The driver should have just depressed the accelerator and run that jerk over. If I were the judge I'd rule it as an accident. And if the pedestrian makes noise, I wouldn't hesitate to fine him for jaywalking.

Normally, car should give way to pedestrian. It just takes that bit more time to let him cross.
