A group of militiamen on Saturday occupied the headquarters of a national wildlife refuge in Oregon in support of two brothers who are slated to report to prison on Monday on arson charges - and the protesters don't plan on leaving any time soon, saying it's 'kill or be killed' time.

Militia members claimed to have as many as 150 supporters with them at the Malheur National Wildlife refuge building in Princeton, which is federal property managed by the US Fish and Wildlife Service that was closed for the holiday weekend.

They later rescinded the number and said they would not disclose how many people were in the building, because of 'operational security'. Local reporters have said that there only appears to be a dozen cars outside of the building.

'We're planning on staying here for years, absolutely,' Ammon Bundy, one of the occupiers, told the Oregonian*via telephone. ‘This is not a decision we've made at the last minute.'*

Ammon Bundy and his brother Ryan, who is another occupier, are the sons of of Nevada rancher Cliven Bundy, who was involved in a 2014 standoff with the government over grazing rights.

The occupation came shortly after 300 marchers paraded through Burns, Oregon, about 50 miles away, to protest at the prosecution of father and son Harney County ranchers Dwight Hammond Jr and Steven Hammond, who were ordered returned to prison by a federal court which ruled their original sentences were insufficient.

The group is demanding that the Hammonds be released and that the federal government give up control of the Malheur National Forest.*

Dwight Hammond, 73, and Steven Hammond, 46, said they lit the fires in 2001 and 2006 to reduce the growth of invasive plants and protect their property from wildfires.

The two were convicted of the arsons three years ago and served time — the father three months, the son one year.

But a judge ruled their terms were too short under federal law and ordered them back to prison for about four years each.

Ammon Bundy, an Idaho militia leader, said that while the occupiers were not looking to hurt anyone, they would not rule out violence if police tried to remove them, the Oregonian reported.

Bundy's brother Ryan Bundy, who is also an occupier, told the Oregonian that they're 'willing to kill and be killed' if necessary, adding that the federal officials' actions have been 'in violation of the constitution'.*

'The best possible outcome is that the ranchers that have been kicked out of the area, then they will come back and reclaim their land, and the wildlife refuge will be shut down forever and the federal government will relinquish such control,' Ryan Bundy told the Oregonian.*

He added: 'What we're doing is not rebellious. What we're doing is in accordance with the Constitution, which is the supreme law of the land.'

The brothers said, however, that their real goal is to simply start a movement. It is unknown what types of weapons are now at the refuge building, but there are no hostages in the area.*

'The facility has been the tool to do all the tyranny that has been placed upon the Hammonds,' told the Oregonian.***

Ammon Bundy posted a video on his Facebook page asking for people to come help him. Below the video is this statement: "(asterisk)(asterisk)ALL PATRIOTS ITS TIME TO STAND UP NOT STAND DOWN!!! WE NEED YOUR HELP!!! COME PREPARED."*

Ammon Bundy said the group planned to stay at the refuge indefinitely.

'The facility has been the tool to do all the tyranny that has been placed upon the Hammonds,' the Oregonian quoted Ammon Bundy as saying.

'This is not a decision we've made at the last minute,' he added, calling on other militiamen to join them.*

The Bundys are the sons of Nevada rancher Cliven Bundy. The Bundy family ranch in Bunkerville, Nevada, some 80 miles northeast of Las Vegas, was the site of an armed protest against the US Bureau of Land Management in April 2014.

MILITIAMEN'S CALLS TO ARMS*

In a video posted to Facebook by Sarah Dee Spurlock, two men - one donning camouflage gear - explain why they are taking the measures they are.*

FIRST MILITIAMAN: 'This will become a base place for patriots from all over the country to come to be housed and live here.

'We're planning on staying here for several years.And While we're here, what we're going to be doing is we're going to be freeing these lands up, getting the ranchers back to ranching, getting the miners back to mining, getting the loggers back to logging, where they can do it under the protection of the people.*

'And not be afraid of this tyranny that's upon them. And what'll happen is Harney County will begin to thrive again.*

'One time they were the wealthiest county, now they're the poorest, and we will reverse that in just a few years by freeing up their land and resources.*

'And we're doing this for the people. We're doing this so the people can have their land and their resources back where they belong.

'We're calling people out here to come and stand. We need you to bring your arms and we need you to come to the Malheur National Wildlife refuge.'

