Man, 42, rapes intoxicated woman, 33, after stalking her for 45 mins in Holland Village
He and his friend offered the victim and her friend a ride home.

A 42-year-old man in Singapore was found guilty on Sep. 22 of raping an intoxicated woman whom he followed for about 45 minutes in Holland Village.
The incident occurred on Jan. 30, 2021.

In his defence, Dhanabalan Fok Jin Jin told the court that the victim, who was 33 years old at the time, had consented to sex, The Straits Times reported.
The rape occurred in the woman's condominium unit.
According to Shin Min Daily News, the victim is an Australian and a single mother.
High Court Judge Valerie Thean ruled after a trial that the victim was unable to give consent and did not consent to sex with Fok, ST reported.
Fok had been waiting to prey on the victim and her friend, the judge found.
Victim and friend could not get transport home
The victim was with six friends at Dempsey Hill to celebrate her birthday on Jan. 30, 2021.
They subsequently went to a bar at Holland Village and she consumed at least three margaritas and two shots of tequila.

The group left the bar when it closed and wanted to go to one of their homes to continue partying.
The victim and a friend could not book a private-hire vehicle and did not manage to hail a taxi.
Offered a ride
Fok and a friend, Lee Kit, 36, approached the two women and offered them a ride.
The victim initially declined but took it as she assumed that she would not make it back home if she turned it down, Shin Min reported.
The two women vomited and fell asleep in the backseat of the car.
The victim was brought back to her home and she took a minute to find her access card.

Lee used it to open the gate.
The court heard contrasting versions of what happened in the unit, but Fok did have sex with the victim and Lee performed a sex act on her.
Lee, who testified as a prosecution witness during the trial, said Fok wanted to follow the two women because they were drunk.
One woman not assaulted
The victim’s friend was lying on the same bed.
She was not sexually assaulted.
The victim was sexually assaulted between 11:50pm and 12:10am.
Left phone behind
Fok and Lee drove off after leaving the apartment.

In the car, they discussed whether they could get in trouble with the law.
Fok then realised his mobile phone was still at the woman’s home.
The duo returned to the condominium and tried to persuade the victim to return the phone.
She called the police instead.
What court heard
Surveillance footage of the two men stalking the victim and her friend between about 10:45pm and 11:30pm was played in court, ST reported.
Fok’s lawyer argued that the victim provided her address and helped her friend, who could not walk, to the lift lobby, and there was a lack of evidence to ascertain that she could not give consent.

Judge said perpetrator was not consistent
The judge said Fok's account of what happened in the bedroom was not consistent.
Fok had denied having sex in the bedroom, but then admitted to it after audio recordings from his in-car camera captured him saying he was worried about getting caught.
He said he denied it as he was “scared” that his wife might find out about him having sex.
Fok also told the police that the woman started touching him while they were kissing on the bed.
At trial, he said he kissed the woman to ascertain whether she was interested in sex after she began stroking his thigh.
The judge said Fok's lie showed his guilty conscience.

Fok will be sentenced at a later date.
In March 2024, Lee was already sentenced to 20 months’ jail and four strokes of the cane after he pleaded guilty to molesting the same woman.
