二審判扁珍20年 致中1年2月 靚1年緩刑4年 都要交罰金

扁家弊案，高等法院二審今天上午十點宣判，陳水扁一審被判無期徒刑，今天二審改判陳水扁20年徒刑，罰金一億七千萬元，褫奪公權10年，吳淑珍也是改判20年，罰金2億元，褫奪公權10年，陳致中被判一年兩個月，罰金3千萬，黃睿靚被判一年，緩刑四年，罰金2千萬。刑度都比一審還輕。
陳水扁到目前已經被羈押五百二十九天，他向高院聲請具保停止羈押，依照往例，高院詢問庭後，合議庭當庭宣示是否交保的機率並不高，而是會在六月二十三號羈押到期前，以書面通知裁決結果。
由於高院審判長鄧振球向扁家表示，只要扁家在瑞士的七億元能夠匯回來，扁交保的可能性就很高。也因此扁家存在瑞士的兩千一百萬美元從五月一號起，已經陸續匯回了一千一百多萬美元，還有三百萬美元在進行交割中，這三百萬美元今天原則上會匯回台灣，爭取交保機會。
高院今天宣判扁家弊案，包括了國務機要費、海外洗錢、龍潭購地、南港展覽館四大案，共計有十名被告，包括陳水扁、吳淑珍、陳致中、黃睿靚、陳鎮慧、馬永成、林德訓、蔡銘哲、李界木、和郭銓慶。

TAIPEI - TAIWAN'S high court on Friday reduced former president Chen Shui-bian's life sentence for corruption to 20 years in jail, a court official told AFP. The official, who did not give her name, said Taiwan's former first lady Wu Shu-chen's life conviction for graft was cut to 14 years by the high court at a meeting early in the day.

The 59-year-old former president was convicted last year of embezzling state funds, laundering money, accepting bribes and committing forgery and was sentenced to life. The high court met, with Chen present, in downtown Taipei amid tight security, with uniformed police guarding the court building, which was also ringed with barbed wire. 'Chen is innocent!' a group of supporters of the former president chanted outside the court.

Chen has blasted the charges against him as a vendetta by the island's current Beijing-friendly administration over his pro-independence stance while president. Taiwan has been governed separately from China since 1949, but Beijing still considers the island as part of its territory and has vowed to take it back, by force if necessary. -- AFP

通通匯回來！扁求脫身　辯駁仍還押

滿懷希望，一早就從看守所被提訊出庭聆判的陳水扁，上午聽宣判，立即召開延押庭；3小時的延押庭，陳水扁只陳述意見30分鐘，整個人站得直挺挺，握著麥克風，中氣十足的為自己做辯駁，
羈押超過562天的陳水扁，在法庭上，對於二審判決改判為20年，向合議庭致上由衷感謝，稱讚認真，並對司法重新燃起希望，甚至還語帶激動地說，打死也不會逃亡，要為自己清白據理力爭，辯護到底，因為名譽是他的第一生命！
另外，也提到瑞士查扣的5.7億是政治獻金，並非犯罪所得，但只要能交保，一定在一週內完成相關手續，匯回指定帳戶。最後，還說對庭上充滿感激，有所期待，希望合議庭在改判刑度後，也有機會恢復自由之身，為自己爭取清白。
不過合議庭仍未做出評議，還押北所，陳水扁臉色凝重的被帶離法庭。陳致中：「今天宣判的結果，我們當然表示不滿意，也不能接受羈押庭的一個結果，今天沒有做出裁定，要另外書面通知，我們對這個結果是感到悲觀，我們也認為二審已經宣判了，在法律上沒有任何理由，再將我父親羈押。」
父親還押北所，做兒子的很不滿，因為從今年5月開始，陳致中陸續匯回452萬9千萬美元，這個月10日又匯回一批有價證券，包括數十檔的債券、基金、股票700多萬美元，延押庭下午，又再度匯回300萬美元，至今總計4億6600萬元，已匯回7成。
隨著羈押期限即將屆滿，陳水扁如果再被羈押，不服想提告，卷宗就會移審到最高法院，不過只審核卷證，如果被告在開羈押庭，還是由高院合議庭審理，但羈押時間必須重新計算，第一次羈押以3個月為限，但陳水扁因涉及重罪，因此沒有羈押次數限制，有可能押到定讞為止。
期待可以交保，但最後還是沒有結果，陳水扁只好拖著沉重的腳步，繼續回到羈押560多天的小小牢房裡。

I estimate they will let him out of jail before the polling for 5 cities' mayors and which his son also will be taking part.


1. they don't want to have sympathy votes due to his father's imprisonment.

2. they let Ah Bian out to speak outside jail to media and provoke anti- DPP sentiment.

3. they let Ah Bian out to release steam of anger against KMT regime.

They will magically time this release in relation to the poll. Just watch them play this sort of tricks.

It may backfire on them.
The "deep blue" lot will be very upset and may refuse to vote.
In any case, I don't think it's up to the political party to decide. Ma is one of the cleanest politicians to ever walk this earth. Whereas Ah Bian is one of the dirtiest and possibly the greatest liar.

判決理由 痛斥扁珍 納公為私 公款家用 以權牟利

扁家四大弊案，高院十一日宣判。合議庭在判決理由中，痛斥扁珍把國務費「納公為私，公款家用」；還以總統之尊「以權牟利，以私害公」，藉國家經濟科技發展，以金錢交易牟利私囊，違反法律人的良知，背棄人民的託付與期待，收受鉅額賄賂，併科罰金應從法定新台幣六千萬元，提高到一億五千萬元。
判決理由指出，陳水扁曾任律師、立委，並擔任中華民國第十和十一任總統，位高權重，本應為民表率、廉潔自持，應敦促家人、親信嚴守公私份際，避免「以權牟利，以私害公」，辱壞官箴，導致社會價值觀及行為觀紊亂。
但扁竟對所專屬並有善用責任的國務機要經費，放任家人公款私用，復藉諸國家經濟科技發展、公股投資民營機構職位，以金錢交易牟利私囊，致主管機關浪費公款以解決私人廠商財務問題、財政部長戒慎恐懼安排私人職位，更將不法所得款項，由家人以繁複手段洗至國外，以圖切斷資金來源及其犯罪所得的性質，逃避追訴、處罰，知法犯法，有違法律人的良知，及背棄人民之託付與期待。
判決理由指出，吳淑珍曾 因意外受有身體上的殘疾，固甚可憫。但她曾任立委，應當知道國家公帑分毫均源自人民血汗，卻在丈夫陳水扁擔任總統後，以總統夫人之尊，不但不能力求清廉， 謹守份際，反而「納公為私，公款家用」，且藉權勢地位，獲取鉅額私利；又利用金融工具反覆匯洗，意圖掩飾、隱匿，致使檢察機關查緝困難。
另 外，扁珍在九十五年間總統府國務費使用發生爭議後，不知以民意為圭臬，反省自躬，竟對昔日部屬，強施壓力以勾串證據，企圖掩飾犯行非常不當。扁珍行止對司 法信譽破壞至深，二人就龍潭工業區土地貪汙犯罪所得美金一千一百九十八萬美金，已超過貪汙治罪條例規定的罰金最高額六千萬元，二人罰金刑應加重為各一億五 千萬元。
