Chinese official gets longer jail term for child rape

A former county official was sentenced to eight years in prison for the rape of a four-year-old girl, three years more than the previous sentence.

The People's Court in Daguan County in southwest China's Yunnan Province, on Friday announced the extended prison term for Guo Yuchi, a former official of Daguan, three days after an in camera retrial.

Guo got five years at a trial in September but his "lenient" sentence caused public outcry. A statement from the court Friday said Guo deserved a harsher penalty because he was a public servant. The original sentence was "inappropriate," said the statement.

The criminal law stipulates between three and ten years for rape of a female. If the victim is under 14, the offender should be given a heavier sentence within the range.

But the offender could face a jail term of over ten years, life imprisonment or death penalty if he takes part in a gang rape, rapes multiple victims or causes serious injuries or death of the victim, said Hong Daode, a professor with China University of Political Science and Law.

The court noted that the new sentence took into consideration that Guo candidly confessed during police interrogation and compensated the victim's family. The original verdict rejected compensation for the girl's family, but Guo later agreed to pay the family 150,000 yuan (24,660 U.S. dollars) in compensation.

The victim's mother said the new sentence is "lighter" than her expectation, but the family have not decided whether to appeal.

On Oct. 24, the Supreme People's Court, the Supreme People's Procuratorate, the Ministry of Public Security and the Ministry of Justice jointly announced a guideline on tougher penalties for public servants involved in sexual offenses against minors, after a spate of child abuse cases by government employees and teachers.

Former headmaster arrested for raping student

A former headmaster in northwest China's Shaanxi Province has been arrested for allegedly raping a female minor in his school, local authorities said yesterday.

The former headmaster, surnamed Liu, was accused of raping the student in March 2012. But he had not been arrested until last week. The local publicity office declined to explain why it took more than a year to make the arrest. The age of the victim was also not disclosed.

Liu, now in his 50s, served as headmaster of a school in Ningshan County for 10 years. He was transferred to the county's education bureau in 2012.

A string of school rape and molestation scandals sparked public outcry earlier this year. In June, a headmaster in the island province of Hainan was sentenced to 13 and a half years in jail for rape, after a news report saying he and a county official took six girls to a hotel went viral online.

The former chief cashier of the Shop N Save Supermarket in Ang Mo Kio Avenue 5 was jailed for six months on Monday for misappropriating $18,556 of the store's earnings. A district court heard that Siti Nooryani Mohamed Yunos, 29, siphoned the money between September 2012 and February this year.

In the beginning, she would embezzled a small portion of the store's takings that she would deposit in the store's bank account. However, she grew greedy and kept $4,444 on Feb 18 this year. The next day, she misappropriated $3,947.

Two days later, she was confronted by Mr Larry Peng Qing, 33, who was in charge of the store then. After she admitted to misappropriating the $8,391, he told her to stay in the office while he called the police but she fled the scene and went into hiding.

She was arrested on Aug 24. Investigations had revealed that she had misappropriated a total of $18,556, which she spent on personal expenses and to pay off loans. She pleaded guilty yesterday to committing criminal breach of trust. Shop N Save outlets were rebranded as Giant stores in April this year.

An Immigration and Checkpoints Authority (ICA) specialist who took and gave bribes to grant social visit passes to various foreigners to enter Singapore was jailed for 21 months on Monday. Corporal Mohammed Mustaffa Mohabat Ali, 29, admitted to 12 of 35 charges of corruption. He was ordered to pay a penalty of $8,050 or in default, sentenced to four weeks' jail.

A district court heard that Mustaffa, who was attached to Tuas checkpoint, met a Filipino woman at a pub in Paramount Hotel in 2010. He agreed to help her "extend'' her social visit pass by getting a new pass for 30 days for a fee.