SECOND MILITIAMAN: 'Until that line is drawn to say "We've had enough of this tyranny, you are going to leave us alone, it will not change".*

'This is the power of America right here. People got together for this and it doesn't have to stop here.*

'This could be a hope that spreads through the whole country. Everybody's looking for this hope because the government has beat us, oppressed us and took everything from us. They will not stop until we tell them no.'

The stand-off gained nationwide attention as the agency sought to seize cattle because the elder Bundy refused to pay grazing fees.

The federal agents ultimately backed down, citing safety concerns, and gave back hundreds of Bundy cattle which they had rounded up.

In another video, Jon Ritzheimer, a Phoenix-based anti-Islam activist and militiaman, says goodbye to his family, suggesting he plans to occupy the federal lands as well.

'The oppression and the tyranny that's taken place in Oregon - we know it's taken place all across the US - the Bundy Ranch was prime example. And we the people need to take a stand,' he said in the 13-minute video.

He goes on a lengthy rant about the legal system and how it treated the Hammond family.

'They are not terrorists....This oppressive, tyrannical government who really has no jurisdiction here - this is Hardy County's land,' he said.

He added: 'The Hammonds were not tried by a jury of their peers. There's an indictment with no signatures on it.

'This is a cruel and unusual punishment. But this federal government comes in here and says no, that's not enough, they need to do a minimum of five years.'

Ritzenheimer then makes a call to arms.

He said: 'It's real simple, Dwight. Do you want to die in prison labeled a terrorist by these oppressors or do you want to die out here with us as a free man? I want to die a free man.'

'If you do not spearhead this and take a stand, it's going to set a new precedent across the US.

'They get stronger and think they can continue to go around and bully we, the people. But when we unite and you take that stand there's no stopping us.'

Beth Anne Steele, an FBI spokeswoman in Portland, told The Associated Press that the agency was aware of Saturday’s situation at the national wildlife refuge. She made no further comment.

Harney County Sheriff Dave Ward released a statement late on Saturday night.*

Ward said: 'After the peaceful rally was completed today, a group of outside militants drove to the Malheur Wildlife Refuge, where they seized and occupied the refuge headquarters.*

'A collective effort from multiple agencies is currently working on a solution. For the time being please stay away from that area.*

Some local residents feared the Saturday rally would involve more than speeches, flags and marching. But the only real additions to that list seemed to be songs, flowers and pennies.

As marchers reached the courthouse, they tossed hundreds of pennies at the locked door. Their message: civilians were buying back their government. After the march passed, two girls swooped in to scavenge the pennies.

A few blocks away, Hammond and his wife Susan greeted marchers, who planted flower bouquets in the snow. They sang some songs, Hammond said a few words, and the protesters marched back to their cars.

Dwight Hammond has said he and his son plan to peacefully report to prison January 4 as ordered by the judge.

The decision to extend the Hammonds’ prison terms has generated controversy in a remote part of the state.

In particular, the Hammonds' new sentences touched a nerve with far right groups who repudiate federal authority.

Ammon Bundy and a handful of militiamen from other states arrived last month in Burns, some 60 miles from the Hammond ranch.

In an email to supporters, Ammon Bundy criticized the US government for a failed legal process.*

A group of militiamen occupied a federal building at an Oregon wildlife refuge late Saturday and vowed to stay there indefinitely to protest rancher rights.

The standoff came after protesters and militia members converged on the small town of Burns to show support for a pair of ranchers jailed on an arson conviction, according to NBC affiliate KTVZ.

After a march and rally there, a small group then took over the Malheur National Wildlife Refuge headquarters about 60 miles away.

Ammon Bundy — son of Cliven Bundy, the Nevada rancher known for his 2014 standoff with the federal government — was among them.

After issuing a Dec. 31 video message urging "patriots" to "stand up" and report to the refuge, Bundy said in a new video posted to Facebook late Saturday that his group was there and prepared to stay for "as long as it takes."

"We're prepared to be out here for as long as needs be," Bundy said in the video posted on Facebook. "Once they can use these lands as free men then we will have accomplished what we came to accomplish."

He stressed the protest was peaceful, saying his group poses "no threat to anybody."

The FBI said it was aware of the situation but declined to comment further. NBC News was unable to reach local officials for further comment.

