Anaesthetist acquitted of 4 charges of molesting woman, who admitted to lying in court​

  • Dr Yeo Sow Nam, 52, was cleared for all four criminal charges against him

SINGAPORE — An anaesthetist who runs a private clinic at Mount Elizabeth Hospital in Orchard was cleared on Monday (Aug 16) of four criminal charges of molesting a woman almost four years ago.

District Judge Ng Peng Hong granted the prosecution’s application for a discharge amounting to an acquittal for Dr Yeo Sow Nam, now aged 52, midway through his trial. The defence had yet to begin its case.

The complainant, 33, had admitted to lying on the witness stand about material aspects of the allegations she had lodged against Dr Yeo.

She had accused him of inappropriately touching her four times in the hospital on the evening of Oct 9, 2017.

The allegations included him wrapping his hand around her shoulder, pulling her towards him and kissing the side of her head on two occasions; hugging her and “quickly gripping” her breasts over her arms from behind her; and squeezing her waist over her clothes with his hand.

The media and public were banned from attending the hearing when she testified, but Dr Yeo’s lawyers — Mr Eugene Thuraisingam, Mr Chooi Jing Yen and Mr Johannes Hadi — successfully applied for court transcripts to be released under the principle of open justice.

Prosecutors objected to this but the court ruled in the defence’s favour.

Dr Yeo’s lawyers said they had also intended to apply for the gag order on the complainant’s identity to be lifted. However, they acknowledged that the law prohibits anyone from naming her until or if she is charged with giving false evidence.

Mr Thuraisingam added that they reserve their rights to apply for the lifting of the gag order in the future.

District Judge Ng Peng Hong then ruled that the gag order will remain in force.

Deputy Public Prosecutors Muhamad Imaduddien and Andre Ong did not say if they intend to charge the complainant.

While the media cannot identify her occupation, Mr Thuraisingam told the court that she was not a patient, staff member at Dr Yeo’s pain management clinic — The Pain Specialist — at Mount Elizabeth Hospital, or a fellow doctor.

The lawyer noted that she had admitted to knowingly giving false evidence on oath to the court, arguing that she was not an “alleged victim” but a “self-confessed perjurer”.

Even though an acquittal, which can be due to other reasons other than the accused being innocent, does not automatically mean a gag order is lifted, the defence said that was an exceptional case with a distinctly different public interest at stake.

They argued: “She is not a ‘real’ victim who has been disappointed by the prosecution’s inability to prove the commission of an actual crime in court.

“She is a liar who has made false, scurrilous allegations against (Dr Yeo) — which were publicly reported over the course of more than a year during these proceedings in the name of open justice — and perjured herself… She should not be permitted now to abuse the protection of the gag order to escape the usual operation of the open justice principle."

Under cross-examination by Mr Thuraisingam, she had confessed to lying about Dr Yeo resting his hand on her hip, among other alleged instances, and to changing her version of events to make it seem more believable.

She also agreed that she would sometimes lie if it was in her self-interest, and that she lied so frequently in court she could not remember when she told the truth.

‘FALSE AND SCURRILOUS ALLEGATIONS’

In a public statement released to the media following his acquittal, Dr Yeo wrote that he “was the victim of false and scurrilous allegations by a female who interacted with me in the course of my practice as a medical specialist”.

He added: “The past four years have been an ordeal for me, my family and friends, my staff, and my patients.

“Despite the distinction and professionalism with which I have served the community as a doctor, I have had to endure the distress and ignominy of being publicly accused of sex crimes I did not commit.”

Dr Yeo also thanked his patients and colleagues for their trust in him, and the wider medical community — including hospitals and the Singapore Medical Association — for standing by him.

While he said he was glad that the truth had prevailed, he expressed his disappointment that the compliant had “jeopardised the good, necessary, and difficult work of ensuring access to justice for real victims of sex crimes, many of whom already hesitate to accuse their attackers publicly”.

“I hope that today’s verdict does not discourage real victims of sex crimes from coming forward, or set back the moral agenda in their favour,” he added.

SINGAPORE - An anaesthesiologist who had four molestation charges against him withdrawn on Monday (Aug 16) said that he will seek legal counsel regarding taking action against his accuser.
The woman, who cannot be named due to a gag order, had accused Dr Yeo Sow Nam of outraging her modesty on Oct 9, 2017.
District Judge Ng Peng Hong gave Dr Yeo a discharge amounting to an acquittal on Monday after the woman earlier admitted that she had lied in court during the trial which started in March.
In an email interview with The Straits Times, the 52-year-old Singaporean doctor said: "I believe that we have a good system that will dispense justice by protecting the true victim. As for the false accuser, we will have to leave it to the relevant authorities."
Dr Yeo told ST that the past four years were "very painful and disruptive" for him and his loved ones.
He said he is very relieved that his ordeal is finally over, adding: "I was initially shocked that this could happen to me even though I had done nothing wrong. However, I was absolutely confident that the truth would prevail and that I would be exonerated.

"Nonetheless, it was a very harsh and distressing experience for me to be falsely accused of serious sexual misconduct when I have always upheld the highest professional standards of medical practice and care for my patients.
"The cost and burden on me, my family, and friends was immense. A public hospital even discontinued my visiting consultant position shortly after I was charged."
Dr Yeo also said that he was "disturbed" by a few issues. For instance, he could not believe that the incident could happen to someone "who had done nothing wrong".
He told ST: "I'm concerned that the perpetrator of the lies and false accusations against me remains free and unpunished. She remains a threat to the medical profession, our patients and society. She is also protected by a gag order."
He added: "Many of my colleagues and friends in the medical community share these grave concerns."
The doctor told ST that while he is grateful that the judicial process managed to expose the woman's "deceit", he wondered how such false accusations could be identified much earlier during the investigative process.
"This would have saved me and my family much pain and suffering. I sincerely hope that the relevant bodies and authorities can look into these questions," said Dr Yeo.

Doctors are the whipping boys of the professional world.

Patients are at liberty to lie and create false scenarios false accusations, say that the Dr said or did things they did not. The doctor is guilty. Colleges believe patients more than Drs.

PLUS.......the patients have indemnity from persecution for making these false accusations. The reason? Because it will undermine the process which allows patients to complain. If patients fear repercussion from complaining against a dr they may not complain. Hence this hinders the role of the college in self regulating.

I don't think such thing will happen to lawyers. Lawyers will sue the sock off people making false accusations and the law society will say that's the law and justice is served.

Thats the trouble. Doctors are not allowed to counter sue.

When it comes to Politicians, Ministers if somebody did the same, they will get counter sue like crazy.

Anyway whatever lah. I never ever expected doctors and the medical profession to be such total whimps until I became one.

That is why must be very careful and paranoid when you are doctor. Keep everyone happy. If anyone not happy must pre-empt.

Gyne will always have chaperone.

Anyway with Dr Yeo Sow Nam. It wasn't a patient. It was just someone who had a bone to pick with him.

I think there needs to be some protection for doctors as well.

It is fair enough if the doctor has acted unprofessionally to a patient and all. But if it a private matter, this has to be dealt with sensitively. Sure if the doctor is guilty of breaking the law, molest, sexual assault then that needs to be looked at.

But if it is frivolous?

Has to be a balance. At this juncture the doctors are at the mercy. Any person can cook up a story and complain and report to Salma Khalik and then it becomes a story.

have to be if the story is in the end false, the doctor should be allowed to sue. Sue not just the false accuser but also the news agencies that carried the false news.

Cannot just suka suka destroy the doctor's reputation.