Through the unidentified Filipina, he met Philibert Tng Hai Swee who told him that he knew of foreigners who were willing to pay him money to for the pass. Mustaffa charged between $250 and $450 per extension. After each successful transaction, Tng would collect payment from all the foreigners concerned, and keep $50 per person for himself before passing the rest to Mustaffa. Mustaffa also assisted foreigners who contacted him directly, charging them $300 to $500 for every pass extension.

A total of 33 foreigners, comprising females from the Philippines and Vietnam, participated in Mustaffa's scheme. Mustaffa knew they were working illegally in Singapore.

The Chinese government rarely holds families accountable for infanticides, selling children, or any of the grisly practices that occur as a result of its one-child policy.

And why would it? The Chinese government routinely brags about the astronomical number of unborn children it has killed in abortions and forced abortions in a push to lower its population figures.

Those abortions — the culture of a preference for boys — have relegated girls to an inferior status and the phenomenon has given rise to enormous problems such as sex trafficking, prostitution, and, in this case, the sale of girl babies.

Yet, the Washington Times reports on one couple that are facing their day in court as a result of their horrific actions:

A man and woman in China were in court on Friday, defending allegations they sold their baby girl to go on a shopping spree that included the purchase of an iPhone and top-of-the-line footwear.

The Telegraph reported that the couple, known only as Mr. Teng and Ms. Zhang, admitted the baby was given to another family — but they claim it was given away not for money.

“We did not give the baby away for money but in order to give it more security” with a family that could provide an education, they said, The Telegraph reported.

The woman gave birth at home, and shortly after began to post an online advertisement for someone to take her daughter. Prosecution in court said their ad stated they would consider parting with the child in exchange for 50,000 yuan — about $8,200. After the baby was born, they delivered her to one of the advertisement responders, prosecutors said. That same day, The Telegraph reported, the couple’s bank account reflected a large cash deposit.
Prosecutors call the transaction a “sinister conspiracy” to sell the baby and say credit card bills from the couple seized after the money was deposited show several purchases: The pair went on an Internet shopping spree that included buys of an iPhone and “high end” luxury trainers, The Telegraph reported, citing court testimony.

Prosecutors also say the sale of the baby was planned far in advance, claiming the woman actually tried to hide her pregnancy and that she told neighbors her baby bump was actually a tumor.

Desperate Chinese boy, 17, sells kidney for £2,000 to buy an iPad and iPhone

Five people have been charged with intentional injury to a Chinese teenager who was so desperate to buy an iPad and iPhone that he sold his kidney for just over £2,000.

The accused, from southern China, include a surgeon who removed a kidney from a 17-year-old boy in return for around 220,000 yuan - just over £20,000.

Prosecutors in Chenzhou city, Hunan province, said one of the defendants received the money to arrange the transplant. He paid the teenager, identified only as Wang, 22,000 yuan - just over £2,000 - and split the rest with the surgeon, the three other defendants and other medical staff.

Woman in China selling hugs to buy iPhone 5

Kuala Lumpur, Dec 14 (ANI): A woman from Xiamen in China has resorted to selling hugs on the street just to buy an Apple iPhone 5, it has been revealed.

According to Malaysian Chinese newspaper Kwong Wah Yit Poh, the woman, whose name was not revealed, stood by the side of a busy road in the city on Monday and was holding a placard written with words "10 yuan (RM5) for a hug, to collect money for an iPhone 5," the Star Online reported.

Her actions attracted curious onlookers and 10 minutes later, three people hugged her.

A man took a picture with her instead as he felt too shy to give her a hug, the paper said.

The incident became a hot topic among Netizens on social networking site Weibo, with some branding her as "a materialistic girl who would sell herself for luxurious pleasure." (ANI)

Incest man killed by kin

A man who insulted his wife and sexually assaulted his daughter and granddaughter
was murdered by his outraged family members who dumped his dismembered body in Hexian County, eastern Anhui Province.

Zhang Shimin, a resident of Nanjing in neighboring Jiangsu Province, often scolded and beat his wife Wu Baodi, 65, and threatened to kill her.