The case which sparked the initial protest involves Dwight Hammond, 73, and his son Steven, 46, who set fires that spread to government lands they leased to graze cattle.

The Hammonds — who said they lit fires in 2001 and 2006 to reduce the growth of invasive plants and protect their property from wildfires — were convicted and served time for arson. However a judge later ruled their sentences — three months for the father, one year for the son — were too short and ordered them back to prison.

The Hammonds are due to report to jail on Monday, according to KTVZ.

BURNS, Ore. -
The fears of many Burns-area residents of violence when hundreds of militia members converged on the small town failed to materialize as a protest march and rally went peacefully Saturday, in support of a pair of ranchers about to begin their second federal prison term on an arson conviction.

But a short time later, a smaller group took over the Malheur National Wildlife Refuge headquarters, about 60 miles to the southeast.

Ammon Bundy, son of Cliven Bundy, the Nevada rancher known for his 2014 standoff with the federal government, told NewsChannel 21 he and his group are prepared to stay at the refuge for as long as necessary. He urged others to join them, saying they are peaceful and don't mean any harm.

"It is the people's facility, owned by the people," Bundy said. "And it has been provided for us, to be able to come together and unite in making a hard stand against this overreach, this taking of the people's land and resources."

The rally kicked off at noon in the quiet town of Burns on a bitterly cold day.

"We're here to support the Hammond family and the community," said Brandon Curtiss, president of the group Idaho 3 Percent.

But after weeks of worry, it was an unsettling day for many area residents.

"We're not used to this kind of thing here," said resident Kainan Jordan.

The militia groups traveled to Burns to show their support for father-and-son ranchers after a judge ruled they served too little time for setting fires that spread to government lands they leased to graze cattle.

Dwight Hammond, 73, and Steven Hammond, 46, said they lit the fires in 2001 and 2006 to reduce the growth of invasive plants and protect their property from wildfires.

The two were convicted of the arsons three years ago and served time — the father three months, the son one year. But a judge ruled their terms were too short under federal law and ordered them back to prison for about four years each, as arson on federal land carries a mandatory minimum five-year prison term.

A prescribed burn in 2001 got out of hand, burning 127 acres.

"I'm going to prison for five years for 127 (acres)? Seems like a bit of an overkill to me," Dwight Hammond said Saturday outside their home .

Federal prosecutors believe the blaze was a cover-up of poaching.

On Monday, the Hammonds are turning themselves in at a California federal prison.

"It isn't my decision, obviously," Hammond said. "It's a sentence."

But it's a sentence which people from many states came to the wide-open lands of southeastern Oregon to protest against.

"We've had the same problems in Utah and Nevada," said Utah resident Shannon Cox.

U.S. flags and signs ("We Stand with the Hammonds") in hand, the protesters marched down the street, throwing pennies in front of the door of the Harney County Sheriff's Office, in essence buying back their government.

"He didn't do his job!" one protester said of the sheriff.

Many of the participants said they were hoping the sheriff would stand up against the federal government and protect the Hammonds.

"This whole process has been unjust from start to finish," Curtiss said.

While most people in town support the ranching family, the militia groups' involvement has been sparking controversy for weeks.

"I don't like the militia's methods," said resident Monica McCannon who held up signs against the militia. "They had their rally. Now it's time for them to go home. People are afraid of them."

Others in town shared that sentiment.

"It's sort of frightening when there are people making threats and people toting guns," Jordan said.

Militia organizers insisted they weren't here to cause any harm to anybody.

"We're here for a peaceful rally," Curtiss said. "If the Hammonds decided not to go to prison and stand up for their rights, we would stand right by their side. What would entail after that, I don't know."

The marchers gathered out front of the house, and one by one went to hug Dwight Hammond and his wife.

"To think that there's this many people showing up," he said, his voice breaking.
"I thank everyone who came out here today."

It doesn't change the outcome. On Monday Hammond and his son are going back to prison.

"See you in five years," Hammond said.

Later, in a video message widely spread on Facebook, Ammon Bundy, reportedly joined in the takeover by two brothers and dozens of other militia members, explained why they had taken that step.

"This will become a base place for patriots from all over the country to come and be housed here," he said, standing on a snowy road. "And we're planning on staying here for several years."

Bundy said they will be "bringing the lands up and getting the ranchers back to ranching and the miners back to mining, putting the loggers back to logging, where they could do it under the protection of the people, and not be afraid of this tyranny that has been upon them."

