The Malaysian Insider) - Top PAS strategist Dr Dzulkefly Ahmad described the recent Syariah caning of three women for illicit sex as politically-motivated, cautioned his party against being baited in the issue by rival Umno.

The Kuala Selangor MP said Islam true teachings meant a system of justice and fairness for all without cruelty and corruption, adding those caught for any offence must be able to exhaust all avenues before getting punished.

“It is obvious the canings are politically motivated. PAS and Pakatan must not allow itself to take the bait,” Dzulkefly said in a statement released in the PAS party organ website Harakahdaily when commenting on the caning.

Home Minister Datuk Seri Hishammuddin Hussein announced on Wednesday that three Muslim women found guilty of engaging in illicit sex had been caned under the Syariah law — the first time women in the country have been punished this way.

The caning at 10am on Feb 9 was carried out the Kajang Prison where two of the women were given six strokes of the rotan, while the third was hit four times. The minister did not specifically say their partners were caned but added four men also received the punishment.Dzulkefly noted that Malaysia has parallel legal systems — civil and Syariah, which he said stressed on open and fair trials to prevent mistakes in carrying out punishments.

“Currently, the civil courts are more established but while PAS supports the further development of the Syariah courts, the most important thing is that at the end of the day, Malaysia is governed by law and order.

“As a responsible Islamic party, PAS is not only committed to Pakatan but to the true teachings of Islam. And true teachings of Islam means a system of justice and fairness for all, without the cruelty and corruption, the cronyism and abuse of power, the looting of the country’s coffers and the abandonment of ethics and principles that are now the signature of the current administration,” he added.

KUALA LUMPUR, Malaysia — Three Muslim women who were the first in Malaysia to be caned for illicit sex feel the penalty was an opportunity for them to repent, media reports said Friday.

Prison authorities caned the women on Feb. 9 after an Islamic Shariah court issued the penalty. The caning has outraged rights groups and revived speculation that conservative Islamists, who advocate harsh punishment, are gaining influence.

The three women, aged 17-25, said they turned themselves in after feeling guilty for sleeping with their boyfriends before marriage and getting pregnant, The Star and the New Straits Times newspapers reported.

The 17-year-old told reporters that she surrendered to Islamic authorities after her prematurely born child died. She is now serving a six-month prison sentence.

“I know I have sinned, and I have to be punished. Strangely however, I felt that the caning was not a form of punishment but was an opportunity for me to repent and return to the right path,” The Star quoted her as saying.

She has already married her boyfriend, who has also been caned and jailed over the offence. The other women, who have one young child each, are planning to marry their partners, who have also been caned, after they are released.


One, aged 25, said she was scared before the caning but knew she deserved the punishment. All three women called on others not to make the same mistake and abstain from sex before marriage.

A Prison Department official confirmed the women’s comments, made at a news conference at the women’s prison outside Kuala Lumpur to local, government-linked media under the watch of authorities. He said they were reluctant to speak to other media. It could not be confirmed whether they were speaking voluntarily. A request with the department for interviews is pending.

Deputy Prime Minister Muhyiddin Yassin defended the caning Friday, saying it was “far lighter” than what some people might imagine.

“The punishment is legitimate and in accordance with the law,” Muhyiddin was quoted as saying by the national news agency, Bernama.

Human rights groups have slammed the caning, saying it is a cruel and degrading punishment and discriminates against Muslim women because Malaysian civil law — which applies to non-Muslims — bans the caning of women.

The women, who were fully clothed and sitting on a stool, received between four and six strokes with a thin rattan stick on the back, lasting a few minutes.

Another woman, Kartika Sari Dewi Shukarno, is still waiting to be caned for drinking beer in public. Her case received international attention last year when she became the first woman slated to receive a caning penalty. But the punishment was deferred indefinitely amid a public outcry.

Caning of men for such offences as rape, drug smuggling and staying illegally in the country is common. It is administered with a thick rattan stick on bare buttocks, causing severe pain and leaving scars.

Malaysia has a two-tier justice system. Shariah courts deal with personal matters for Muslims, who account for about two-thirds of the country’s 28 million people, while non-Muslims — many of whom are ethnic Chinese and Indians — go to civil courts.

The recent caning of three Muslim women for allegedly participating in illicit sex is the latest in a series of events flooding Malaysia in adverse worldwide spotlight inimical to our international image and competitiveness in the ten months Datuk Seri Najib Razak has taken over as Prime Minister of Malaysia.

Before I came, I googled the two words “malaysia caning” and there were 257,000 search results. I next added another word to google the three words “malaysia muslim caning” and the finds multiplied by 30 times to return 6.45 million results.

Malaysia cannot continue to be in adverse international spotlight if we are to restore our international competitiveness by regaining national and international confidence in good governance; the rule of law; a democratic, progressive and model multi-racial, multi-cultural and multi-religious modern nation to be ideal destination for FDIs, haven for tourists and hub for international students.