He also raped his daughter and granddaughter and had sexual relationship with his daughter-in-law, said the Hexian County People's Court. Hexian is separated from Nanjing by the Yangtze River.

His wife could no longer bear his heinous acts. Instead of calling police, Wu asked a man named Liu Qiangjun to kill her husband and promised to marry her daughter Zhang Xiaoxia to him, the Jinling Evening News reported today.

One night last September Liu went to the man's bedroom and hit him to death with a rod while he was drunk. Wu then dismembered his body and with the help of his daughter threw the body parts over a bridge in Hexian County.

The court convicted Wu, Zhang and Liu of intentional homicide. Liu was sentenced to 15 years in prison. Wu and her daughter were sentenced to 12 and four years respectively, the paper said.

KAJANG: A petty trader has claimed trial to having sex with his daughter, who is 25 years his junior.

Teoh Boon Huang, 46, was charged in the Sessions Court here Tuesday with having sex with the 21-year-old in their home in Taman Cheras Perdana, at 3am on Oct 23.

When asked for his plea in Mandarin, Teoh was seen hesitating, requiring the interpreter to prompt him three times before he pleaded not guilty.

Teoh, who was wearing a beige shirt and brown cargo pants, remained silent and stared at the floor throughout the proceedings.

He faces up to 20 years prison and whipping, if convicted under Section 376B of the Penal Code, for incest.

Under Section 376B, a person is said to have committed incest if he has sexual intercourse with another person whose relationship to him is such that he is not permitted to marry her under the law, religion or custom.

Deputy public prosecutor Siaw Chooi Chin urged the court not to offer bail.

Counsel Douglas Yee did not object as he said his client could not afford bail anyway.

Judge Nor Hazani Hamzah denied bail and set Dec 24 for next mention.

The Star reported on Thursday that the man had allegedly been having sex with his daughter in their home in Kajang whenever his wife was not around.

An uncle, who runs the hair salon where the daughter had been working, suspected something amiss after seeing steamy text messages exchanged between them.

The daughter then admitted to having consensual sex with her father since she was 18.

The abuse of China's 'left-behind' children

Millions of migrant workers have to leave their children in their home villages

A series of disturbing revelations in China's state media about the sexual abuse of school children has exposed the dark side of life in rural areas where parents leave their homes to earn money as migrant workers.

On 8 August, a 62- year-old man was detained by police in the city of Ruichang, Jiangxi province, for sexually abusing seven girls. The details of the case are horrifying.

The man was working as a school teacher in a remote mountainous region and between September 2012 and May 2013, he molested seven pupils aged eight or nine in a room at the back of the class, saying that he was just checking homework.

The girls were left with sexually transmitted diseases. Their parents were all migrant workers, Chinese media reports say.

The man has admitted the crimes and police are still investigating the case. It emerged just days after another primary school teacher was arrested in Shanxi Province, in central China, on suspicion of molesting several pupils.

Analysts monitoring such cases of abuse say these reports are probably just the tip of an iceberg.

In May this year, no fewer than eight cases of sex abuse in schools were exposed within a span of 20 days, causing alarm among parents, disgust and anger on social media and in many editorials on official media.

Teacher abusers

"Behind every reported sex abuse case, there might be six hidden cases unreported," says Wang Dawei, a well-known criminologist in the People's Public Security University of China. He believes that many children might not realize that a sex crime has been committed against them and therefore might not even tell their parents.


The children of many migrant workers are cared for by their grandparents
One such case emerged in May when a teacher was detained in the city of Shenzhen, Guangdong Province, for molesting four girls. But this case only surfaced when one of the victims told her father in passing that she had massaged her teacher's back at school.

Analysts have identified some key trends. According to Han Jingjing, director of a Beijing-based legal centre for young people, 60% of the sex abuse cases happen in rural areas and 70% happen at schools; the victims tend to come from single families, families that went through divorces and re-marriages, or where mothers are in prison.

