Cleaner cleared of sex with underage prostitute

A CLEANER broke down in tears after he was acquitted of having sex with an underage prostitute for $10. Bangladeshi national Md Salauddin Md Dudu Mia, 29, who did not have a lawyer, also thanked the judge repeatedly for believing in him.

In arriving at the verdict, District Judge Low Wee Ping noted that the charge did not specify the exact date, time or place of the offence although these were required by the Criminal Procedure Code.

The judge said: "What was significantly worrying was that the initial charge stated that the offence was committed in January last year on a staircase landing of Block 605 in Hougang but when the trial started on Dec 19 this year, the prosecution amended the charge to state that the offence was committed sometime in July this year at the staircase landing of an unknown block in Hougang."

The judge also noted that the statement Mr Md Salauddin gave to police referred only to the alleged offence last year and no further statements had been taken from him regarding the amended charge.

The court also found that the testimony of the victim, now 15 years old, was too vague and was not corroborated by any other witness.

Six of Mr Md Salauddin's colleagues, aged between 23 and 33, have been jailed between 10 and 17 months by a district court last month.

The girl, now 15, is being cared for at the Pertapis Centre for Women and Girls. There is a gag order on her identity.

Judge Low said that Mr Md Salauddin had admitted to the police that he met the girl and her friend in January last year but stated he did not have sex with either of them as he had no money. During the five-day trial, the cleaner also denied having sex with her in July this year. Mr Md Salauddin, who has been in remand since Aug 22, is now a free man.

Ita hard to kelong and there are no white horses inside prison....the fact any elite Kena sent to prison means he is not elite enough....protected elites are kept out of prisons.

I have seen some inmates sentence less then a year working as " cookie" .

So, now the girl's been found fibbing about sex, will she be named and shamed?

Go ahead and protect her identity. Next time she'll falsely accuse someone of rape.

This reminds me of an incident when I was in Sec 3 at Toh Tuck secondary.

My quite pretty classmate accused me of touching her neneh during recess an threatened to tell the teacher although it was an accidental grope.

I was so scared and pleaded with her not to do so. She said ok but I have to have sex with her after school. It was an awakening 3 hours of torrid frenzy !:o

Date, time and place of offence missing from the charge? How did the IO investigate the case? How did his/her supervisor allowed this to escape his/her eyes? A very glaring error indeed. Worse if a DPP or Asst DPP vetted the charge! Standards heading south.

I really hope that this is not a situation where they thought because it was a simple cleaner they could be slip-shod.

Looks like that's the case. IOs and their supervisors are trained to scrutinise the background of both accused person as well as victim when they start their investigation. Not being unfair but that's the reality and I am sure those still in service will agree with me. CP and DCID will, as expected, disagree.

Their command of English was superb, their legal knowledge deep and their style of investigating cases worthy of mention. No nonsense types. Fair to the victim and fair to the accused person.

They dare face awesome lawyers like David Marshall, JBJ and Leo Fernando in court and came out unshaken and more wiser.

Their high standards earned them the respect of members of the Bench.

Today's IOs lack the "uuummmmppphhhh" and all the other good attributes mentioned above.

Can any HI today be comparable to the likes of old-timers like Ong Hean Teik, Puvanendran, Ang Chiang Teck. The list will go on.

I doubt if M'sians are permitted but not sure on PR. Back in the 70s and 80s, we had many M'sians in the SPF. Almost all converted to SC. Was hinted to them that if they did not convert, promotion chances not-so-good. Most of these chaps already pensioned.
