The notion that the government can, in effect, execute one of its own citizens far from a combat zone, with no judicial process and based on secret intelligence, makes some legal authorities deeply uneasy.

To eavesdrop on the terrorism suspect who was added to the target list, the American-born radical cleric Anwar al-Awlaki, who is hiding in Yemen, intelligence agencies would have to get a court warrant. But designating him for death, as C.I.A. officials did early this year with the National Security Council’s approval, required no judicial review.

The man in question is a Islamic fundamentalist of Arabic origin, now in Yemen. He has been linked to several terror activities against hos own adopted country the USA to kill as many US citizens as possible.

The US president has full responsibility to protect the citizens of his country and there are full guidelines on this on what he can do.
If there is "clear and present danger" then elimination of that individual is considered necessary to protect the innocents..Especially if the terrorist is hiding in Yemen desert plotting terror and beyond the reach of law enforcement agencies.

Such presidential action is taken after careful decision making procedures and adhering to clear guidelines laid in the constitution.

Simple, logical and ethical. many other nations also have such laws.

If the man in question is alleged to be responsible for all those horrible crimes, then submit him through due process in judicial proceedings ; let him have his day in Court

The only other nation that has such similar laws that I'm aware of is North Korea and Syria .

Even in China , they have due process that must be adhered to.

While I detest Muslim extremist and their violence views, I'm inclined to believe that they also have Constitutional Rights guaranteed by the US Constitution.

No wonder the US is such a shit country . They should learn from the examples of India Rule of law .

Israel does NOT execute its own citizens , only citizen of other nations .

It is not called assassination - they label it as "targeted killing " Go figure it out .LOL

You're right about the 5th Amendment.

But remember that the U.S. Constitution only applies to jurisdiction within U.S. territory. Therefore, an illegal alien also enjoys the same constitutional protection as an American citizen provided that he in U.S. soil.

But if the alleged offender is located overseas like the American citizen Muslim cleric in Yemen, he's not entitled to the 5th Amendment protection whatsoever. The U.S. Constitutional protection ends once a person, American citizen or otherwise, leaves U.S. territory.

The 5th Amendment of the U.S. Constitution clearly states that no person (not no U.S. Citizens) shall be deprived of life, liberty, or property without due process of law. This means all persons within U.S. soil which includes all non-immigrant legal aliens, illegal aliens, U.S. PRs, & American citizens.

I used to worked as a law clerk in America before, therefore, I know the legal loopholes left, right, and center that prosecutors and lawyers utilize to fight their cases in court.