"Harney County will begin to thrive again," he said, noting it used to be the wealthiest county in the state and is now the poorest.

"We're doing this for the people," Bundy said. "We're the point of the spear," urging people to "come out here and stand" with them. He said they have a place to stay and food to offer, adding: "We need you to bring your arms."

Another participant, Blaine Cooper, compared the takeover to what is done about the bullies in high school that eventually "you got sick of, and you had to put him in his place. I had to knock mine out, and we became best friends."

"Now, I'm not going to be best friends with the BLM," he said. "The point is, until that line is drawn, that we have had enough of this tyranny and you are going to leave us alone, it will not change. This is the power of America, right here. ... This could be a hope that spreads through the whole United States."

"Everybody's looking for this hope, because the government has beat us and oppressed us and took everything from us, and will not stop until you tell them, 'No!'"

Earlier, about 40 people gathered at a northeast Bend store's parking lot in the Saturday morning cold for a convoy to Burns for the rally

*Leader Andrew Bedortha stressed the peaceful nature of the gathering, noting the group included seniors, women and children. "We're not in tactical gear," he said. "

Across the parking lot, about 20 members of area peace and justice groups held their own protest, holding up signs. Organizer Greg Delgado said, "The Constitution should be respected by all of us, and that's what we're here for -- but also that Bend is united for peace."

The case has generated controversy in a remote part of the state where the Hammonds are well-known for their generosity and community contributions. It's also playing into a long-simmering conflict between ranchers and the U.S. government over the use of federal land for cattle grazing.

In particular, the Hammonds' new sentences touched a nerve with far right groups who repudiate federal authority. The son of Nevada rancher Cliven Bundy, who was involved in a standoff with the government over grazing rights, is organizing opposition.

This month, his son Ammon Bundy and a handful of militiamen from other states arrived in Burns, some 60 miles from the Hammond ranch.

In an email to supporters, Ammon Bundy criticized the U.S. government for a failed legal process. Federal lawyers prosecuted the Hammonds under an anti-terrorism law that required a five-year minimum sentence, though they have declined to say why.

Ammon Bundy wrote that the Hammonds are not terrorists and didn't commit any crimes. He also shamed the Harney County sheriff for not protecting the Hammonds. The sheriff didn't respond to calls from The Associated Press.

Ammon Bundy and other right-wing leaders have called on armed militia around the country to come support the Hammonds.

A call for participants in the peaceful demonstration said they wanted "to make it clear that our community isn't silently complicit with these groups and their intimidation tactics."

"If what is happening to the Hammonds is allowed, it will set a standard of what these powerful people will do to all of us," Ammon Bundy wrote in an email, referring to the federal government.

The Hammonds have not welcomed the Bundys' help.

"Neither Ammon Bundy nor anyone within his group/organization speak for the Hammond Family," the Hammonds' lawyer W. Alan Schroeder wrote to Sheriff David Ward.

Dwight Hammond maintained in an interview with The Associated Press their case isn't about fires: It's the climax of the government's efforts to take their land at a time when saving endangered species has gained in importance.

Over the years, the government chipped away at their grazing allotments, taking some and increasing fees on others, Dwight Hammond said. New federal rules made it harder to renew permits.

After father and son were convicted of the arsons, the government declined to renew their grazing permit. The family is appealing that decision.

"We paid hard dollars over fifty years ago for the right to graze. It isn't right for them to take it away from us," Dwight Hammond said, adding they've had to rent pastures from other ranchers to keep their cows fed.

In an opinion piece published this month in the Burns Times Herald, Oregon's U.S. attorney, Bill Williams, said the Hammonds received a fair trial and lawful sentences.

Williams said the government has never called the ranchers terrorists, and prosecutors acknowledged they were good people who contributed to their community.

Referring to the militia, Williams said: "Any criminal behavior contemplated by those who may object to the court's mandate ... will not be tolerated."

Nevada rancher Cliven Bundy’s three sons and “about 150” militiamen have occupied the Malheur National Wildlife Refuge HQ to protest the pending imprisonment of two Oregon ranchers accused of arson, arguing the federal government has no authority in local cases.

