A brothel operator who was convicted of killing a pimp is seeking the court to impose life imprisonment instead of the death penalty on him.

On Wednesday (3 April), Chan Lie Sian sought to show that he had not intended to cause the death of his subordinate William Tiah Hung Wai during a Court of Appeal hearing. The three judges -Chief Justice (CJ) Sundaresh Menon and Judges of Appeal Andrew Phang and Judith Prakesh – have reserved judgement for the case.

One hand he says aggressor has upper hand (long end of stick), on the other hand he says aggressor allowed application of bandage (didn't intend victim to die): has the defense counsel pulled wool over CJ Menon's eyes?

The aggressor Chan is legally trained ah? Add some bandages to cover CJ Menon's eyes? Knows how to play his cards to avoid death sentence?

What I want to know is why Chan asked for victim NOT to be sent to hospital. Victim refused is it? Obviously victim Tiah died because besides being almost fatally hurt by Chan, Chan put the last nail on the coffin of Tiah by preventing the arrival of the ambulance.

"DPP Phang also pointed out that Chan had dissuaded others from calling for an ambulance, causing Tiah to only be sent to hospital at around 6pm, long after the assault took place around 11am."

Me thinks that crux of matter is respect for human life.

Even in the words of his OWN lawyer, "(Chan) wanted to teach the deceased a lesson". Apply bandage can be with the intention to prolong death for as long as possible to prolong suffering before death. Eventual death is evidence that defendant intended to cause as much suffering as possible. The delay of 7 hours before calling ambulance is unconscionable and anything less than calling ambulance is likely to be substandard care, with the high possibility of deliberately causing INCREASED suffering with the ultimate intention of causing death (i.e. murder (s300a))

If it can be shown that the aggressor DISRESPECT for human resulted directly in the death, then death penalty should be sought.

IMHO, crux of the matter is the 7 hrs delay before being sent to hospital. In future, people may use this precedence to say the applied bandages but delayed only 6 hours and thus don't deserve death penalty. Clear cut, no wishy washy arbitrary judgement subject to bias and other unnecessary influence.

Delays in calling for ambulance should be seen as a significant aggravating fact for the causation of harm to the victim.
