This should surprise no one, but there is total silence in the state media on yesterday's egregious police harassment of Roy Ngerng and Teo Soh Lung.
People said of Benjamin Lim, "But there've been so many investigations, and he's the only one where this happened!" Well, he's the only one you know of, because the state media is worse than useless on questions of civil liberties and due process. And you know about him only because TOC forced their hand.

People scoffed, "This is Singapore; cover-ups don't happen!" Which gets it exactly backwards. This is Singapore, and the cover-up is so complete you don't even notice.

Statement by Community Action Network (CAN) on the actions by the police against Roy Ngerng and Teo Soh Lung's alleged violation of the Parliamentary Election Act during the recent Bukit Batok By-election. (read here)

Community Action Network (CAN) calls for an end to the harassment of Roy Ngerng and Teo Soh Lung, who are under investigation following police reports filed by the Elections Department alleging that they had breached Cooling-Off Day rules during the Bukit Batok by-election.

Ngerng and Teo have both been subjected to long interviews in police headquarters this morning. The police then proceeded to search both their homes for over two hours. During the search, they were not allowed to make any phone calls.

The Elections Department's own website states that the Cooling-Off Day rules do not apply to the "transmission of personal political views by individuals to other individuals, on a non-commercial basis, using the Internet, telephone or electronic means". Ngerng and Teo's posts on their personal Facebook pages fall under this exception.

This is police harassment; as Singaporean citizens Teo and Ngerng are entitled to share their personal opinions on political issues. This should not be treated as suspicious, much less a crime warranting long interrogations and

[FONT=open_sansregular]The Workers’ Party (WP) has expressed its concern on the manner which the investigations into the alleged violations of Cooling Off Day regulations were being conducted.

This was after witnesses shared video footage of several police officers conducting the search and seizure process of lawyer and former Singapore Democratic Party (SDP) candidate Teo Soh Lung’s laptop and other electronic devices at her home.

Last Friday afternoon (May 27), the Elections Department (ELD) announced that they have reported three parties to the police for allegedly violating cooling-off day restrictions during the recent Bukit Batok by-election.

They included socio-political site The Independent Singapore, former Singapore Democratic Party candidate and former Internal Security Act detainee Teo Soh Lung, as well as blogger Roy Ngerng:

WP “urge the authorities to ensure that consistency and proportionality are applied to all investigations, as these are key to maintaining confidence in Singapore’s law enforcement organisations and legal system.”

SDP CALLS FOR FAIRNESS IN IMPLEMENTATION OF COOLING-OFF DAY REGULATIONS

It is unfortunate that the Elections Department (ELD)which works from under the Prime Minister's Office (PMO) has chosen to file reports against Mr Roy Ngerng and Ms Teo Soh Lung when countless other individuals have posted material related to the by-election in Bukit Batok.

This includes PAP candidates such as Dr Vivian Balakrishnan and Ms Tin Pei Lin in previous elections.

The Department must not only discharge its duty in a non-partisan manner but it must also be seen to do so.

The SDP reiterates our call for the ELD to function and operate independently from the PMO and for an independent elections commission to be established so that breaches of campaign rules and regulations can be investigated without fear or favour.

Only then can elections in Singapore be genuinely free and fair. Currently, Singapore's electoral process is considered by international standards to be far from democratic and transparent.

The report against The Independent website must also be called into question. According to the ELD, Cooling-off Day is described as a “24-hour campaign silence period is to give voters some time to reflect rationally on issues raised during the election before going to the polls.”

Yet, for some reason, newspapers and television are exempted from this ruling and, as a result, very partisan and biased views have been aired in the local pro-PAP traditional media without allowing affected individuals the right of reply.

A good example is the publication of a statement by Dr Derek da Cunha in the Straits Times which cited untrue statements by Mrs Lina Chiam critical of Dr Chee Soon Juan. This was done on Cooling-off Day of the recent by-election which meant that Dr Chee could not respond lest his remarks be construed as campaigning and therefore contravening regulations.

This is manifestly unfair and contradicts the spirit of the law governing the cooling-off period. It is necessary to emphasise again that laws and regulations must apply equally to all and not used to favour one party at the expense of another.

We look forward to justice taking its course in this case and election laws being rationalised to treat all individuals and media fairly.
