SINGAPORE: A man who defaulted on National Service (NS) for more than a decade was sentenced to four months' jail on Thursday (Feb 2).

Jonathan Tan Huai-En, 28, pleaded guilty last month to two counts under the Enlistment Act, for remaining outside Singapore without a valid exit permit for 10 years, four months and 13 days.

His lawyer Josephine Choo said Tan, who was granted S$10,000 bail, plans to appeal the sentence.

Noting the importance of NS to Singapore’s safety and security, District Judge Shawn Ho said: “An individual cannot cherry-pick when he serves NS. It would be unfair to allow an individual to defer NS to further his education or life pursuits and thereby gain an advantage over his peers who would have to sacrifice by postponing such pursuits.

“Regardless of station in life and background, for the past 50 years of NS … over 900,000 male Singaporeans – sons following their fathers – have served NS,” he added.

Tan is the older son of Senior Counsel Tan Chee Meng, the deputy chairman of law firm WongPartnership. When the boy was 12, he moved to Canada with his mother, older sister and younger brother because the two boys had struggled with studying the Chinese language in school. The family had not planned to return to Singapore, and became Canadian citizens in 2005.

But Judge Ho said Tan had “reaped the benefits” of Singapore’s education system, having completed primary school here, and “retains a substantial connection to Singapore” due to his father having remained here.

When Tan failed to register for NS after three registration notices were sent to his Singapore address, a police gazette was raised against him in late 2006. In 2009, Tan’s father told the Central Manpower Base (CMPB) of his son’s intention to renounce his Singapore citizenship. But he was blocked from doing so as he had not fulfilled his NS obligations.

Back in Canada, Tan went on to secure a degree in applied sciences, a masters in engineering and a job with a multinational based there. In 2013, he wanted to visit his sick grandfather in Singapore but his mother told him he would be arrested upon return. Tan then began making arrangements to return to his birthplace.

He arrived in 2015, enlisted in NS the next year and is currently serving his vocation as a preventive medicine technician.

In sentencing Tan, Judge Ho said due weight was given to a good testimonial from his superior during NS, along with his admission of guilt and the fact that he surrendered himself.

His “culpability flowed not from the fact that he left for Canada, but from him remaining there even after he knew he was required to register for a valid exit permit or return for NS”, the judge concluded.

Tan’s younger brother Isaac, 25, has also returned to Singapore and is under investigation.

Wondered if he ever go to bmt....the exercises alone will trigger a heart attack in him....not to say that he will ever take an IPPT test...sure PES D and below.....complete NS, most likely exempted from reservist due to medical reason....

He may be very fat or obese, or not good looking, and was found guilty by a Singapore Court, but I am not tolerant of his obesity.
Regardless, I do not recall calling any other individual, a bastard, not even my worst enemy.

SINGAPORE — The elder son of senior lawyer Tan Chee Meng was sentenced to 16 weeks’ jail on Thursday (Feb 2) for defaulting on his National Service (NS) obligations for over a decade.

Jonathan Tan Huai En, 28, was supposed to start serving his sentence immediately but was allowed to be released on a S$10,000 bail after indicating that he intends to appeal the court’s decision.

In sentencing Tan, District Judge Shawn Ho stressed that NS obligations apply to all eligible Singaporean males: “An individual cannot cherry-pick when he serves NS ... It would be unfair to allow an individual to defer his NS so as to further his education of life pursuits and thereby gain an advantage over his peers who would have had to sacrifice by postponing such pursuits.”

Even if one is residing overseas, he should return to fulfil his NS obligations to “negate any unfair advantage over his local peers”, added the judge, noting that Tan had amassed two degrees and landed a career at a multinational company in Canada in the time he defaulted on serving NS.

He returned to Singapore and started serving NS on Jan 8 last year as a preventive medicine technician.

The court was told that Tan migrated to Canada with his family in December 2000 because he and his brother were unable to cope with studying Chinese language in school. He received

Canadian citizenship in 2005, and continued to study and work there.

Only his father, a Senior Counsel and deputy chairman of WongPartnership, remained in Singapore due to a lack of work opportunities overseas.

The Ministry of Defence (Mindef) sent three notices between December 2005 and June 2006 informing Tan to register for NS and medical screening. Central Manpower Base (CMPB) officers also visited his father’s registered address at a Hillview condominium twice.

His father informed CMPB in 2009 that Tan wanted to give up his Singapore citizenship and asked if his son’s NS obligations could be waived, but was told that he would first have to serve NS before renouncing his citizenship.

CMPB also told Mr Tan Chee Meng that his son had been classified as a defaulter, and would have to return to Singapore as soon as possible.

Seeking a jail term of five months, the prosecution charged that Tan had benefited from his Singapore citizenship by completing his primary education here, but never renounced his citizenship despite moving to Canada and becoming a citizen there.

The defence, however, pleaded for a fine or community-based sentence.

District Judge Ho said a custodial term in Tan’s case was “entirely foreseeable” given the length of his default period. He noted that Mindef had “consistently and publicly” stated — since a Ministerial Statement in 2006 — that it would be asking the prosecution to press for jail sentences in “serious cases” of more than two years’ default.

The judge said he had intended to impose a 20-week jail term but granted Tan a one-month reduction after considering a testimonial from Tan’s superior in NS, who described him as an “excellent trainee”, and a “role model” with an “excellent work ethic”.

He also took into account Tan’s plea of guilt and the fact that he surrendered himself.

Tan’s younger brother Isaac, 25, has also returned to serve NS and is under investigation.

He was only 12 when he left singapore. Dont think there are many such cases. Hefty fine say s$1m in lieu of jail time.

Actually this guy returned to serve his NS. Just that he decided to finish his studies first.

Korea has a program that allows the men to decide when they want to serve their NS. I think it wouldn't be too disruptive to adopt that approach as well.

If you implement 1 million dollar fines and jail times of 20 years, all it would do is send the CLEAR message that Singapore does not want these males to go back to serve their NS. Stay away from Singapore. I think that would be good actually.

Right now the message is so hazy. Obviously, this Tan fellow calculated that it is still worthwhile to return to Singapore to serve NS.
