing magazine has won a copyright infringement lawsuit against a company that puts out a similar publication. Pioneers & Leaders (Publishers), which has been publishing Punter's Way since 1977, took Asia Pacific Publishing, which is behind Racing Guide, to court over the way it presented racing information.

Pioneers & Leaders said it owned the copyright in the format, presentation and compilation of horse-racing information in the tables of its magazine. It claimed that many of these features were copied in Asia Pacific's Racing Guide. In a 41-page written judgment, Justice Lai Siu Chiu ruled in favour of Pioneers & Leaders. Damages will be assessed at a later hearing.

The court heard that when Punter's Way was first launched, Pioneers & Leaders set up a research and IT unit to organise horse-racing information, decide how best the tables should be presented in a reader-friendly manner, and study and compile the information.
