新北市一名孫姓男子日前到圖書館借書，只是要離開時雨傘竟然不翼而飛，因為傘對他有意義，當事人不抱希望，結果員警還真的找到偷傘的人，東西不見到底怎麼報案，律師說如果騎車錢包、手機掉了，這種遺失可以告「侵占」否則都算「竊盜」。

3名男子從圖書館走了出來，走到旁邊窗戶發現外頭下雨，其中這名身穿綠色衣服的男子看了看旁邊的傘架，還在挑選要哪一把選中一把折傘後3人一起走下樓離開，事發在13日下午四點多三重市立圖書館，孫姓被害人只是來借書，萬萬想不到一出來竟然無傘可撐。
記者吳筱凡：「下雨天，民眾很常把傘放在像這樣的傘架裡頭。」
警方隔了三天找到偷傘嫌犯，發現是一名18歲的李姓男子，被害人也高興的在NPA署長室貼文，查一查網路新聞發現警方對於竊盜案都不會積極偵辦，只是掉了一把雨傘警察怎麼可能幫我，掉的是一把500元的雨傘對我有特別意義，沒想到會找到雨傘感謝警方，一般來說民眾對於傘被偷到底要報竊盜還是侵占，先判別是不是遺失物。

電訪律師：「私人的雨傘就放在門口，他不是愛心傘(非遺失物)，他不能隨便你拿去使用，所以他不在我可以控制範圍內，那如果我今天是把他取走那這樣的狀況就會變成是竊盜。」

以刑責來說，兩邊都是最重五年有期徒刑，但不一樣的是，竊盜是公訴罪侵占屬於告訴乃論，可以撤告，雨傘若被認定為非遺失物，就算竊盜，雖然只是一把小小傘具，但順手牽羊的行為，還是可能讓自己吃上官司。
