Who make the decision of sending someone to 55 ?

Under the Criminal Law (Temporary Provisions) Act, or "Section 55" as it is more popularly known, suspected gang members were detained or placed under police supervision without the need for open trials. I heard that even some high ranking police officer doesn't know who have the power to put gang member or headman into 55 .
