I'm also no lawyer.

But to be in contempt of court doesn't mean the offender has to be in the court to commit such offence.

In this case, lsw refuse to comply with agc to remove fb post and apologize and is deemed as comptempt of court by agc.

The contempt of court charge against LSW is specifically for the comment, "pliant court system", in his private FB post. Nothing to do with court appearance or apology.

The contention here is that no jurisdiction in the free world would charge a person for a private comment between friends, regardless of how it might be interpreted. Ditto for libel and defamation charges.

They will convict him in absentia and also sentence him in absentia. He will then apply to stay in the US as political refugee if he doesn't already have a green card.

In real democratic country like usa or korea, i believe their courts are more powerful than the government as they are independent from the ruling party.

In their courts of justice, the judge can convict anyone be it president or prime minister so long that person is proven guilty of some wrong doing.

IN sinkie land, other than some mp convicted for corruption, don't think the justice system here can do the same.

Here, if any of the judge try to be smart or bypass the ruling party on any matter, very soon i believe you can see the judge removed.

Because here the gahment control the courts.

So who is more powderful? I mean powerful..

if he doesn't have a pr yet and seeks political asylum, his eb visa (as fellow in harvard) will allow him to petition for asylum while doing his post doc in harvard and enjoying the view at ho plaza.

In a truly democratic country, where there's true separation between the executive (govt), legislative (Parliament) and judiciary (courts), the courts are indeed powerful and independent. A president can be impeached, or a corrupt minister charged, if they're guilty of proscribed offences. However, there are boundaries to its remit — the court can only interpret and prosecute according to the law laid down by Parliament. The court cannot make new laws.

Problem in Singapore isn't about the court's power; it's about the lack of independence of the courts, and executive interference in the court's decisions. This allows the govt to abuse the courts for political ends. The appointment of the PM's personal lawyer as AG is a prime example of such a collusive relationship between govt and judiciary.

Actually, its far worse then that. For a UK Trained lawyer like Lee Con You, his application and abuse of constitutional law is shocking. The PAP does not know the first thing about separation of state. PAP kangaroo judges will give you a blank look if you ask them. Ditto for idiots like Law Minister Shan and AG Lucien. Look at the whole farce of a Reserved Presidential elections.

You have the executive branch aka the govt. that forms a committee called the Presidential Elections Committee, headed by govt appointees like head of PSC Eddie Teo. This committee then decides who can and who cannot be the President. Therefore, the President (who belongs to the legislative branch by virtue of his chief duty, which is to sign bills into law) is determined solely by the executive, a direct conflict and it makes the President beholden to the executive. The requirement that the President cannot belong to any political party is a facade made to create some semblance of separation of state. Halimah resigning from the PAP to run for the EP after decades of being a PAP member is not fooling anyone, after all a leopard cannot change its spot overnight. The whole system is rigged on multiple levels by the PAP. Old Fart thought he was very smart to set up such a system because he thinks the PAP has the monopoly on intellect, talent, and ideas. But we can all see, this is not the case. We will have to pay for it after his death.

I am sure MINDEF will produce a letter asking him to report for reservist knowing full well that he will not. That will be an additional charge on him for avoiding reservist.