“We’re going to be freeing these lands up, and getting ranchers back to ranching, getting the loggers back to logging, getting the miners back to mining where they could do it under the protection of the people and not be afraid of this tyranny that’s been set upon them,” Ammon Bundy, who appears to be the leader of the group, said in a Facebook video posted by Sarah Dee Spurlock on Saturday.


Bundy appears to be standing at the scene of the takeover, surrounded by several men in military-style uniforms with rifles and hand-held radios.

The rancher points out that Harney County used to be the richest in state, and is now the poorest. His radical proposal to solve the situation is to have armed “patriots” come and live in a de-facto self-rule zone independent of the federal authorities.


The second speaker in the video, identified as Blane Cooper, equates the Bureau of Land Management (BLM) to bullies at school that used to beat one up and who eventually had to be put in their place.

“Until that line is drawn and say ‘we’ve had enough of this tyranny, you are going to leave us alone’ it will not change,” the military-clad man says.


According to Cooper, they hope their occupation will spell the beginning of a US-wide movement.

“It doesn’t have to stop here. This could be a hope that spreads through the whole country, the whole United States. Everybody’s looking for this hope because the government has beat us, and oppressed us, and took everything from us; they will not stop until we tell them no,” he claims.



The militiamen told OregonLive there were about 150 of them, but a couple who delivered food to the refuge HQ estimated that there were just 15.

The Bundys and their armed supporters occupied the federal property after splitting from a peaceful Saturday morning protest in Burns, Oregon.


Some 300 people marched through the town to protest against the prosecution of two Harney County ranchers, Dwight Hammond Jr. and Steven Hammond, who are scheduled to report to prison on Monday.

Both ranchers were convicted on charges of setting fire to federal land. The case has attracted interest from local militia and intensified debate around the federal government’s authority.


“Dwight Lincoln Hammond, Jr., 73, and his son, Steven Dwight Hammond, 46, both residents of Diamond, Oregon in Harney County, were sentenced to five years in prison by Chief US District Judge Ann Aiken for arsons they committed on federal lands,” the US Attorney Office*said.*




The occupation resembles the Bundy Ranch standoff of 2014, when the Bureau of Land Management (BLM) attempted to enforce grazing laws. Bundy got the help of armed militia and triggered a standoff with federal authorities.

The family said heavily-armed federal agents had surrounded their ranch as “trespass cattle” were removed from the disputed land.

Since 1993, Cliven Bundy – the “last rancher in Clark County, Nevada” – has refused to pay fees to the federal government for the right to raise cattle on land that his family has ranched since the 1870s, according to the Washington Free Beacon.


The dispute began in 1998 when the BLM designated 186,909 acres of the Gold Butte area, where the ranch is located, as “critical” for the survival of the desert tortoise population. Bundy had lost his grazing permit in 1993, despite his family’s long-time presence on the land.


According to the BLM, Bundy owes around $1 million in fees, while the family contends the sum is more like $300,000.


Hammonds case
The Pendleton, Oregon jury found the Hammonds guilty of the arsons in June 2012. Both were charged with igniting a series of fires on lands managed by the BLM.

Hammond Ranches has about 12,000 acres in the Diamond-Frenchglen area. Their livelihood is running cattle during the winter. Two years ago, the ranch used 26,420 acres of land belonging to the BLM for summer grazing.

Supporters of the Hammonds believe they were treated unconstitutionally because the two were convicted of arson under a provision of an expansive federal law punishing terrorism. They both served their prison terms for 2001 and 2006 fires, but were then told by appellate judges they had to go back to prison to serve more.


Ranchers use fire in eastern Oregon to burn invasive species. However, it is a dangerous practice, as several wildfires in the area have gotten out of hand, scorching hundreds of thousands of acres.

The controversial case demonstrates a problem with a 1996 law, which was introduced to punish domestic terrorists, according to Barry Bushue, the longtime president of the Oregon Farm Bureau.


“I find it incredible that the government would want to try these ranchers as terrorists,” Bushue told The Pete Santilli Show. “Now is where the rubber meets the road. Right now is when the public should absolutely be incensed. And the public, I think, should be fearful.”

The self-proclaimed “patriots”, say they*have around 150 members stationed in the Malheur National Wildlife Refuge, The Oregonian reports. Their leader has reportedly informed local press that the men are planning to stay in the refuge indefinitely and are “willing to kill or be killed” to do so.

The occupation began shortly after a peaceful protest yesterday in support of a local ranching family facing prison for arson.
