BUKIT MERTAJAM: Penang police have described the claim made by an Indonesian woman that she was beaten and raped by two policemen as a false accusation meant to tarnish the image of the force.

State deputy police chief Datuk Abdul Rahim Jaafar said they had carried out initial investigation, including medical examination, and found that the 26-year-old woman was not raped.

"I hereby deny the accusation as it is indeed meant to defame the Royal Malaysian Police, especially my staff in Penang.

"Based on the medical report issued by Penang Hospital, there was no sign of her having been raped or beaten," he said here Sunday.

It was reported Sunday that an Indonesian woman claimed she was raped by two policemen inside a patrol car in Bukit Tengah, near here around midnight Saturday.

Abdul Rahim said further investigations on the woman also found that she had given too many contradictory statements, including about the exact location of the alleged incident.

Besides, Abdul Rahim said the woman was also unable to identify the alleged rapists.

He said the woman's statement that she was a factory worker was also proven untrue as investigations found that she was working as a guest relation officer (GRO) at an entertainment centre in Seberang Jaya.

"So far, evidence revealed that she had made up all the stories about being raped by two policemen, but we will continue carrying out the investigation in every aspect," he said, adding that police did not rule out the possibility to take action against the woman for making the false accusation.

All rape investigations under Section 376 of the Penal Code are very onerous and a lot has to depend on medical reports and DNA results.

The police investigating teams are usually very careful when pursuing such investigations. They have special teams/units to handle such reports.

The police investigating teams will always work very closely with proffessionals from the Department of Forensic Sciences.

On their part they will seize all evidence, including the patrol-car to conduct investigations.

If the culprits were identified, they too would be subjected to tests for purposes of DNA Profiling.

Traces of semen and pubic hair will be collected along with the undergarments like panties, underwears, etc...

These are the silent witnesses to the crime if any.

The physical examination of the victim's vagina will determine as to whether she had some latest penetration, signs of struggle, etc. The medical doctor will make notes of the tears in her vagina and conclude whether it was recent or old. She may have scratched her victims and here too the nails may be of help for they may carry skin specimens.

Unless, all this has been concluded by the investigation team and substantiated by the medical team, then only can the Police Chief conclude and say what he feels ought to be said in a press release.

In all fairness to the victim, the police should not capitalise on the fact that she DID not know the exact location or identity of the two rapists. More often then not women in such incidents are usually in a disturbed state of mind for the incident leaves deep scars in their minds. Hence victims of rape should be handled tenderly and with care.

In this case the police found out that the alleged victim was NOT a factory worker but a Guest Relations Officer. The fact that she gave a wrong story here does not mean that she lied for she may have had reasons not to say that she was a GRO. Even prostitutes have been raped and the perpetrators taken to tasks. The law does NOT discriminate at to the proffession of the victim. This becomes even more onerous when the rape victim is mentally retarded.

In this case, it seems that the victim was raped on Saturday and on Sunday the Police Chief made a statement absolving his officers from any blame. Why so FAST?

What is worse is his final parting shot that the police may charge her for making a false statement.

Sometimes blind support for their own people may not augur well for the police in the long run. The public will loose confidence in the police and this will affect them in their work. No police force can function WITHOUT the support from the public.

In this case, the Police Chief may be further enamoured by his staff, but the staff may use this support and inflict even more harm on future victims.

I am sure Penang has a good government under PKR and many NGOs and Women groups to probe even deeper.

Hope the victim gets justice.
