TT Durai to pay legal costs in NKF defamation suit against SPH
The lawyers representing Singapore Press Holdings and National Kidney Foundation met in court this morning (15 July 2005) to settle the issue of costs arising from the withdrawal of the defamation suit against SPH and The Straits Times senior writer Susan Long.
The following is a summary of developments concerning the issue of costs:
During cross-examination in court on Tuesday, 12 July 2005, T T Durai informed Justice Tan Lee Meng that Durai would be withdrawing the libel suits brought by the National Kidney Foundation and him against Singapore Press Holdings Ltd and Susan Long.
On Wednesday, 13 July 2005, SPH’s lawyers asked the court to order that:
NKF and Durai are not to start any legal action against SPH or Long over the same matter.
NKF and Durai are not to suggest that Long’s article contains anything which is untrue.
NKF funds are not to be used for legal costs, and that the costs are to be borne by Durai and/or the NKF Board members.
NKF and Durai asked for time to consider SPH’s conditions.
On 15 July 2005, NKF’s lawyers informed the Court that Durai would pay the defendants’ legal costs. The Court also ordered NKF and Durai not to start any legal action over the same matter and not to suggest that Ms Long’s article is untrue.
