今天(10月23日)一早,一则“外籍乘客拉下高铁紧急制动阀未被处理”的话题很快冲上了热搜。
网传的两段视频显示,一名外国乘客疑似拉下停靠在长沙南站的高铁紧急制动阀,但未受到处理,涉事外国人表情轻浮,对周围人形成“挑衅”姿态。有国内乘客当场怒斥乘务员处理不力,一张“你不尊重中国人”的视频截图广为流传,引发舆论质疑。

舆情持续发酵后,长沙铁路公安很快给出了回应,称事发21日晚上海虹桥开往广州南的G1305次列车上,并称已开始调查,将依法进行处理。23日中午,长沙铁路上级单位@广州铁路 发布微博对事件进行了说明,称系“一名外国乘客误碰15号车门手动按钮,导致车门鸣响关闭”,并非网传的外国乘客拉下高铁紧急制动阀。

社交媒体时代,新闻出现反转并不奇怪,但如此短时间内巨大反转,还是让很多情绪激昂的网友惊愕。有网友就调侃说,“我喷都喷完了,你才给我看这个?”
事实上,如果仔细观看最早在网上流传的两段视频会发现,视频只有国内乘客对乘务员“你不尊重中国人”、“有多远滚多远”的怒斥,没有“表情轻浮”外国乘客的辩解(也可以理解为语言障碍),也没有乘务员整个的沟通处置过程。换言之,这是一段缺少核心事实、没有头只有尾的视频,根本无法得出“外国乘客拉下高铁紧急制动阀”的结论。
但就是这么两段模糊的视频,经网络传播后掀起轩然大波,最后演变为对铁路官方处置不满的集体讨伐。是因为有人恶意造谣传谣,还是因为误会导致的误传,现在还不知道。但值得反思的是,近两年面对公共部门处理外籍人员时的差别态度,网上确实民愤很大。这也是谣言很快能被更多人采信和传播的情绪基础,其准确击中了大众的公平焦虑。
远的不说,近一点的“福州一高校留学生当街推搡交警”以及“南京地铁罚中国人不罚外国人”事件,都是因为对中国人和外国人区别执法引发巨大争议,最后在舆论的介入下才加重处罚或表示反思。

而在广州铁路的说明发布前,有网友找出了多条中国乘客按下紧急制动阀被处罚的案例,更是有意在引导舆论往这方面靠——
2019年7月13日,上海人李某上错高铁后拉下G7325次列车紧急制动阀,导致晚点五分钟,被罚款一千元;
2017年10月3日,旅客蔡某在湖北建始火车站拉下D2217次列车紧急制动阀,被襄阳铁路警方罚款500元。
上述两位中国乘客遭受的处罚,依据的是2014年起施行的《铁路安全管理条例》,其第77条规定了16项“禁止实施下列危害铁路安全的行为”,其中就包括“擅自移动铁路线路上的机车车辆,或者擅自开启列车车门、违规操纵列车紧急制动设备”。
如果这次真的只是“误碰车门手动按钮”,要不要受到处理?事发时的监控视频显示,该外国乘客在列车停靠时在车门口拿手机拍摄,并非有意触碰车门手动按钮,且该行为并未影响列车的运行,列车“正点开出长沙南站”。如果由此认定要处罚当事外国乘客,于法于情都说不通。

尽管被证明是“虚惊一场”,这场舆论风波也提醒相关执法部门,在处理外国人违反治安案件问题上,一定要秉持公平公正的原则,不留下执法上内外有别的话柄。
但另一方面,我们也要考虑到,处理外国人的治安管理案件,棘手的地方在于它存在着权限问题,在取证、确定处罚方式、执行等方面也存在着现实困难。涉及到权限,就会引出一系列的层级汇报机制,派出所如果不具备这个权限,就得层层请示,而指令结果下来又得再重复一遍。别说基层警员犯难,高铁乘警恐怕更吃不消。
