CITY Harvest Church leaders were in a hurry to refute allegations that they were misusing church funds for Ms Ho Yeow Sun's singing career, it was revealed in court yesterday.

Shortly after churchgoer Roland Poon made public his worries in January 2003 about how funds were being used, the church commissioned a special audit of its accounts by auditor Foong Daw Ching.

But that was not all.

At a church annual general meeting (AGM) in April that year, it played a video in which Mr Foong declared: "It is my professional opinion that no church funds were ever used in the promotion of Ms Ho's secular singing career."

But yesterday, the 63-year-old auditor admitted that the video was planned by the church itself and he was merely reading from a script he hardly had time to vet.

"It definitely wasn't me who drafted this statement," he told the court, during the ongoing trial of City Harvest founder Kong Hee and five of his deputies.

They are accused of funnelling millions of dollars of church money to Ms Ho's career and hiding the matter via a series of sham transactions beginning in 2007. The defence argues that the transactions were all above board.

The church also maintains that before 2007, Ms Ho's career was funded by direct donations to the Crossover Project, which was started in 2002 with the aim of using secular music to evangelise.

When repeatedly pressed by the prosecution as to who asked asked him to make the 2003 video statement and who wrote the script, Mr Foong insisted he could not remember, but said it "must be somebody quite senior".

The partner at accounting firm Baker Tilly TFW recalled how he was first asked to appear at the AGM, but he told the church he was not free that day.

City Harvest then dispatched a video crew, armed with a script, to meet Mr Foong at the Church of Singapore, which he attends. The video, he said, was recorded in a "very, very rushed" manner due to his busy schedule.

That was why he made the error of claiming that he was the lead auditor in charge of City Harvest's accounts when it was actually someone else at Baker Tilly. (First, he said he did not draft something that he read in a video; now he confesses he made a false claim over his role in the CHC affairs.....)

He said he had overlooked that part of the script as he was more concerned about correcting another sentence, which read that he "certified" no church funds were used for Ms Ho's music. (This guy is a church elder and a senior guy in some accounting firm?)

He changed that to "in my professional opinion".

The prosecution also tried to show that Mr Foong shared a close relationship with City Harvest leaders and gave them specific advice on transactions involving the church's money. The accountant said he only gave "general" advice when church members asked him about property purchases and bond investments.

Deputy Public Prosecutor Mavis Chionh, however, showed him e-mail messages in which he gave advice on issues such as the use of the church building fund and how such transactions should be disclosed. Several of the accused also described in e-mail how "Bro" Foong had given his approval for certain transactions.

But Mr Foong told the court he did not recall the matters discussed in the e-mail or whether he had not been involved.

The DPP presented one e-mail in which former church investment manager Chew Eng Han wrote that Mr Foong had "cleared" a decision to leave out key investment information at annual general meetings.

"The AGM will... not see the portfolio, only a line saying funds invested with fund manager. Only the auditor will see the whole portfolio but that is okay as we have cleared this with Foong," Chew wrote.

Asked about this, Mr Foong replied: "I do not understand this at all... I do not have any authority to clear any such thing."

Now we know why baker Tilly needs to send lawyers to sit in the court proceedings. The accounting firm will be liable to CHC for any misinformation committed by foong. This foong is bloody stupid to say such things in the video recording. His career has effectively ended today.

The learned judge should ask him, if he remembers at that time, did he remember how much was he paid for his services?? the defence will shout ??? ha ha ha did he remember he had a good breakfast, with all the money he made...that made him forgetful, when it was necessary?? ha ha ha

FOONG Daw Ching, the external auditor who made a public video saying that no City Harvest Church (CHC) funds were ever used in the promotion of Sun Ho's music career, admitted in court yesterday that the statement had been prepared by CHC, and that he had been pressured into reading it by the church.

Mr Foong, who is a co-founder of the firm now known as Baker Tilly TFW LLP, also told the court that he was not the lead audit partner for CHC's accounts at that time, even though he had said so in the video.

The video message, which was broadcast during CHC's 2003 annual general meeting (AGM) in April that year, was recorded in response to allegations made by a then-CHC member, Roland Poon, that church funds had been misused.

Mr Foong said, in the video, which was addressed to all CHC members: "I am the lead partner in charge of City Harvest Church's accounts. Having led the audit of City Harvest Church's accounts, it is my professional opinion that no church funds were ever used in the promotion of Ms Ho Yeow Sun's secular singing career and the accounts presented before this AGM are true and fair."

Mr Poon, who made the allegations in January 2003, had to retract them and print public apologies to CHC in five newspapers, costing him $33,372, according to the statement of facts agreed between the prosecution and defence.

Mr Foong admitted yesterday he was not the lead partner in charge of the church's accounts in 2003, having told the court earlier that he was the lead partner only for the first year that the church was the public accounting firm's client - between 1993 and 1994.

Mr Foong, who spent much of his day on the stand not being able to remember the incidents he was being questioned on, said the church had come to him with a prepared statement they wanted him to read.

"Who was it who asked you to read the statement, do you remember?" asked chief prosecutor Mavis Chionh.

"I can't, because the video crew came with this statement. I don't know who accompanied the video crew. And so, I can't remember who was the one who asked me to read this statement," Mr Foong said.

"Do you remember who handed you the statement?"

"Again, I can't remember."

Mr Foong said the whole process was "very rushed", as CHC wanted him to attend their AGM to present his opinion but he could not because he was preaching at his own church.

"Who wanted you to attend the City Harvest AGM to present your report?" Ms Chionh asked.

"I can't really remember," Mr Foong replied.

He did remember the church pressing him on getting the video done, and he agreed as a result.

When asked about the special audit his team did for CHC in 2003 - that is, the kind of work that was performed and how long it took - Mr Foong said: "Really, I cannot remember. All I remember is, work was done."

He also testified that CHC members would approach him for advice on transactions they intended to undertake, even after he was no longer the lead partner. When asked who from the church would come to him for advice, he said: "I really cannot remember. I think maybe (deputy senior pastor Tan) Ye Peng . . . (former finance manager) Serina (Wee) would be a likely person. And, on and off, I would say either (board member) John Lam or (former board member Chew) Eng Han will come . . . I can't remember over the recent years whether (finance manager) Sharon (Tan) was one of them . . . I really can't remember."

When questioned about the sort of advice CHC would approach him for, Mr Foong - who told the court he had been appointed to work in the Accounting Standard Council preparing accounting standards for charities - said he typically gave only very general advice to the church.

"I'm not good for details," he said. "I think the office knows that my real detailed technical knowledge is not very good."

When asked about how he advised CHC when they came to him on the bond issues that Xtron Productions intended to undertake, he said: "I can't remember what exactly I told them . . . My knowledge of financial instruments is very, very weak, so this is one area I never like to venture into because it's too technical for me to understand. So, I could only offer a very general comment . . . some idea of what they mean by 'fair value' and some idea of what is impairment and some idea of how bonds ought to be disclosed in the financial statements."

He's old and he probably knows he's done for professionally, so declaring memory loss and technical imcompetence means little to him, compared to a jail sentence.
 
He may be old but not stupid. Selective amnesia may well save his own skin and his firm! For he's a great pretender, like the rest! The prosecution has to work extra hard to nail them.

He was intoxicated by " China Wine" & like a fly, was drawn into a web, he couldn't come out & could not remember!, for his good sense & bearing & values were soon sucked out of him.
