Ex-ISA detainee to sue government


SINGAPORE - An ex-Internal Security Act (ISA) detainee has decided to sue the Singapore Government for damages incurred during his imprisonment from 1963 to 1974.

Michael Fernandez, who was a leftist union activist in 1963, led a month-long strike involving 11,000 workers the same year.

He was detained under the ISA the following year for undermining the security, stability and economic well-being of Singapore.


Fernandez said at a press conference in his lawyer's office yesterday that he wanted younger Singaporeans to be aware of the experiences that the detainees went through.

In the writ of summons his lawyer M. Ravi is filing with the High Court today, he claims to have suffered pain, suffering, humiliation and loss of reputation from the period of incarceration.

In the writ, he also claimed he was manhandled by guards, deprived of sleep and force-fed with tubes down his throat while being shackled to a chair. It also alleged that his cell condition was not humanely habitable, with blood stains and pest infestations.

He also claimed he was denied medical help despite physical injuries sustained during his incarceration.

As a result, Fernandez claims to suffer from sleep disorders, hallucinations of being strangled or choked to death and lumps on his stomach - due to mistreatment by the prison authorities.

The writ names the Attorney-General (AG) as the defendant in his case.

The AG's chambers has eight days from the writ's submission to respond.

Who is Michael Fernandez?

Michael Fernandez, 77, was a former trade unionist and alleged member of the Communist United Front in the 1960s.

He joined the Naval Base Labour Union as its acting secretary-general in 1963. In that same year, he led a strike which involved 11,000 workers over issues like overtime, annual leave and pay.

Later, he became the paid secretary of the Singapore Commercial House and Factory Employees' Union, and adviser to the Singapore European Employees' Union.

He was detained under the Internal Security Act in 1964. The Government accused him of being a member of the Communist United Front, which was a part of the underground Communist Party of Malaya - an organisation which used terror and violence to subvert the democratic process and overthrow the elected governments of Singapore and Malaysia.

Fernandez maintains that he merely had socialist leanings and was helping to champion workers' rights.

He has been working in insurance and education consultancy since his release. He is married with four grown children.

He should sue the one who signed the detention order. In this case it is most likely to be none other than LKY!

The ISA is just a lazy way by LKY to deal with those activists that spoils his day.
I hope after Ah Lee Baba is gone will the gov.sg then come clean and admit they handled things wrongly and that it was a honest mistake. If they do this PAP would have really come of age.

Well said HTOLAS, In 1959, Singapore became independent from British Rule and in 1963, Singapore became part of Malaysia and in 1965 was kicked out of Malaysia (though the PAP says Singapore 'broke away from Malaysia'.)

Yes, Mr Fernandez as held way after 1965 (separation from Malaysia), so the PM at that time or during that period was LKY, who is undoubtedly responsible for Mr Fernandez's dentention without trial.

LKY or no one can push the blame to the British or Malaysian governments. LKY is undoubtedly accountable for Mr Fernandez's dentention without trial.

Just my two cents.

The ISA was used by LKY not as a 'lazy way' but it was a very well-planned attack on his rivals or opponents. The ISA was his ace card, and he used it whenever he needed to get rid of his opponents, but again always cleverly saying that the ISA was not from his making but it was left by the British, and hence inherited it, so implying that 'don't blame him from using it'.

The truth is, he as a PM should be accountable for all his actions.
