<!-- START OF : div id="storytext"--><!-- more than 4 paragraphs -->THE trial of former Singaporean lawyer Gopalan Nair opened yesterday, with the prosecution arguing he has repeatedly insulted High Court Judge Belinda Ang through e-mail and postings on his blog.
Nair, 58, now an American citizen living in California, is charged with insulting Justice Ang in a blog posting on May29. It was posted online shortly after he attended a three-day court hearing over which she had presided.
The hearing was to assess damages in a defamation suit that Prime Minister Lee Hsien Loong and Minister Mentor Lee Kuan Yew won against the Singapore Democratic Party (SDP), its chief Chee Soon Juan and his sister Chee Siok Chin.
Nair wrote: 'The judge Belinda Ang was throughout prostituting herself during the entire proceedings, by being nothing more than an employee of Mr Lee Kuan Yew and his son and carrying out their orders.'
Yesterday, in setting out his case, Deputy Public Prosecutor Francis Ng first read out an e-mail sent in August 2006 to Justice Ang's secretary.
Nair, who represented himself, confirmed the e-mail was sent from his California law firm's account. It contained offensive language directed at the judge.
However, he denied he had sent it.
DPP Ng also referred to seven postings on Nair's blog, from March last year to April this year. These contained references to Justice Ang which were critical and offensive, he added.
'This shows the intention of the accused to insult,' DPP Ng said.
Nair objected, saying the 2006 e-mail and seven blog postings were irrelevant to the charge he faces.
Justice Kan Ting Chiu agreed.
DPP Ng yesterday also produced police statements that Nair had written himself after his arrest on May 31.
In these, Nair said he was not trying to describe Justice Ang as a prostitute. He said that in the English language, to prostitute oneself means to allow oneself to be used by others. And based on his observations at the SDP hearing, he felt the judge was biased and allowed herself to be used by the two leaders.
He also said he would apologise to Justice Ang if she had been offended by his words, which he said 'may have been inappropriate and impolite'.
At the hearing yesterday, Nair argued: 'The objective test is to look at the English language to see if the words were insulting. I will be producing dictionaries in court to see what is an insult.'
As for his May 29 blog posting which led to the charge, Nair also disagreed with DPP Ng that he sent an e-mail containing the posting and a link to his blog to Justice Ang's secretary on May 30.
The court also heard that Attorney- General Walter Woon received a similar e-mail and forwarded it to the Criminal Investigation Department.
But Nair said the sender's name on the e-mail messages was Pallichadath Gopalan Nair, a name he gave up for his present name when he became a US citizen in 2004.
Twice yesterday, he accused Assistant Superintendent Abdul Razak Jakaria, the case investigating officer, of sending the e-mail messages after arresting him. Nair said his e-mail password was in his notebook, an item seized from him on his arrest.
If found guilty, Nair can be jailed for up to a year, fined up to $5,000, or both.
The trial continues today.