There had been a series of adverse publicity for Malaysia world-wide since Najib became Prime Minister negating all his efforts to project a new slogan, 1Malaysia – such as the divisive “Allah” controversy, the sacrilegious burning of churches and attacks on mosques and other places of worship; the 5-0 Federal Court judgment seeking to legalise the undemocratic and unconstitutional ouster of Datuk Seri Nizar Jamaluddin in the Umno power grab in Perak; the mysterious death of DAP aide Teoh Beng Hock at Malaysian Anti-Corruption Commission headquarters last July, the recrudescence of dangerous politics of race and religion, like the irresponsible campaign to falsely and viciously paint the Penang Chief Minister Lim Guan Eng and Penang Pakatan Rakyat state government as anti-Malay and anti-Islam etc.

We are thankful that this morning in Batu Pahat, the baby of Teoh Beng Hock has been born and both the mother and baby boy are safe. Malaysians of goodwill and good heart, regardless of race or religion, not only wish both of them well but want those responsible for Teoh Beng Hock’s death to be brought to justice without any delay.

But the question that must be uppermost in the minds of thinking Malaysians is why the new Prime Minister seems to be so helpless that he is not only incapable of checking these adverse developments for Malaysia, he could not even get Umno and Barisan Nasional solidly behind him to give unequivocal support to his 1Malaysia campaign.

The vicious campaign to falsely paint the Penang Chief Minister and Penang Pakatan Rakyat state government as anti-Malay and anti-Islam is indeed a great test for Guan Eng and the PR Penang State Government.

But what is little realized is that it is an even greater test for Najib and the Barisan Nasional – Umno, MCA, Gerakan, MIC and the Sabah and Sarawak component parties – whether they are serious about the 1Malaysia slogan and concept.

If ever there was a case of hypocrisy and double standards about the caning of women, this must be one of them. It is despicable and crass and just shows how we are tumbling headlong into an abyss of sanctimoniousness and moral decay.

The news about a 15-year-old Malaysian teenager, by the name of Salsabila Yunan aka Bella has just broken, in the mainstream papers. Salsabila who calls herself an actress, ran off with an Indonesian man from Lombok. They are now married and she is 6 months pregnant. She has not even finished her PMR examinations. Her father was quoted as saying that Umno Youth had traced her and brought her home. Although he is grateful to them, she is unrepentant about her marriage. She says she would like her husband to come to Malaysia and look after her and the baby, and has asked for help from Umno and the Malaysian embassy in Jakarta, to furnish her husband with the appropriate travel papers.

First. This girl is underaged. Therefore, her husband, whose age we are not given, had sex with a minor. Even if it was consensual sex, it is still statutory rape. She could even have been 14 years old when she was made pregnant. In the recent debacle of three women being whipped, for illicit sex, the youngest woman was 17 years. Are we to understand that as Umno Youth were involved, this 15-year-old will escape punishment?

Second. How did she obtain the travel papers/documentation to go abroad? Even when I go overseas on holiday, with my young nephews and nieces accompanying me, I have to carry letters from their parents to say that I have not kidnapped these children (they have their own passports). Or are the immigration authorities only particular in western countries? If so, we need to upgrade our immigration policies.

Third. This 15-year old calls herself an ‘actress’. In the recent case of the three young women who were whipped recently, we are not told their backgrounds or professions, but the implication was that they were stay-at-home types, thus nothing as glamorous as this teenage celluloid celebrity. Are we to come to the conclusion, that Malaysia syariah justice considers housewifely types more punishable than so-called actresses? Or does Umno Youth’s involvement have a strong influence on who gets whipped or not?

Fourth. Both the Malaysian Embassy and Umno have been asked by Salsabila to help her husband with his documentation. I agree. Just prepare the international arrest warrant for him. Actually, why not just let the Indonesians arrest him and let him languish in an Indonesian jail. That might save our foreign embassy some money, on air-fares and custody costs.

Five. This girl seems more upset that she has been dragged home because her father is ill. She sounds very ungrateful and more concerned about her husband’s well-being. Maybe she should have been left in Lombok.

The recent whippings have highlighted many irregularities in our syariah laws. The Malaysian authorities seem unfazed by the domestic and international condemnation s. And naturally, those of us who question certain aspects of this punishment, risks being labeled as trouble-makers or anti-Islam.

Nevertheless, we watch with interest if this 15-year old, who was rescued by Umno Youth, will receive the same treatment as the three women who were recently whipped. Its early days yet and she may of course, give herself up voluntarily to the authorities, out of guilt, just like the other three did. But, let’s not hold our breath.

MALAYSIA'S largest English-language newspaper has spiked a prominent commentator's column on the caning of three Muslim women, weeks after it got into trouble with the government over a similar article by one of its editors.

Social activist Marina Mahathir said The Star refused to publish her weekly column on Wednesday because of concerns that such sensitive articles could jeopardize its printing permit. All publications in Malaysia must renew their printing licenses each year to operate.

The Star got into trouble over a Feb 9 opinion piece by managing editor P. Gunasegaram, a non-Muslim, who criticised the caning of the women for sex outside of marriage, saying it undermined individual rights. The Home Ministry threatened action against The Star, saying the article might harm public order. The newspaper withdrew the article and issued an apology.

