My employers refuse to pay me and I have no contract! What can I do?

I used to work at this push cart last year end but was dismissed shortly after a week. My employers told me that they would give me my pay soon but they did not initiate contact with me. I've messaged them a few times and only once did they reply, stating that they would do the calculations and let me know. However, after that message there was no more contact and I messaged them again, but there was no reply this time. I want to make a police report but as there was no contract involved, I'm not sure whether I'm covered under the law. What should I do?

I am sorry that you face such a situation.

According to the Ministry of Manpower (MOM), when you are paid and if you are entitled to be paid depends on what is stated in your employment contract or the existing practices in your company. If the contract is silent, it is up to you to negotiate with your boss and have a mutual agreement.

As there was no contract it would thus depend on what was agreed on. If what was agreed on was not fulfilled, you may need to go to the MOM to find out what action you can take up with your former employer. According to the MOM website, the employee may lodge a claim for salary arrears or unauthorised deduction with the Ministry of Manpower by providing the information and email it to [email protected] if the employee satisfies the following conditions:

(a) the employee is not employed in a managerial and executive position

(b) the claim did not arise for more than one year from the date of lodgement

(c) if the employee has left employment, the claim is lodged within six months from the date of leaving employment

3. or else, there is no case against the "employer".

sometime when people shout "Fuck You" in your face it may not mean to be an admission of liability, you know :eek:
