A 61-year-old woman from China exposed to have paid a Singaporean S$4,000 for a fake marriage, along with a monthly S$400 payment to secure her Singapore Permanent Residency, is now demanding to inherit her recently-deceased “husband’s” S$200,000 CPF money.

52-year-old divorcee Singaporean, Sun Shui Yuan, died from brain hemorrhage in August 2013. When he was alive, he married a China woman 5 years older than him, Diao Yen Mei, in Oct 2012, in order to receive S$4,000 in lump sum and a monthly payment. Diao Yen Mei was also a divorcee and a dependent pass visa holder in Singapore for her son on a student visa. She is currently a Permanent Resident of Singapore. When the Singaporean was alive, the two did not live together because Diao Yen Mei alleged that her husband wants to sleep in the same room as his mother. The two met only once a week for dinner and dates, she claimed. When the Singaporean died, Diao Yen Mei didn’t even know about his death.

When the China woman heard that Sun Shui Yuan died, she demanded to inherit his S$200,000 CPF money. However, this is stopped and contested by Sun Shui Yuan’s sisters. When Sun Shui Yuan was alive, he nominated his two sisters in his will in 2009. However, the fake marriage in 2012 automatically voided the will under the CPF law.

1 Normally, most people will do a nomination at CPF as to who to receive their CPF balances upon his/her death. Under CPF rules, the board will not recognise any provision made in a will, but will pay out the balance to whoever is nominated through the CPF using CPF forms. Presumably, deceased did make a nomination, but since the marriage is a sham, it is doubtful if the China 'wife' was nominated. This leaves his sisters, who most likely had been nominated as beneficiaries and thus CPF will pay the balance to them. He further strengthened this by making similar provisions in his will.

2 Unless, deceased did not do a CPF nomination. In that case, he did make a provision in his will for his sisters to inherit his CPF balances. However, it is right that the will will be voided by his 'marriage', unless, he did do a revision to his will after his 'marriage' for his sisters to receive his CPF balances.

Who eventually will get the money will depend on the facts of the case as provided through the documents - whether have CPF nomination or not, whether any revision to his original will in 2009, etc. No point speculating unless everything is out in the open. The quality of reporting seems lacking when not all facts are gathered or presented by the media.

Was the marriage declared null and void as a sham marriage?

If not, it's is still officially a legal marriage. As pointed out, if no new nomination was made after the marriage, cpf goes to the spouse, i.e., the PRC woman who 'invested' initial $4000 and monthly premiums over the years.

If not already in place, I believe ah longs, being highly creative, already implemented it.

All CPF nominations are voided once a CPF member marries or remarries. So a member must renominates after his marriage. If not, follow law of intestacy.

MOM has to prove the marriage is a sham, sisters prove no use. Not recognised by law. But MOM is unlikely to bother. And LSS busy looking at his CPF statement every month