Marina, the daughter of former Prime Minister Mahathir Mohamad, wrote on her Internet blog that the law requiring publications to renew their license every year holds them hostage to the government. 'But still there is room for courage, to stand up for freedom of speech. If we capitulate every time, then why bother publishing at all?' she wrote.

Star editors could not immediately be reached for comment. The ministry's threat against The Star has fueled concerns that conservative Islamists appear to be gaining influence over the government in the Muslim-majority country. Malaysia has long been seen as a model of a moderate and progressive Islamic society.

Marina said censoring the print media is pointless. 'What is the point of censoring the mainstream media when there is the freewheeling Internet? The other point we should make to people like The Star is, what is the point of constantly sucking up to the government when they can still turn around and bite you?' Marina said. -- AP

reflected Umno's political tactics.



KUALA LUMPUR: The caning of three Muslim women in 2010 under the syariah law for committing adultery was a tactical manoeuvre undertaken by Prime Minister Najib Tun Razak’s new administration to retain the conservative Malay voters, Malaysia-based US diplomats believed.

They also felt that the caning of the three women was perhaps an attempt by Najib and his party Umno to test the waters to forecast the sentiments on part-time model Kartika Sari Dewi Shukarno’s caning for beer-drinking.

Kartika was found guilty by a Pahang Syariah Court in July 2009 of drinking beer at a hotel in Kuantan and was sentenced to six strokes of rotan and a fine of RM5,000.

The court’s finding to cane her attacted wide attention, both from within and internationally, and the ruling had taken place just a year after Najib had become the prime minister. While her caning was pending for months for various reasons, the three women were caned in February 2010.

“Kartika’s case put Prime Minister Najib’s new administration in the difficult position of balancing the competing forces fighting for Malaysia’s Muslim identity.

“While concerned about preserving Malaysia’s image as a moderate Muslim state, Najib has been unwilling to date to criticise syariah law or otherwise downplay the seriousness of Kartika’s offence for fear that it could damage Umno’s Islamic bona fides,” wrote a senior political officer based in the US embassy here in a confidential cable to the US State Department in Washington.

Details of the confidential cable sent in 2010 were leaked by WikiLeaks to popular blogger Raja Petra Kamarudin who had published the cable in his Malaysia Today website today.

“That the GOM (government of Malaysia) chose to cane three anonymous women, rather than the internationally renowned Kartika, seems to be a tactical manoeuvre by Umno to retain or lure back conservative Malay voters as well as perhaps a testing of the waters presaging Kartika’s caning.

“That Najib feels the need to placate the most conservative Malays suggests that his stated intent to change to a more inclusive, less Malay-centric economic and political model is facing considerable, resistance within his own coalition,” added the cable.

The cable must have been sent to the State Department immediately after the caning of the three women on Feb 9, 2010 as it makes no mention of the eventual outcome of Kartika’s case. Following the intervention of the Sultan of Pahang, Kartika’s caning sentence was eventually commuted to 20-day community service in April 2010.

The three women were sentenced to be caned for committing adultery in violation of Section 23 (2) of the Kuala Lumpur Federal Territory Syariah Criminal Offences Act of 1997.

Home Minister Hishammuddin Hussien had announced on Feb 17, 2010, that government officials had caned three Muslims on Feb 9, 2010. The three women were believed to be the first women to be caned under the law in Malaysia.

Two of the women received six strokes of the cane and the other received four. The women were caned in a female prison.

The US cable noted that the sentencing of women to such corporal punishment under syariah law contradicts the federal law outlined in Section 289 of the Criminal Procedure Code that states that women are not to be subject to caning.

“In the current case, the three women, previously unknown to the public, were caned and the public was not informed for over a week.

“The canings were administered by federal prison officials in a federal women’s prison. This gives rise to a possible violation of federal law that the GOM has yet to explain or address,” added the cable.

The US cable also said that federal government was clearly playing a role in meting out a syariah punishment, with Hishammuddin “sounding like an Islamic cleric” in justifying the caning on the three women.

“The federal government has highlighted its role in meting out these sentences, indicating that the decision had Najib’s support.

“Hishammuddin placed himself at the forefront of this issue, announcing on Feb 17 that the women had been caned, commenting that ‘the punishment is to teach and give a chance to those who have fallen off the path to return and build a better life for the future,’ sounding much like an Islamic cleric,” said the cable.

The US diplomats noted in the cable that Deputy Prime Minister Muhyiddin Yassin also failed to address the legal issue surrounding the caning of the three women, and had instead focused “on the need to explain that syariah caning is ritualistic rather than severe”.

The cable further pointed out that the federal government’s role in caning the Muslim women was also evident in a statement issued by minister in charge of religious affairs Jamil Khir Baharom who had reportedly said that the women were remorseful and “welcomed their sentence”.

Women, Family, and Community Development Minister Shahrizat Jalil was also reported to have said: “As the minister in charge of women affairs in this country, I really hope that the whipping sentence on Muslim women will be carried out fairly and judiciously.”
