A residence belonging to Huang Youlong, husband of mainland actress Zhao Wei, has reportedly been sold by the couple's driver.

The driver allegedly posed as Huang, a businessman in the finance and catering industry, and duped a public notary's facial recognition system into registering him as the man.

As a result, Huang now faces a court case brought by the buyer of the property, after the couple refused to vacate the premises, the People's Court Daily reported yesterday.

Zhao's fame on the mainland has been likened by that of leading Hollywood actresses such as Drew Barrymore.

The case was filed in a court in Beijing's Chaoyang district.

According to the newspaper, Huang's driver, posing as his employer, managed to pass the check by a facial recognition system at the local notary office before securing a legal document required for property deals.

The driver then entrusted the sale of the apartment to another person, the paper said.

A real estate lawyer said the story was "unbelievable" as complex legal procedures prevent fraud during the sale of a property, including verifications of one's identity and signature.

"You have to have all the steps fail, and all the people blind, to make this happen," said the lawyer, who requested anonymity.

Huang did not realise his property had been sold until the buyer came to demand that the couple vacate the apartment. The case will be heard tomorrow.

The facial recognition system used by Beijing’s public notaries is under scrutiny after a driver working for mainland actress Zhao Wei and her husband allegedly duped the technology and sold a residence belonging to the couple.

The driver allegedly posed as Zhao’s husband, Huang Youlong, and managed to pass the identity check used at the local notary office.

He then used the legal document from the notary to entrust the sale of Huang’s apartment to another person.

The apartment was sold last August for 15.2 million yuan (HK$18.5 million).

Huang, who works in finance and catering, was recently sued by the buyer of the home after the couple refused to vacate the premises.

A court in Beijing’s Chaoyang district heard the case yesterday. But the proceedings were suspended soon after they began.

The court said it would wait until another case Huang initiated against his driver was decided. The outcome of that case would directly affect the second case, it said.

The court cast doubt on the accuracy of the facial recognition system used at the notary’s office. It said the use of the technology by notaries was “without merit” and the standard for a successful recognition “was too low”.

The systems operate by comparing a picture of the subject taken in the notary’s office with the photograph used on the person’s identification card. It then gives a score for how closely they match.

In Huang’s case, the system gave a score of at least 0.6, which was considered acceptable by the notary’s office.

“We have seen an increasing number of cases involving people posing as someone else to get notarial certificates. And many of them are involved in property sales … We believe notary offices should fulfil their duty of examination in these cases,” the court said after the proceedings were halted.

The court urged the Beijing Municipal Bureau of Justice to issue more specific guidelines on identity examination and re-evaluate the accuracy of facial recognition systems and other technologies it has approved for notary work.

A notary officer in Beijing, who refused to give her name, said the system was introduced last year, and was widely available across the city.

“The system is definitely not the only tool to help us examine one’s identity,” she said.

“In the first place, a notary must judge the person with his naked eyes. For property deals, we also require applicants to show their identification cards, property ownership certificate … as well as marriage certificate. He would not be able get the certificate without any of them,” she said.
