This would never happen under Lee Kuan Yew. He would have put the Borneo High Court judge into detention under ISA for Sedition and Treason. Sabah would have avoided this fiasco if it had agreed to a merger with Singapore along with Sarawak and Brunei back in 1960s as a counter to the UMNO shenanigans.

File review to stop Sulu sultanate payments for Sabah, A-G urged

MARCH 16, 2013

KUALA LUMPUR, March 16 – Attorney-General Tan Sri Abdul Gani Patail should quickly file for a court order to nip the annual rent Malaysia pays the Sulu sultanate for Sabah to protect the country’s sovereignty, MP Karpal Singh said today.

The veteran lawyer and federal lawmaker (picture) said the court review was a necessary procedure to stop the Philippines from further staking ownership to the north Borneo state, based on a 17th-century claim from a Filipino Muslim clan that invaded Sabah last month, and triggered clashes that have killed eight Malaysian policemen and two soldiers.

“As an independent country, we should not be paying lease money. By paying, we are accepting that we are not independent,” the Bukit Gelugor MP was quoted as saying in George Town today by The Star Online news portal.

“With the passage of time and with Sabah having joined Malaysia as a sovereign state by having ambassadorial level representation in the country, it clearly means that the Philippines cannot lay any claim to Sabah,” he added.

Karpal, who is also DAP chairman, said the government’s top lawyer could seek a review of the 1938 Borneo High Court decision to initiate Malaysia’s bid to halt the RM5,300 annual payment to heirs of the Sulu sultanate.

“It is my view that the cessation payment constitutes a fit and proper case for the High Court in Kota Kinabalu to review the 1938 decision and order that the cessation payment be discontinued immediately,” he was quoted as saying.

Manila has been reported to be mulling taking the Sulu sultanate’s claim on Sabah to be adjudicated at the International Court of Justice at the Hague.

The Sulu Sultanate has laid claim to Sabah, saying it had merely leased North Borneo in 1878 to the British North Borneo Company for an annual payment of 5,000 Malayan dollars then, which was increased to 5,300 Malayan dollars in 1903.

The sultanate has claimed that the payment amounts to rental of Sabah, but Malaysia has argued that it is instead payment for the sultanate’s ceding of its rights over the land.

Sabah, however, joined Malaya, Sarawak and Singapore to form Malaysia in 1963, after which Malaysia continued paying an annual stipend of RM5,300 to the Sulu sultanate on the basis of the sultanate ceding the Borneo state.

In a referendum organised by the Cobbold Commission in 1962, the people of Sabah voted overwhelmingly to join Malaysia.

IF the Old Fart is the PM of Malaysia, rather unlikely, yes he would wage a war.

This war will be fought by soldiers drawn from the general population. Many will be killed or seriously injured. Mostly they will sons of peasants.

His son, the White Horse, will hesitate and dilly dally. Finally, behind the scenes, foreign advisors will come up with a winning strategy. When all the dust has settled, the Shit Times will give all the credit to the White Horse in preparation for his taking the helm after a decent interval with a seat warmer.

Fortunately for our neighbour, the Old Fart did not get his chance to be their PM. Unfortunately for the Little Red Dot which was unceremoniously kicked out of the Federation, zis AhLeeBaBa never ever relinquished the reins of power.

Bro, a bit of correction. Sabah was keen on the merger and Raja led the negotiations. But old man went it alone after Sultan met most of the terms and Sabah original position was not part of it. They felt betrayed as Singapore put together the original position. Raja mentioned this in some book or article.

Years later, when old man found out that the former Sabah Chief Minister Fuad Stephens who was part of the original negotiations was a major shareholder of Singapore Herald he panicked and thought it was payback and did a smear campaign and closed it.

Fuad Stephens wrote a personal letter later to him that it was not the case and a genuine family investment. By then people lost their jobs and families suffered. Guilty complex and paranoia.

Tks for the interesting tidbit. Old Man truly was an asshole as he was only using Sabah for leverage in his battle with UMNO.

Interestingly the British proposed and preferred it as the Admin of Borneo came under SIngapore British Admin. If there was trouble in that part of the world, British soldiers based in Singapore would be sent there. The local politicians however thought it was too ulu and never considered it and even sold Christmas Islands. The negotiations with the Borneo States were to pressurise the Tungku. Even Tungku did not want them and the British pressured the Tungku as they did not want the Indonesians to sway control.

And you are right - full of resources up to the eyeballs. What a waste.

The British today have a garrison in nearby Brunei. Wonder if they are frightened it will be taken over?