National figures on such crimes are difficult to come by, but according to Ms Wang Xingjuan, founder of The Maple Women's Psychological Counselling Centre in Beijing, Guangdong province alone dealt with more than 1,700 sex abuse cases involving children from 2008 to 2011.

But what has angered many is the involvement of the most responsible carers outside of the home, school teachers, in these cases

In June a primary school principal in Hainan Province was sentenced to 13.5 years in prison for raping six female pupils in a local hotel. Among the cases reported in May was that of a 56-year-old man in Henan province detained for molesting several pupils in his charge and threatening them and in Hunan, another teacher was detained for abusing several girls.


These cases have shocked the nation and Chinese social media is simmering with anger, frustration and questions.

"Are they animals"? "Don't they have daughters?" That's the view of one netizen on Tencent Weibo - the Chinese micro-blogging website.

Mother 0315 posts on Sina Weibo: "I always thought of teaching as a noble vocation, but now I feel a teacher is worse than animals. As a mother, I can feel the pain of the victims and their families."

Zuoxingzhan laments the general moral decline of the nation: "Nowadays, teachers are sex abusers, doctors sell babies, judges fool around with prostitutes…… since when did moral standards slip from these once-respected occupations?"

'Left behind children'

But there is also another facet to these cases that is less commented on.

School children in rural areas are particularly vulnerable if their parents happen to be migrant workers who spend a long time working away from home. They often don't get to visit regularly and the children are left to be looked after by relatives, such as grandparents.

A recent report by the All China Women's Federation, the official union for Chinese women, suggests that 37% of children in the rural area belong to this category of so-called "left behind children", and sexual abuse is a major threat.

At a July conference held in Beijing in response to the spate of sexual abuse cases reported in the official media, experts point out that the increase in cases can also be blamed on the poor quality of sex education and inadequate guidelines for children on how to respond to such situations.

"Some children are molested when they are about seven or eight, but they don't realise that they have been abused", observes Wang Xingjuan, founder of the Maple Women's Psychological Counselling Centre. "They are not comfortable with the situation; they are afraid and they know there is something wrong, but they put up with it".

"Children should be educated enough to know that in such situations, they can say no, they can cry, they can shout, and they can leave - all these are self-protection methods", says lawyer Liu Liwen.

A recent survey carried out by the Maple centre reveals that many schools don't educate pupils about sexual offences, and even sex education classes made mandatory by the Ministry of Education are not carried out properly, with many schools simply going through the motions and some even asking the students to read the textbooks themselves at home.

But things are no better at home, as traditionally, adults don't talk about sex with their children. The "absent mothers" situation makes this even worse.

How the legal system should protect vulnerable children and punish the culprits is another area for debate. According to the criminal code, people who have committed multiple acts of sexual abuse of underage children should get 10 years or longer in prison.

Recently a school principal accused of sexually abusing four girls had his sentenced increased by six months to three years. The victim's family still thinks it is too lenient and are looking for a sentence of at least five years in prison.

There will be a further hearing later this year. After this latest spate of cases, people will be watching

The parents of a four-year-old girl who was raped by a former county official said on Tuesday that they will not appeal the offender's eight-year prison sentence.

The People's Court in Daguan County in southwest China's Yunnan Province, announced on Dec. 6 that the prison term of Guo Yuchi, a former official of Daguanan, would be increased to eight years from five.

Guo received five years of imprisonment at a trial in September, sparking a public outcry.

The criminal law stipulates between three and ten years for rape of an adult. If the victim is under 14, the offender should be given a heavier sentence within that range.

The victim's mother said although the new sentence was "lighter" than she expected, to avoid further impact on her daughter, the family decided not to appeal.

"We will try to start our new lives as soon as possible. We want to say thank you to all the people who have given attention to the case," said the mother.

The original verdict rejected compensation for the girl's family, but Guo later agreed to pay the family 150,000 yuan (24,660 U.S. dollars).
