An Indian national refugee who attempted to sexually assault a man in his 20s he met on the street has been sentenced to a prison term.
According to legal circles on the 7th, the 13th Criminal Division of Uijeongbu District Court (Presiding Judge Oh Yoon-kyung) recently sentenced A, an Indian national charged with quasi-rape, to four years in prison. Alongside this, the court ordered a five-year employment restriction at institutions related to children, adolescents, and people with disabilities.
A was referred to trial on charges of attempting quasi-rape against B, a man in his 20s, around midnight in September of last year on a road in Pocheon, Gyeonggi Province.
At the time of the crime, A approached B, who was walking, and asked, “Where are you going?” while offering to drink beer together.
After the drinking session, when B left first to return home, A followed him and kissed him.
Startled, B fell down, and A climbed onto him to restrain his movement and attempted sexual assault.
A had entered South Korea on a short-term visa in 2022 and obtained residency status through the refugee application process until April of this year.
During the trial, A denied the charges, stating, “There was mutual consent for the kiss, but no quasi-rape occurred.”
However, the court rejected A’s claims, citing the victim’s consistent testimony and the lack of motive or reason for him to make false statements unfavorable to the defendant.
Additionally, A’s DNA found on B’s underwear and surveillance camera (CCTV) footage recorded during the crime served as grounds for conviction.
The court stated, “The nature of the crime is extremely serious as the quasi-rape attempt occurred right in front of the victim’s residence. The defendant denies the crime, shows no reflection, and has not been forgiven by the victim.”
