立法处罚“过马路看手机”,并非小题大做|新京报快评

嘉兴市此次能够明文出台相关处罚条例,这在全国尚属罕见,颇具先导意义。

据新华社报道,浙江省人大常委会近日批准了一条《嘉兴市文明行为促进条例》。针对“低头玩手机”过马路等行为作出了禁止性规定,“行人通过路口或者横穿道路时浏览手持电子设备或者嬉闹的处警告或者五元以上五十元以下罚款”。

近年来,各地对于立法处罚马路低头族一直多有争论,此次浙江嘉兴市能够明文出台条例,对过马路看手机的行为最高处以50元罚款,这在全国尚属罕见,颇具先导意义。

在如今的移动互联网时代,手机已经成为我们生活中必不可少的工具。“低头族”无处不在,也已经成为长久讨论的一种社会现象。

具体到交通安全领域,“马路低头族”的存在,则会造成不小的安全隐患。中国青年报在2017年的一份调查显示,72.2%的受访者有步行过马路玩手机的经历。80.7%的受访者建议增设法律法规明确禁止这一行为。

其实,“开车玩手机”早已被明令禁止,《道路交通安全法实施条例》明文规定,驾驶机动车不得拨打接听手持电话,违者罚款200元,扣2分。

驾驶机动车看手机、打电话固然危险,而过马路看手机同样存在较大的安全隐患,只是尚未被写入《道路交通安全法》之中。

虽然如此,各地对于“马路低头族”,也多有管束。例如,在嘉兴之前,温州市其实已经出台了对于这类行为的处罚条例。

据报道,温州市在2019年元旦开始实施的《温州市文明行为促进条例》,明确规定,“对于行人通过路口或者横穿道路时低头看手机、嬉戏等,影响其他车辆或者行人通行等不文明行为要重点整治,违反该规定的会受到警告或十元罚款”。

对于此类行为,国外也有立法先例。例如,2017年7月,美国檀香山市议会便通过新立法,对过马路时看手机或使用其他电子产品的“低头族”罚款15到99美元。

过马路看手机,近年来已经造成了不少交通安全事故。对于公众而言,立法处罚“马路低头族”的意义不言而喻。也因此,温州方面在依据新《条例》开出罚单之际,网上出现一片叫好声。现在,嘉兴出台新条例,也希望能够收到好的规制效果。

当然,这一条例在具体实施过程中,必然还存在继续细化、规范的空间。对“马路低头族”违法行为的判断,也需出台更具体的条例作为依据,减少自由裁量的空间,做到科学执法,方能真正服众。

According to Xinhua News Agency, the Zhejiang Provincial People's Congress Standing Committee recently approved a "Jiaxing City Civilization Promotion Regulations." For the "low-headed mobile phone" crossing the road and other behaviors made a prohibition, "walkers through the intersection or cross the road when browsing handheld electronic devices or playful warnings or fines of more than five yuan and fifty yuan."


In recent years, there have been many disputes about the legislative punishment of the road-headed people. The Jiaxing City of Zhejiang Province has been able to introduce regulations in plain text, and impose a fine of 50 yuan on the behavior of crossing the road to see mobile phones. This is rare in the country and is quite valuable.


In today's mobile Internet era, mobile phones have become an indispensable tool in our lives. The “low-headed family” is everywhere and has become a social phenomenon that has been discussed for a long time.


Specific to the field of traffic safety, the existence of the "lower roads" will cause no small safety hazards. A survey conducted by the China Youth Daily in 2017 showed that 72.2% of respondents had the experience of walking across the road to play mobile phones. 80.7% of the respondents suggested adding laws and regulations to explicitly prohibit this behavior.


In fact, "driving a mobile phone" has long been banned. The "Regulations on the Implementation of the Road Traffic Safety Law" clearly stipulates that driving a motor vehicle is not allowed to answer a hand-held telephone. The offender is fined 200 yuan and deducted 2 points.


Driving a motor vehicle to watch a mobile phone and making a phone call is dangerous. Crossing the road to see a mobile phone also has a large potential safety hazard, but it has not yet been written into the Road Traffic Safety Law.


Even so, there are many restrictions on the "lower roads". For example, before Jiaxing, Wenzhou City had actually introduced penalties for such behavior.


According to reports, Wenzhou City’s “Regulations on the Promotion of Civilized Behaviors in Wenzhou City”, which was implemented on New Year’s Day in 2019, clearly stipulates that “for pedestrians who cross the road or cross the road, look down on mobile phones, play, etc., affecting other vehicles or pedestrians, etc. The behavior should be focused on rectification. Any violation of this rule will be subject to a warning or a fine of ten yuan."


There are also legislative precedents for such acts. For example, in July 2017, the Honolulu City Council of the United States passed new legislation to fine $15 to $99 for “low-headed people” who watched mobile phones or used other electronic products while crossing the road.


Looking at mobile phones across the road has caused many traffic safety accidents in recent years. For the public, the significance of legislating the "lower roads" is self-evident. As a result, Wenzhou has made a good voice on the Internet when it issued a ticket under the new "Regulations." Now, Jiaxing has introduced new regulations and hopes to receive good regulatory effects.


Of course, in the implementation of this regulation, there must be room for further refinement and standardization. Judging the illegal behavior of the "low-headed people on the road", it is also necessary to introduce more specific regulations as a basis to reduce the discretionary space and achieve scientific law enforcement in order to truly serve the public.
